AGENDA ITEM WORDING: A public hearing to consider approval of resolution renouncing and disclaiming
any right of the County and the public in and to the platted, undeveloped right-of-way, that is located at Mile
Marker 106 in Section 1, Township 61 South, Range 39 East and Section 6, Township 61 South, Range 40 East,
Key Largo, Monroe County, Florida according to P.F. Jenkins Model Land Company plat (PB1-68) as requested
by Keys Lake Villas, LLC.
ITEM BACKGROUND: The Keys Lake Villas site (RE No. 00083970.000000) was previously known as
Lakeview Gardens. Prior to Lakeview Gardens, the site was known interchangeably as the Florida Keys RV
Park and the Happy Vagabond, which was developed and utilized as a 126-unit RV park with 13 permanent
residential units in the form of mobile homes. The petitioner has submitted a road abandonment petition in
order to establish the property line that will insulate the 110-unit affordable housing project approved by
Planning Commission Resolution No. P27-08 from potential traffic and create a vegetative buffer as required by
HUD. More specifically, the road abandonment petition is for a 30 foot wide, unnamed, unbuilt and not used,
platted road with a length of 1,275.13 feet for a total of approximately 37,932 SF.
The County -owned property adjacent to the Key Lake Villas property is currently being leased by Humane
Animal Care Coalition. If the road abandonment request is granted, the property owned by Monroe County
would be increased in size and would gain 15 feet along the approximate 455-foot length of the eastern property
boundary for a total of approximately 6,825 SF. The tenant has no objection to the abandonment.
Other parcels along the 1275.13 feet road abandoned area would also gain additional land.
PREVIOUS RELEVANT BOCC ACTION: At the April 18, 2012 BOCC meeting, the BOCC approved
Resolution No. 125-2012 setting a public hearing for May 16, 2012 in Key Largo for this request. Also at the
April meeting, the BOCC authorized the County Administrator to provide a letter of no objection on behalf of
Monroe County as an affected property owner. On March 19, 2008, the BOCC entered into a development
agreement with Northstar Resort Enterprises Corp., requiring the applicant to construct 110 affordable housing
units.

WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to
renounce and disclaim any right of the County and the public in and to the hereinafter streets,
alley -ways, roads or highways; and
WHEREAS, due notice has been published and a public hearing has been held in
accordance with Chapter 336, Florida Statutes; and
WHEREAS, at said public hearing the Board considered the argument of all parties
present wishing to speak on the matter, and considered the renouncing and disclaiming of any
right of the County and public in and to the hereinafter described streets, alley -ways, roads, or
highways as delineated on the hereinafter described map or plat; and
WHEREAS, the Board has determined that vacation of the said road is for the general
public welfare, and conforms to the requirement of Florida Statute Sections 336.09 and 336.10;
and
NOW THEREFORE, E IT RESOLVED BY THE BOARDOF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLOIDA, that it hereby renounces and
disclaims any right of the County and public in and to the following described streets, alley-
ways, roads, or highways as delineated on the hereinafter described map or plat, to -wit:
"The right-of-way corridor of a 30 foot wide, un-named road in Section 1, Township 61
South, Range 39 East and Section 6, Township 61 South, Range 40 East, Key Largo, Monroe
County, Florida, according to the P.F. Jenkins Model Land Company Plat, recorded in Plat
Book 1, Page 68 of the public records of Monroe County, Florida, and being more particularly
described as follows:
Begin at the Point of Intersection of the centerline of said 30 feet wide un-named road,
being also the line common to Lots 9 and 12 of said P.F Jenkins Plat, with the south-easterly
right of way line of State Road No. 5 (US Highway No. 1), said Point of Intersection lying 116
feet, measured at right angles, from the centerline of the former Florida East Coast Railway.
From said Point of Beginning, thence S 0°40'47"E along the centerline of said 30 feet wide un-
named road, being also the line common to Lot 9 and Lot 12, and common to Lot 13 and Lot 16,
all according to said P.F. Jenkins Plat, for 1275.62 feet to the south line of Lot 16 of said Plat,
and the Point of Termination of the herein described centerline. Subject right of way corridor
contains 37,932 square feet (0.8708 acre), more or less. "

19 REQUEST: The petitioner, Keys Lake Villas, LLC, has requested abandonment of a platted,
20 undeveloped right-of-way in Section 1, Township 61 South, Range 39 East and Section 6, Township 61
21 South, Range 40 East, Key Largo, Monroe County, Florida, according to P.F. Jenkins Model Land
22 Company Plat, recorded in Plat Book 1, Page 68 of the public records of Monroe County, Florida. If
23 this request is approved, it would allow the petitioner to establish the property line that will insulate the
24 110-unit affordable housing project approved by Planning Commission Resolution No. P27-08 from
25 potential traffic and create a vegetative buffer as required by HUD.

