AGENDA ITEM WORDING: Authorization to initiate litigation against SARAH D. CURRY and
her property, 399 Balido Street, Stock Island, Florida, to seek compliance with the County Code and
enforce the lien(s) arising from code compliance case number CE18070105.
ITEM BACKGROUND:
CE18070105: This property has been the subject of a code compliance case for failure to obtain
required building permit(s) for installation of soffits/roof. The fines total $98,300.00 as of February
8, 2022 and will continue to accrue at $100.00 per day, until compliance is achieved.
A hearing was scheduled for February 28, 2019 and the property owner was present. The Special
Magistrate found the property in violation and ordered a compliance date of May 30, 2019. The
the property owner was present, along with her daughter and grandson. The Special Magistrate
collections. The code case remains open for non-compliance and failure to pay outstanding fines
and costs. There is a permit that has been ready to be issued for the roof since October 2020.
The Monroe County Property Appraiser shows the property has a just market value of $376,212.
The property is homesteaded and there are no pending foreclosure actions at this time. There is a
$110,000 mortgage on the property (maturity date March 1, 2034). There is a $293 superior lien
held by KW Resort Utilities.
Under the policy adopted in Resolution 057-2014 the available legal options in regard to the
n this property are:
1. Initiate litigation against the property owner for injunction and money judgment;
2. Allow the liens to remain against the property owner, the subject property and any other
property owned by the property owner; and/or
3. Release the lien.
