Transportation (FDOT) to release the County's interest in FDOT parcel 551, Big Pine Key Florida.
Authorization for the Administrator to send a letter to FDOT expressing the County's response to its
request.
ITEM BACKGROUND: FDOT acquired the subject parcel known as FDOT parcel 551 from the
County in 1977 with a clause that provided it would be returned to Monroe County upon the
conditions that it was no longer used by FDOT for the specified purposes and upon a request by the
County for its return. FDOT has leased the parcel to the owners of the Fish Camp on Big Pine Key
since 1996. In 2019, the owners of the Fish Camp asked to purchase the parcel. On November 24,
2020, the Department reviewed the parcel and approved the disposal of only a portion of the parcel
(see Exhibit A enclosed in letter in the backup) thus preserving enough right of way for future
transportation needs. FDOT realized during the due diligence that this parcel is subject to a reverter
clause to the County and requests that the County release its rights to FDOT of the parcel.This
agenda item also seeks approval for the County Administrator to send a letter to FDOT of the
decision of the BOCC.
PREVIOUS RELEVANT BOCC ACTION:
24 MAY 1977 BOCC transferred the property to FDOT with a clause providing for reversion to
County ownership if the parcel was not needed by FDOT for right of way,
parking, or as a park.

TheDepartment’sobjectiveistoobtainthereleasethusallowingtheDepartment
toproceedwiththesaleoftheparceltotheprospectivebuyer;onthealternative,have
theCountyformallyrequest tohaveParcel551returnedtothemin accordancewiththe
following:
TheDepartmentownstheright-of-waypursuanttoMonroeCountyDeed
recordedinORB715, Page82, acopy attachedhereto,theCountyhavingreceivedthe
rights-of-waypursuanttotheOverseesRoad&TollBridgeDistrictDeedBookG6,
Page 44, which deed contains the Section31/T66S/R30E. A covenant was just recently
discoveredintheCountydeeduponreviewofatitlesearchinpreparationforthesale.
Thecovenantreads,“thegrantee\[FDOT\]agreesandbindsitselftoreturntoMonroe
County,Florida,anyoftheproperty…conveyedwhichisnotusedforrightofwayor
otherroadpurposesuponcompletionofconstructionandimprovementsbythegrantee
uponrequestbygrantor”.Asaresult,thesalehasbeenhaltedpendingthe
determination of the County to release its interest in the Parcel or its request to havethe
Parcel returned to them.

•Parcel551islocatedadjacenttotheBigPineKeyFishingLodgelocatedat
33000 Overseas Highway, Big Pine Key.
•FDOT has leased the Parcel to the Lodge since 1996.
•In 2019, the Lodge’s owners requested to purchase the parcel.
