ITEM BACKGROUND: On or about March 14 and April 22, 1996, a final judgment issued by the

16 Judicial Circuit Court in and for Monroe County, Florida, and Certificates of Sale and Title
thereto s favor in the matter of Monroe
County, Florida v. Federal Deposit Insurance Corporation as Receiver for Southeast Bank N.A., et
al., Case No. 95-20118-CA-09. Said order(s), however, contained an incorrect recitation of thelegal
description of the property successfully foreclosed upon by Monroe County in that litigation.
Neither the court judge nor counsel for County did not seek to correct the erroneous legal
description.
The subject property is designated Tier I. Ts Office has
assigned it property identification number 00087310-000000. As the attached aerial reflects,
unauthorized and illegal habitation, landclearing, storage, and dumping, are occurring at the subject
property.
This request seeks (1) authorization to reopen the case to
legal description of the subject property, a necessary step toward additional steps that will need to be
undertaken to prevent the continued unauthorized, unsafe, and illegal use of the property and its
defoliation, and (2) authorization to initiate litigation and/or adversarial administrative proceedings
against such parties as are necessary to safeguard control of the subject property and to stop, enjoin,
and prevent the unauthorized and unlawful use(s), activity(ies), and operation(s) occurring on the
property.