27 REVIEW: The Keys Lake Villas site (RE No. 00083970.000000) was previously known as Lakeview

35 It should be noted that the northern portion of the platted, undeveloped right-of-way is only 15 feet wide
36 and runs south for 81.62 feet before the right-of-way widens to 30 feet.

38 Monroe County owns property (Re No. 00084140.000000) that is currently being leased by Humane
39 Animal Care Coalition and is located adjacent to the west of the Keys Lake Villas property. If the road
40 abandonment request is granted, the property owned by Monroe County would be increased in size and
41 would gain 15 feet along the approximate 455-foot length of the eastern property boundary for a total of
42 approximately 6,825 SF. The Engineering Department is currently pursuing the possibility of obtaining
43 a portion of surplus right-of-way along the front of US 1 from FDOT. The amount of surplus right-of-
44 way being requested by the County is 30 feet wide by 331 feet long. The County project would not
45 affect the requested abandonment area.

1 This petition has been reviewed by County staff and written recommendations of no objection were
2 received from Monroe County Engineering Services, Fire Marshal, Code Compliance, and the Monroe
3 County Sheriffs Office.

5 Letters of no objection have been received from all four adjacent property owners; Oscar Garcia (RE
6 No. 00084180.000000), Jose Gill Perez (RE No. 00084160.000000), Florida Keys Electric Cooperative
7 Association, Inc.-FKEC (RE No. 00084150-000000), and Monroe County (RE No. 00084140.000000).

9 In addition to the letter of no objection from KFEC as an affected property owner, FKEC also provided
10 a letter of no objection as a utility provider. Other utility providers that provided letters of no objection
11 include Florida Keys Aqueduct Authority, Key Largo Wastewater Treatment District and Comcast.

13 Monroe County Code Section 19-1 - Abandonment of rights -of -way states:
14
15 (a) No dedicated and accepted right-of-way in the county shall be abandoned where:
16 (1) the right-of-way terminates on a body of open water; or
17 • The platted, undeveloped right-of-way does not terminate on a body of
18 open water.
19 (2) the right-of-way provides access to the public to land on open water; or
20 • The platted, undeveloped right-of-way does not provide access to the
21 public to land on open water.
22 (3) the abandonment would preclude a way for the public to maintain access to the water.
23 • The abandonment would not preclude a way for the public to maintain
24 access to water.

26 (b) In all other cases of abandonment, no right-of-way shall be abandoned unless there is an
27 agreement to do so by all affected property owners. For purposes of this subsection, an
28 affected property owner is the owner of property which, if the right-of-way is abandoned,
29 will:
30 (1) Have access that is currently used by that property owner eliminated;
31 • The requested abandonment is for a platted, undeveloped right-of-way
32 that is not being used for access by the property owner. Aerial
33 photography shows the property has been accessed by two entrances off
34 US 1 since at least 1977.
35 (2) Have the only platted access eliminated;
36 • As noted above, the property has been accessed by two entrances to US
37 1 since at least 1977.
38 (4) Have the paved area adjacent to that property increased for turn -around purposes; or
39 • There are no paved areas adjacent to the adjoining properties and there
40 are no proposed plans for a turn -around.
41 (4) Be increased in size.
42 • There would be no increase in size.

44 (c) A road may be abandoned only at the terminal portion of the road and in its full width unless
45 the abandonment will comply with the County Code requirements for road, turn -around, and
46 fire -rescue access and one of the following circumstances exists:
47 (1) An adjacent lot owner has on the platted right of way or within a setback a substantial
48 structure which predates the Special Session Law 59-1578 perta ring to maps, plats
49 and right of way. The term "substantial structure' specifically does not include wood

I or metal fences, sheds or tiki huts or other items not listed which are accessory
2 structures.
3 • There are no substantial structures within the right-of-way area or the
4 side yard setback. However, it has been noted by the Engineering
5 Department that the adjacent County -owned property has space issues
6 and that there may be storage trailers encroaching on the platted,
7 undeveloped right-of-way being requested for abandonment.

