Item H3BOARD OF COUNTY COMMISSIONERS AGENDA ITEM SUMMARY Meeting Date: Mgy 16 2012 Division: Growth Management Bulk Item: Yes X No Department: Planning & Env. Resources Staff Contact Person: Richard Jones/289-2805 AGENDA ITEM WORDING: Approval of selection of Boating Improvement Funds (BIF) funding requests submitted by the various municipalities totaling $95,692 and direction for staff to draft Inter - Local Agreements with the Village of Islamorada ($30,000 for buoy maintenance), Marathon ($15,000 for buoy maintenance and $15,992 for pumpout boat maintenance) and Key West ($34,700 for mooring field materials) providing for reimbursement for boating and waterways related projects to be performed in FY' 13. ITEM BACKGROUND: At the February 15, 2012 BOCC meeting the Board approved Resolution No.080-2012, which amended Resolution No.371-2011, establishing policy and procedures for the award of BIF funding to the municipalities within Monroe County. The procedures (described in the attached Instructions and Guidelines) provide for annual funding requests, a project scoring and selection process, and award of funding through Inter -Local Agreements (ILA). Staff has received four funding request forms, including the Village of Islamorada in the amount of $30,000, the City of Marathon (two requests) in the total amount of $30,992 and the City of Key West in the amount of $34,700. Staff has evaluated and scored the funding requests and has recommended to the Board selection of all the requests in full, totaling $95,692. Upon direction from the Board, staff will prepare ILA's between the County and each of the three Cities. The ILA's will be structured to provide for a `not to exceed' amount. Staff anticipates bringing ILA's back to the Board in July 2012. Approval of the ILA's in the current fiscal year will assist with budgeting for FY' 13. PREVIOUS RELEVANT BOCC ACTION: September 21, 2011- discussion of the need for a policy for the use and distribution of BIF. October 19, 2011- approval of Resolution No.371-2011 establishing policy for the reimbursement of BIF to the municipalities. January 19, 2012- approval of recommended BIF reimbursement funding policy elements and direction for staff to draft a revised resolution which would replace Resolution No.371-2011. February 15, 2012- approval of Resolution No.080-2012 amending Resolution No.371-2011 and providing for BIF reimbursement funding procedures, funding request forms and guidelines. Islamorada, Village of Islands i Project Ariana Lawson, Procurernent/Grants Administrator Manager Phone: (305) 664-6450 Email: ariana.lawson@islamorada.fl.us 11M:1:T*31 Project Title: Islamorada Buoy Maintenance Program - FY 12/13 Islamorada, Village of Islands' boundaries extend from Tavernier Creek Bridge at MM 90.9 south to the Channel Two Bridge at MM 72.6, and include Plantation Key, Windley Key, and Upper and Lower Matecumbe Keys. Nicknamed the "Sportfishing Capital of the World", the waters of Islamorada, Village of Islands (the "Village") are heavily trafficked by recreational boaters, fishermen and personal watercraft. To aid in boater navigation and facilitate preservation of nearshore waters, flats and reefs, the Village has operated a Buoy Maintenance Program since 2004, maintaining a Florida Uniform Waterway Marker compliant system of 120 navigational buoys and a series of fixed regulatory, recreational and informational markers within the Village's 1200' off -shore jurisdiction in the Atlantic Ocean and Gulf of Mexico. Unfortunately, the Village experiences frequent losses and damages to its buoy system as the result of routinely heavy boat traffic, environmental wear, seasonal storm activity, and occasional theft. Under Florida law, and pursuant to Village Ordinance 03-10, the Village is responsible for responding to reports of damaged or missing buoys and markers. Subsequently, the Village has retained marine contractors to regularly inspect the buoys and markers to ensure operational continuity of the system and, therefore, the safety of the public and the environment. FWCC currently provides partial funding for the Islamorada Buoy Maintenance Program through June 30, 2012. The grant agreement, however, prohibits the obligation of additional FWCC funds for the existing buoy system until 2017. To assist with anticipated program maintenance costs in FY 12/13, the Village requests Monroe County reimburse the Village $30,000 in Boating Improvement Funds for costs expended in the upcoming fiscal year. Based on prior years' expenditures and FY 12/13 program goals of increased site visitation, permitting additional buoy locations, and continued distribution of educational materials, the Village's total Buoy Maintenance Program costs for FY 12/13 are estimated to be $35,000. If awarded, the Village will provide $5,000 cash match toward program costs from its FY 12/13 Public Works