AGENDA ITEM WORDING: Approval of a resolution approving an agreement to purchase Key
Largo Acreage (Parcel ID #00086680-000000) for conservation; authorizing the conveyance of two
areas of encroachment and historic use to the adjoining property owners; and authorizing the
Chairman to execute the deeds and associated closing documents.
ITEM BACKGROUND: This acquisition is proposed to protect property rights and the natural
The subject property consists of a 6.13 acre parcel on corner of US 1 and Samson Drive on the ocean
side of Key Largo near mile marker 101.
The property attributes are:
Tier designation: Tier 1 Natural Area.
Zoning designation: Urban Commercial and Urban Residential (UC and UR)
Vegetation: Tropical hardwood hammock.
Sea Level Rise: The Southeast Florida Regional Climate Change Compact sea level rise
projection for the period from 2000 to 2070 is 21 to 54 inches. In the event of a 36-inch
increase in sea level, estimates provided by the South Florida Water Management District
indicate this property will have a less than 25.1% probability of being inundated.
Acquisition List qualification: The property qualifies because it is Tier 1.
Florida Forever Boundary: This property is within the Florida Forever boundary.
Transferrable Development Rights (TDRs): 36.78

The property owner has agreed to sell the property for the price of $850,000. The estimated closing
costs for this transaction are listed in the agenda documentation.
There were two significant areas of encroachment and historic use found after the parcel was under
contract during surveying.
(1) A portion of the building owned by the Upper Keys Humane Society and surrounding area of
historic use; and
(2) A driveway providing access to the Key Largo Campground & Marina.
Staff is proposing each encroachment area be deeded to the adjacent parcel owners in order to
decrease the risk and liability associated with these encroachments and historic use.

If approved by the Governing Board, staff will contact the owners of the adjacent properties and
begin the process of deeding the land to each of them.
ADVISORY COMMITTEE ACTION: On December 15, 2021 the Committee voted 3/0 to
approve purchasing this property for the price of $850,000.
PREVIOUS RELEVANT GOVERNING BOARD ACTION: The Board has approved the
purchase of other conservation properties in this area of Key Largo.