9 (2) The abandonment is requested by a County department or governmental agency for a
10 public purpose.
11 • The abandonment request is not by a County department or
12 governmental agency, although HUD requested Keys Lake Villas
13 petition for the abandonment in order to create a vegetative buffer
14 along the property line.

16 (d) The board of county commissioners considers these a restriction on the rights of individuals
17 who desire to abandon properties in accordance with F.S. § 336.09.
18 ® The petitioner meets the criteria above; therefore, there are no
19 restrictions on the rights of Keys Lake Villas, LLC
20
21 The requested abandonment of a platted, undeveloped right-of-way in Section 1, Township 61 South,
22 Range 39 East and Section 6, Township 61 South, Range 40 East, Key Largo, Monroe County, Florida,
23 according to P.F. Jenkins Model Land Company Plat, recorded in Plat Book 1, Page 68 of the public
24 records of Monroe County, Florida meets the criteria cited above and is therefore suitable for
25 abandonment.

I have reviewed the referenced road abandonment application. The legal description describes
the 30 foot wide right of way around the cen ' e; however, the northernmost portion of the
corridor proposed for abandonment is only 15 fed wide so I question whether the legal
description is entirely
Monroe County is named as one of the affected 'es since the Upper Keys Animal Shelter
pro abuts the right of way proposed for abandonment. I am not sure who is authorized to
write a letter of no objection on behalf of the County as an affected property owner but an
Engincermg perspective there are no issues other than the legal description.
I spoke with Jerry Barnett, Director of Project MaMement who has been working on a project
at the Upper Keys Animal Shelter property; he informed me that time are some spa= issues
thm (lack of g) and that trailers at the site may be encroaching on the right of way for
which abandonment is sought. Due to these issues, should the BOCC approve the abandonment
petition, En ' ject Management recommends that the County reWn the 15 $. wide
portion adjacent to the Animal Shelter property that would revert to the County.

A petition has been submitted to Monroe County by Keys Lakes Villas, LLC for the abandonment of
a platted, undeveloped right-of-way located in Section 1, Township 61 South, Range 39 East and
Section 6, Township 61 South, Range 40 East, Key Largo, Monroe County, Florida according to the
P.F. Jenkins Model Land Company plat (PB 1-68).
Monroe County owns property (RE No. 00084140.000000) that is currently being Ieased by the
Humane Animal Care Coalition and is located adjacent to the west of the Keys Lake Villas, LLC
property. Therefore, Monroe County is an affected property owner and is required to submit a letter
of no objection.
At the April 18, 2012 BOCC meeting, the BOCC determined that, as an affected property owner,
there are no objections to the requested road abandonment by Key Lake Villas, LLC.

TOWNSHIP 61 SOUTH, RANGE 39 EAST AND SECTION 6,
TOWNSHIP 61 SOUTH, RANGE 40 EAST, KEY LARGO,
MONROE COUNTY, FLORIDA, ACCORDING TO P.F.
JENKINS MODEL LAND COMPANY PLAT, RECORDED IN
PLAT BOOK 1, PAGE 68 OF THE PUBLIC RECORDS OF
MONROE COUNTY, FLORIDA.
WHEREAS, the Board of County Commissioners of Monroe County, Florida, has
reodved a petition to renounce and disclaim any right of the County and the public in and to the

follows: Begin at the Point of Intersection of the centerline of said 30 feet wide unnamed road

right of way line of State Road No. 5 (US Highway No. 1), said Point of Intersection lying 116
feet, measured at right angles, from the centerline of the former Florida East Coast Railway.
From said Point of Beginning: thence S 0'40'47 "E along the centerline of said 30 feet wide un-
named road being also the line common to Lot 9 and Lot 12, and common to Lot 13 and Lot 16,
all according to said P.F. Jenkins Plat, for 1275.62 feet to the south line of Lot 16 of said Plat,
