ITEM BACKGROUND: Setback of existing front fence line to Key Largo Animal Shelter property before Florida Department of Transportation Right of Way does not permit enough room for parking at front of the facility. Development of an Accessible route and entrance to existing facility cannot be deemed feasible unless enough space can be allocated for the use of accessible routes or parking. Florida Department of Transportation has deemed said right of way land "Surplus" and has agreed to deed said land to Monroe County for the Necessary use of providing an accessible Public Entrance to the existing Public Facility. PREVIOUS RELEVANT BOCC ACTION: On regular meeting dates of August 15th 2012 and May 16ffi 2012 the Board of County Commissioners Approved and authorized the Award of Contracts for ADA Accessibility Segments 1 and 2 to begin construction on the scope of work developed in the ADA transition plan for Monroe County facilities as a result of the Americans with Disabilities Act assessment previously conducted on Monroe County Facilities authorized by the Board of County Commissioners. WHEREAS, Chapter 255 Section 21, Florida Statutes, makes it necessary that facilities made available for use by the public be accessible by all the public; and WHEREAS, the parcel described in Exhibit "A" to this Resolution will serve the public purpose of providing ADA accessible parking to the Key Largo Animal Shelter; and WHEREAS, Said parcel was expanded as a result of Resolution 146-2012 road abandonment approved on the Date of May 16, 2012, and WHEREAS, Monroe County has implemented an Accessibility Plan and awarded a contract for construction to achieve the goal of meeting ADA Accessibility standards for Monroe County Owned and Operated facilities the construction at the Key Largo Animal Shelter to be completed within three (3) years, and WHEREAS, the Florida Department of Transportation has advised the county in a letter dated August 6, 2012, that it has approved for conveyance to the county a 30 foot wide portion of the right of way abutting the Upper Keys Animal Shelter as surplus property designated as Parcel Number 4804, for the public purpose of providing ADA compliant Parking; NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND THE COUNTY COMMISSION OF MONROE COUNTY, FLORIDA: 1. The Monroe County Board of County Commissioners hereby requests the Florida Department of Transportation to quit claim to Monroe County surplus right -of way located along US- 1, a legal description of the property is attached hereto and made a part hereof as Exhibit "A", at no cost, to allow for the establishment of ADA Accessibility to the existing facility.