budget. In accordance with Islamorada's purchasing policy, the Village plans to issue a new RFP for a marine contractor to conduct FY 12/13 inspections and maintenance of the buoy system, including: 1) labor for certified divers to visit buoy locations, inspecting, cleaning, repairing and replacing buoys and anchoring materials as needed; 2) supplies for replacement buoys and anchor assembly lines; and 3) labor and supplies for buoy installations at newly permitted locations as the need arises. Also included in the FY 12/13 program cost is the printing and distribution of educational materials advising boaters about safety Issues and waterway marker information. Description of how project may promote public water access: Islamorada's Buoy Maintenance Program utilizes 120 highly visible shallow -draft buoys marked with GPS identifier to determine position and safe courses of navigation, warn of dangers and obstructions to navigation, and alert boaters and operators of various Federal, State, and local regulations. Safer than fixed signs, buoys reduce the severity of boater/sign collisions and are less expensive to erect and maintain. The buoys are ideal for the low -energy environment surrounding Islamorada, where boaters must remain vigilant of manatees and sea turtles year-round. To promote safe boating practices and protection of the Village's fragile seagrass beds and manatee and sea turtle populations, all buoys exhibit the reminder: "IDLE SPEED NO WAKE 300' FROM SHORE". For boating visitors unfamiliar with the area, the Village also distributes educational brochures and rack cards to increase public safety awareness and knowledge of local boating issues. Status of project (is the project designed/permitted if applicable?) The applicant will provide any pertinent documentation to assist with the review and evaluation of the funding request such as site plans (verifying property ownership), design plans, permits, etc. In compliance with Florida Administrative Code, and Village Ordinance 03-10, Islamorada's current waterway marker plan was reviewed and approved by the Florida Fish & Wildlife Conservation Commission's Office of Boating Safety & Waterway Management in December 2008. The attached FWCC Permit No. 04-018 lists the statewide marker identification numbers, latitude/longitude, and sign verbiage for each of the 120 approved regulatory buoys in the system. Current operational support from the Florida Fish and Wildlife Conservation Commission (FWCC) ends June 30, 2012 and will not be available to the Village again until 2017. This funding request is for FY 12/13, commencing October 1, 2012 and ending September 30, 2013. I- APPLICANT INFORMATION Municl ali: City of Marathon Project Sean Cannon Manager: Phone: (305) 289-8877 Email: cannons@ci.marathon.fl.us II- PROJECT SUMMARY Project Title: Sombrero Swim Buoy Replacement Project description and purpose (explain the community need and project merit): The City of Marathon provides Sombrero Beach Park: as a free public beach and park area that is owned by the City of Marathon. The swimming area is surrounded by 13 anchored buoys, marking it a swim area and prohibiting vessels from entering. Each year thousands of local families and tourists visit the beach to swim and play. Part of the beach away from the swimming area is also a favorite spot for launching kayaks. The existing buoys were first installed in 2005. Although some repairs have been made in the years since, the buoys and the anchoring system are both in need of replacement at this time. Repair and replacement cost is estimated at $14,240. Estimated costs of $760 for decals, and miscellaneous items will bring the total to $15,000. The buoy system provides boaters a visual cue that swimmers are concentrated in that area. Making the swim area a vessel exclusion zone provides a safe haven for swimmers_ V1-REVISED 2/17/2012 PAJGE 1 MUNICIPALITY FUNDING REQUEST FORM FOR USE OF MONROE COUNTY BOATING IMPROVEMENT FUNDS Funding amount $15,000.00 Does project include revenue generating infrastructure?' Description of how project may promote public water access: Sombrero Beach Park is open to the public for swimming. Replacing the swim buoy system will make the buoys easier to see and read, and will assist boaters in avoiding the swimming area. Keeping vessels away from the swimming area will provide a safe area for the public to swim. Status of project (is the project designed/permitted if applicable?) The applicant will provide any pertinent documentation to assist with the review and evaluation of the folding request such as site plans (verifying property ownership), design plans, permits, etc. The buoys have been permitted at this time. Permit numbers are as follows: FWCC Permit #98-060, File #+90+-0944-060BS USCG No objection letter dated 03/10/2005 New permits are not required to re -anchor existing permitted buoys.
