AGENDA ITEM WORDING: Approval to advertise public hearing regarding adoption of an
ordinance revising Section 2-79 of the Monroe County Code, regarding membership of the Monroe
County Personnel Policies and Procedures Review Board ("Review Board"), to eliminate references
to the Employee Relations Committee and provide an alternate method of selecting non-supervisory
employees and a direct online supervisor to sit on the Review Board.
ITEM BACKGROUND: On July 15, 1988, Monroe County Board of County Commissioners
adopted Ordinance No. 038-1988 ("Ordinance"), setting up the Monroe County Personnel Policies
and Procedures Review Board ("Review Board"). The purpose of the Review Board is to review any
proposed changes to the Monroe County Personnel Policies and Procedures Manual prior to
presentation to the BOCC for approval, and also to make sure that BOCC employees were aware of
the changes. The Ordinance also provides that all members of the Review Board shall serve for a
term of 2 years, at which time they can be reappointed or replaced.
As amended via Ordinance Nos. 030-1990, 019-1994, and 021-2015, the Ordinance provides that the
composition of the Review Board is as follows: one (1) on-line direct supervisor; two (2)
department heads; the Director of Employee Services, and three (3) non-supervisory employees
(plus one alternate).
The Ordinance also provides for the method of selection of each category. The Ordinance currently
provides that the non-supervisory employees and the direct on-line supervisor are chosen by the
Employee Relations Committee (ERC). The ERC, which was created by Administrative Instruction
1008, has been composed of non-supervisory employees from each department. In March 2022, the
Administrative Instruction was cancelled and the Employee Relations Committee was disbanded.
As a result, it is necessary to find a new method to select the non-supervisory employees and direct
on-line supervisor who will serve on the Review Board.
The proposed ordinance revises the selection procedure. The proposed ordinance states that the
three non-supervisory employees and one direct on-line supervisor for the Review Board will be
selected via direct nomination by department heads followed by a vote of all department heads

(Senior Management Team), instead of being chosen by the Employee Relations Committee.
If this agenda item is approved, the proposed ordinance will be set for hearing at the BOCC's
meeting on 5/18/2022.

AN ORDINANCE AMENDING MONROE COUNTY CODE SECTION
2-79 REGARDING THE MEMBERSHIP OF THE MONROE COUNTY
PERSONNEL POLICIES AND PROCEDURES REVIEW BOARD TO
ELIMINATE REFERENCES TO THE EMPLOYEE RELATIONS
COMMITTEE AND TO PROVIDE ANOTHER METHOD FOR
SELECTING NON-SUPERVISORY EMPLOYEES TO SERVE ON
THE PERSONNEL POLICIES AND PROCEDURES REVIEW
BOARD; PROVIDING FOR REPEAL OF ALL ORDINANCES
INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION
INTO THE MONROE COUNTY CODE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, on July 15, 1988, via adoption of Monroe County Ordinance No. 038-
1988 ("Ordinance"), Monroe County created the Monroe County Personnel Policies and
Procedures Review Board for the purpose of reviewing any proposed changes to the Monroe
County personnel policies and procedures prior to presentation to the Monroe County Board
of County Commissioners for approval and to assure that all appropriate employees of Monroe
County are made aware of any such proposed changes; and
WHEREAS, section 1 of the Ordinance, now codified in Section 2-79 of the Monroe
County Code of Ordinances, provides that the Personnel Policies and Procedures Review
Board will consist of seven (7) members, as follows: (a) three members elected by the
Employee Relations Committee; (b) one supervisor providing direct online supervision; (c)
two department heads; and the director of employee services; and
WHEREAS, the Employee Relations Committee has been discontinued; and
WHEREAS, until it was disbanded, the Employee Relations Committee was
composed of non-supervisory employees from each department; and
WHEREAS, it is now necessary to amend the Ordinance to provide a method for
selecting non-supervisory employees who will sit on the Personnel Policies and Procedures
Review Board.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows:
Section 1. Section 2-79, Monroe County Code, is hereby amended to read as
follows:
Sec. 2-79. Membership.
(a)!The Monroe County Personnel Policies and Procedures Review Board will consist
of seven (7) members as follows:

Relations Committee;

(2)!One (1) Supervisor providing direct on-line supervision (including but not
limited to Administrator or Sr. Administrator classification);
(3)!Two (2) Department Heads; and
(4)!The Director of Employee Services.
(b)!The membership of the Review Board shall be selected in the following manner:
(1)!The three (3) non-supervisory employees will be proposed by Department
Heads and elected by a majority of Department Heads by the Employee
Relations Committee (ERC) will be elected by a majority of ERC members,
not to include any supervisory personnel.
(2)!The direct on-line Supervisor will be elected by a majority of Department
Heads ERC members, after each Department Head has submitted one (1)
name for nomination.
(3)!Department Heads will be appointed by the County Administrator.
(4)!The Director of Employee Services will be the employee holding that title at
the time of each meeting of the Review Board.
(5)!One non-supervisory employee may also be selected, by the same process
designated in paragraph (1), above, to serve as an alternate. The alternate who
may attend any/all meetings, but will have voting privileges only when it is
necessary to make a quorum, will be elected by members of the ERC.
(c)!All members will serve for two (2) years and will be replaced or reaffirmed every
two (2) years in the manner stated above. In the event a board member can no
longer serve, the current alternate will fill any vacancy that occurs in Membership
Category 1 and a replacement alternate will be elected by the members of the
ERC. A vacancy in Membership Category numbers 1 2 through 4 5 will be
elected/appointed as originally elected or appointed. Any member may be
removed from the Review Board by a majority vote of the board members.
Section 2. If any section, subsection, sentence, clause or provision of this
ordinance is held invalid, the remainder of this ordinance shall not be affected by
such invalidity.
Section 3. All ordinances or parts of ordinances in conflict with this ordinance
are hereby repealed to the extent of said conflict.
Section 4. The provisions of this ordinance shall be included and incorporated in
the Code of Ordinances of the County of Monroe, Florida, as an addition or
amendment thereto, and shall be appropriately renumbered as necessary to conform to
the uniform numbering system of the Code.
Section 5. This ordinance shall take effect immediately upon receipt of official
notice from the Office of the Secretary of State of the State of Florida that this
ordinance has been filed with said Office.
