ITEM BACKGROUND: Resolution #167-2011 approved on June 15, 2011 implemented the cost of providing services associated with the building permitting and inspection system through a fee schedule. This resolution did not include a fee for administrative appeal of building official decisions or research fee. In addition, multiple two-year extensions have been authorized by the Florida Legislature. Generalizing the title of the fee will allow for continued use without revisions. This resolution also clarifies that work commencing before permits are issued are subject to a one -hundred percent (100%) penalty. WHEREAS, the Monroe County Board of County Commissioners wish to provide the citizens of the County with the best possible service in the most cost effective and reasonable manner; and WHEREAS, the Board finds that it would be in the best interests of the public to charge the true cost for such services, thereby placing the burden of such costs directly upon those parties deriving the benefit from such services; and WHEREAS, the updated fee schedule prepared by the Growth Management Director for providing these services includes the estimated direct costs and reasonable indirect costs associated with the review and processing of administrative appeals of the Building Official, and other processes and services; and does reflect the true cost of providing the services to the persons requesting the Building Department services; and WHEREAS, The Florida State Legislature is considering legislation which allows for extensions of time for Building Permits for which the fee is currently $250.00, based on previous Senate and House bills but which fee may be eliminated by the legislature; and WHEREAS, the Florida Building Code Sec. 109.4 Work Commencing Before Permit Issuance - requires a penalty of 100 percent of the usual permit fee in addition to the required permit fees; and WHEREAS, the Board heard testimony and evidence presented as to the appropriate fee schedule; and 1 WHEREAS, the Board concurs with the conclusions and findings of the Growth Management Director; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA (Deletions are sb4eken Offough and additions are underlined. The building official may accept a sworn affidavit from a registered architect or engineer stating that the plans submitted conform to the technical codes. For buildings and structures, the affidavit shall state that the plans conform to the laws as to egress, type of construction and general arrange- ment and, if accompanied by drawings, show the structural design and that the plans and design conform to the require- ments of the technical codes as to strength, stresses, strains, loads and stability. The building official may, without any examination or inspection, accept such affidavit, provided the architect or engineer who made such affidavit agrees to submit to the building official copies of inspection reports as inspec- tions are performed and upon completion of the structure, elec- trical, gas, mechanical or plumbing systems a certification that the structure, electrical, gas, mechanical or plumbing system has been erected in accordance with the requirements of the technical codes. Where the building official relies upon such affidavit, the architect or engineer shall assume full responsi- bility for compliance with all provisions of the technical codes and other pertinent laws or ordinances. The building official shall ensure that any person conducting plans review is quali- fied as a plans examiner under Part XII of Chapter 468, Florida Statutes, and that any person conducting inspections is quali- fied as a building inspector under Part XII of Chapter 468, Florida Statutes. SECTION 108 TEMPORARY STRUCTURES AND USES 108.1 General. The building official is authorized to issue a permit for temporary structures and temporary uses. Such per- mits shall be limited as to time of service, but shall not be per- mitted for more than 180 days. The building official is authorized to grant extensions for demonstrated cause. 108.2 Conformance. Temporary structures and uses shall con- form to the structural strength, fire safety, means of egress, accessibility, light, ventilation and sanitary requirements of this code as necessary to ensure public health, safety and gen- eral welfare. 108.3 Temporary power. The building official is authorized to give permission to temporarily supply and use power in part of an electric installation before such installation has been fully completed and the final certificate of completion has been issued. The part covered by the temporary certificate shall comply with the requirements specified for temporary lighting, heat or power in Chapter 27 of the Florida Building Code, Building. 108.4 Termination of approval. The building official is autho- rized to terminate such permit for a temporary structure or use and to order the temporary structure or use to be discontinued. SECTION 109 FEES 109.1 Prescribed fees. A permit shall not be issued until fees authorized under Section 553.80, Florida Statutes, have been paid. Nor shall an amendment to a permit be released until the additional fee, if any, due to an increase in the estimated cost of the building, structure, electrical, plumbing, mechanical, or gas systems, has been paid. 109.2 Schedule of permit fees. On buildings, structures, elec- trical, gas, mechanical, and plumbing systems or alterations requiring a permit, a fee for each permit shall be paid as required, in accordance with the schedule as established by the applicable governing authority. 109.3 Building permit valuations. Reserved. 109.4 Work commencing before permit issuance. Any person who commences any work on a building, structure, electrical, gas, mechanical or plumbing system before obtaining the building official's approval or the necessary permits shall be subject to a penalty of 100 percent of the usual permit fee in addition to the required permit fees,. 109.5 Related fees. Reserved. 109.6 Refunds. Reserved. SECTION 110 INSPECTIONS 110.1 General. Construction or work for which a permit is required shall be subject to inspection by the building official and such construction or work shall remain accessible and exposed for inspection purposes until approved. Approval as a result of an inspection shall not be construed to be an approval of a violation of the provisions of this code or of other ordi- nances of the jurisdiction. Inspections presuming to give authority to violate or cancel the provisions of this code or of other ordinances of the jurisdiction shall not be valid. It shall be the duty of the permit applicant to cause the work to remain accessible and exposed for inspection purposes. Neither the building official nor the jurisdiction shall be liable for expense entailed in the removal or replacement of any material required to allow inspection. 110.2 Preliminary inspection. Before issuing a permit, the building official is authorized to examine or cause to be exam- ined buildings, structures and sites for which an application has been filed. 110.3 Required inspections. The building official upon notifi- cation from the permit holder or his or her agent shall make the following inspections, and shall either release that portion of the construction or shall notify the permit holder or his or her agent of any violations which must be corrected in order to comply with the technical codes. The building official shall determine the timing and sequencing of when inspections occur and what elements are inspected at each inspection. Building 1. Foundation inspection. WHEREAS, the Monroe County Board of County Commissioners wish to provide the citizens of the County with the best possible service in the most cost effective and reasonable manner; and WHEREAS, it is in the best interests of the public to charge the true cost for such services, thereby placing the burden of such costs directly upon those persons deriving the benefit from the services; and WHEREAS, Florida Statutes 553.791 established an alternative plan review and inspection process whereby citizens may utilize private providers to have their plans reviewed and construction projects inspected for building code compliance; and WHEREAS, Florida Statutes 553.791 requires fee owners who elect to use private providers to have their plans reviewed and construction projects inspected for building compliance are required to acknowledge in writing that they indemnify, defend, and hold harmless the local government whose services replace those typically performed by a local government building department; and WHEREAS, Florida Statutes 553.791 does not provide for review by planning and environmental resources, flood plain, fire, or engineering; and WHEREAS, Florida Statutes 553.791 does still provide that local government building departments may review plans and revisions to assure compliance with building codes within 30 days, otherwise the permit shall be deemed issued; and WHEREAS, Florida Statutes 553.791 provides that local government building departments may audit building code inspections; and WHEREAS, the Director of Growth Management is proposing a revised fee schedule (with newly proposed fees shown in underline and with existing fees maintained within this resolution) does reflect the true cost of providing the private provider services to the persons requesting the Building Department services, as well as the planning and environmental, flood plain, fire, and engineering services for private providers; and WHEREAS, the Florida State Legislature passed HB7207 which allows for extensions of time for some development orders; and WHEREAS, the Board heard testimony and evidence presented as to the appropriate fee schedule; and WHEREAS, the Board concurs with the conclusions and findings of the Growth Management Director; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1.
