AGENDA ITEM WORDING: Approval of a contract to purchase Lot 1, Block 9, Tropical Bay
Third Addition (PB 5-81) with parcel number 00313950-000000 for density reduction purposes.
ITEM BACKGROUND: This acquisition is proposed to protect property rights, to reduce density,

agreement between MCLA and the County.
The subject property consists of an 8,000 square foot lot on the corner of Watson Boulevard and
Warbler Lane on the bay side of Big Key near mile marker 30.
The property attributes are:
Tier designation: Tier 2 Transition and Sprawl Area.
Zoning designation: Improved Subdivision-Masonry (IS-M)
Vegetation: The lot is in a mowed condition and has a mangrove hedge along the canal.
Sea Level Rise: The Southeast Florida Regional Climate Change Compact sea level rise
projection for the period from 2000 to 2070 is 21 to 54 inches. In the event of a 24-inch
increase in sea level, estimates provided by the South Florida Water Management District
indicate over half of this property will have a 25.1% to 100% probability of being inundated.
Florida Forever Boundary: This property is outside the Florida Forever boundary.
Transferrable Development Rights (TDRs): 1
The property owners have agreed to sell the property for the price of $50,000. The estimated closing
costs for this transaction will be approximately $1,144.25.
Pursuant to a 2022 agreement between the County and the Tropical Bay Property Owners
Association, Inc., the County will pay the property owners association an annual fee of $150.00 for
mowing and vegetative maintenance of the lot.
This lot should eventually be placed in the disposition/resale program to eliminate required
maintenance.

PREVIOUS RELEVANT BOCC ACTION: The Board budgeted funds for purchases which are
lawsuits through voluntary purchases. On February 16, 2022 the Board entered into a First
Amendment to Agreement with the Tropical Bay Property Owners Association, Inc. for mowing and
vegetative maintenance services on those lots acquired by the County in Tropical Bay subdivision.
