WHEREAS, on September 15, 2021, the Parties entered into a Collective Bargaining Agreement ("CBA") covering the time period Oct. 1, 2021 through Sept. 30, 2024; and WHEREAS,the Parties also wish to clarify and explain the hourly rates for flight nurses as specified in the Pay Plan for flight nurses attached as part of Appendix Ato the CBA. NOW THEREFORE,the Parties agree that the CBA will be clarified as follows: 1.Flight Nurse Salary. a.Flight nurses (including the Chief Flight Nurse) are not covered by Section 7(k) of the FLSA. Therefore, flight nurses begin to accrue overtime after 40 hours in awork week. However, flight nurses are scheduled to work 48 hours each week on Trauma Star. Itis estimated that flight nurses will work 2,080 hours in a calendar year (40 HPW x 52 weeks), and in addition, will typically accrue 416 overtime hoursbased on a projected 48/120schedule(working 48 hours per week, off 120 hours per week).(Annual, sick, or other leave taken during the year may reduce the number of overtime hours.) b.The Pay Plan for full time flight nurses attached on page 51 of the CBA as part of Appendix A ("Full Time Flight Nurse Salary with 416 Overtime Hours") showedtheblended average Њ hourly pay rates that would result if the flight nurses were to work 2,080 hours plus 416 overtime hours(total=2,496)in a year. c. The rates shown in Appendix A to the CBA are a combination of the regular rate of pay for 2,080 hours,plus overtime pay at the rate of time and one-half the regular rate of pay for all hours worked in excess of 40 in a workweek,based on an estimated1416 overtime hours per year. d. For purposes of clarification only,attached hereto as Exhibit A to this MOU is the chart showing the regular rates of pay that will be paid for the first 2,080 hours for each of the steps for flight nurses shown in Appendix A to the CBA. Each of these rates,if multiplied by 1.5 for 416 overtime hours,equates to the blended hourly rates shown in Appendix A to the CBA. 2. This MOU is intended to serve as a clarification for the CBA and its application is retroactive to 10/1/2021. 3. The Parties agree that the above provisions are intended to serve as clarification of the affected articles and appendices within the CBA and do not affect any other provision of the Collective Bargaining Agreement.
