Approval by the Monroe County Board of County Commissioners of a resolution supporting Harry
Bethel for a position on the Florida State Retirement Commission.
ITEM BACKGROUND:
A position has become open on the "State Retirement Commission" of the State of Florida. Harry
Bethel, Key West resident and former City Commissioner has 41 years experience with pension plans
in Monroe County including the Florida Retirement System (FRS) that covers the employees of
Monroe County, Monroe County Sheriff's Department, Monroe County School Board, and the Monroe
County Mosquito Control District.
PREVIOUS RELEVANT BOCC ACTION:
BOCC has moved similar resolutions of support including Honorable Sandra Taylor for 16th Judicial
Court (Res 152-2007) Ed Scales for 3rd District Court of Appeal (Res 300-2010) and Karl Borglum as
Monroe County Property Appraiser Res 130-2011).

WHEREAS, Harry L. Bethel has served the Key West and Monroe County community for
forty-one (4 1) years in elected, public and community services; and
WHEREAS, Harry L. Bethel has previously served as a member of the City of Key West
Pension Board of Trustees for the Police and Firemen, served as liaison City Commissioner of the City
of Key West to the General Employees and the Police and Firemen's Pension Board and has served as
a member of the Key West Housing Authority Pension Board of Trustees; and
WHEREAS, Harry L. Bethel currently (and since 1988) is Chairman of the Keys Energy
Service Pension Board of Trustees having previously served on the Board for approximatel3v40 years;
and
WHEREAS, Harry Bethel has served as a member and as Chairman with honor and
distinction; and
WHEREAS, Harry L. Bethel will bring the perspective of a rural county to the Florida
Retirement Commission; and
WHEREAS, Harry Bethel is a strong, efficient and effective leader, extremely knowledgeable
in public pension matters; and
WHEREAS, if Harry Bethel is appointed he will serve well and faithfully;
NOW, THEREFORE, be it resolved that the Monroe County Board of County
Commissioners recommend and endorse Harry Bethel for a position on the Florida State
Retirement Commission.

SUPPORTING AND RECOMMENDING THE APPOINTMENT OF HARRY L.
BETHEL TO A POSITION WITH THE STATE OF FLORIDA RETIREMENT
COMMISSION,
WHEREAS, the Florida Keys Aqueduct Authority, an Independent Special District of the State
of Florida, was created by Special Legislation, Chapter 76-441, Laws of Florida, as amended, to
provide potable water and wastewater services to the Florida Keys; and
WHEREAS, Harry L. Bethel was an employee of the Florida Keys Aqueduct Authority for
nineteen years, retiring January 2, 2009 at the position of Department Director of Customer
WHEREAS, Harry L. Bethel has served our community for forty-one (41) years in elected,
public and community services; and
WHEREAS, Harry L. Bethel is currently Chairman of the Keys Energy Service Pension Board

WHEREAS, Ervin Higgs has submitted his resignation from his elected position as Monroe County Property
Appraiser prior to the end of his term; and
WHEREAS, Governor Scott shall have the opportunity to appoint someone to fill out Mr. Higgs' term; and
WHEREAS, Karl Borglum has ably served as Mr. Higgs' second -in -command for a number of years; and
WHEREAS, Mr. Borglum has made numerous presentations to the Board of County Commissioners and the
Value Adjustment Board of Monroe County, providing much needed information about the office budget and
the appraisal process, and, most importantly, understandable explanations about the tax implications of
declining market values in recent years; and
WHEREAS, Mr. Borglum has proved his ability to serve the public and to lead the Office of the Property
Appraiser in a fair and trustworthy manner; now therefore
1. The Board highly recommends to Governor Scott the appointment of Karl Borglum as Monroe County
Property Appraiser.

COURT OF APPEAL.
WHEREAS, Monroe County is one of only two counties within the jurisdiction of the
Third District Court of Appeal; and
WHEREAS, since creation of the Third District Court of Appeal in 1957, no lawyer
from Monroe County has ever been appointed to serve as judge on that panel; and
WHEREAS, due to the unique characteristics of the Florida Keys and the concomitant
unique legal issues, it is imperative that those who sit in judgment over Keys' cases have an
informed appreciation for both the Keys and the ramifications of the decisions affecting them;
and
WHEREAS, Mr. Edwin Scales has submitted his application to fill a vacancy on the
Third District Court of Appeal; and
WHEREAS, Mr. Scales is an accomplished appellate lawyer and is well qualified to
serve on the Third District Court of Appeal; and
WHEREAS, the Judicial Nominating Commission for the Third District Court of Appeal
has nominated Mr. Scales to serve on the Third District; and
WHEREAS, Mr. Scales has served the citizens of Monroe County with distinction for
many years in a variety of capacities including but not limited to serving as a City Commissioner
and a Commissioner on the Planning Board for the City of Key West, a member of the Board of
Trustees for the Florida Keys Community College, a member of the Monroe County Tourist
Development Council, and a member of the Judicial Nominating Commissions of the 16,'
Judicial Circuit and the Southern District of Florida; and
WHEREAS, Mr. Scales also served the citizens of the entire State of Florida through his
position as a member of the Board of Governors of the Florida Bar as well as counsel to the
Florida Citrus Commission and other clients;

WHEREAS, Monroe County is one of only two counties within the jurisdiction of

WHEREAS, since its creation in 1957, no lawyer from Monroe County has ever

WHEREAS, it is past time to correct this injustice, be it intentional or through
oversight; and
WHEREAS, due to the unique characteristics of the Keys and the unique nature
of legal issues facing the Keys and its citizens, many of which are cutting -edge issues
within Florida, particularly in the area of land use, affordable housing, and related issues,
it is imperative that those who sit in judgment over Keys cases have an informed
appreciation for both the Keys and its inhabitants; and
WHEREAS, the Honorable Sandra E. Taylor, Chief Judge of the Circuit Court for
the 16'h Judicial Circuit in and for Monroe County, has served the citizens of Monroe
County with distinction for over 20 years as a County Court and Circuit Court Judge; and
WHEREAS, the Honorable Sandra E. Taylor has submitted her application to
fulfill a vacancy currently existing on the Third District Court of Appeals; and
WHEREAS, the Honorable Sandra E. Taylor is well qualified to serve on the
Third District Court of Appeals,

The Judicial Nominating Commission for the Third District Court of Appeals
is respectfully requested to recommend the Honorable Sandra E. Taylor to the
Governor for appointment to fill the vacancy on the Third District Court of
Appeals, and
2. The Governor is respectfully requested to reject in its entirety any slate of
candidates to fill the current vacancy on the Third District Court of Appeals
that might be submitted by the Judicial Nominating Commission of the Third
District Court of Appeals if that slate that does not include the Honorable
Sandra E. Taylor; and
BE
3. The Governor is respectfully requested to appoint the Honorable Sandra E.
Taylor to fill the current vacancy on the Third District Court of Appeals; and
4, The Clerk of the Court for Monroe County is directed to immediately transmit
