RESOLUTION NO. 130 - 2022 A RESOLUTION OF THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS NOMINATING PROPERTY FOR PURCHASE BY HABITAT FOR HUMANITY OF KEY WEST AND LOWER FLORIDA KEYS, INC. AND REQUESTING THE MONROE COUNTY COMPREHENSIVE PLAN LAND AUTHORITY ISSUE A MORTGAGE LOAN TO FINANCE HABITAT'S PURCHASE OF 22936 OVERSEAS HIGHWAY, OCEAN SIDE OF CUDJOE KEY, NEAR MILE MARKER 22 LEGALLY DESCRIBED AS LOTS 4 AND 5, BLOCK 1, CUDJOE OCEAN SHORES (PB 5-107), WITH PARCEL ID NUMBERS 00186920-000000 AND 00186930-000000 AS AN AFFORDABLE HOUSING SITE SUBJECT TO CONDITIONS. WHEREAS, Habitat for Humanity of Key West and Lower Florida Keys (hereinafter "Habitat) has entered into a contract to purchase a two -lot site at 22936 Overseas Highway with Parcel ID Numbers 00186920-000000 and 00186930-000000, legally described as Lots 4 and 5, Block 1, Cudjoe Ocean Shores (PB 5-107) (hereinafter the "Site"), and WHEREAS, the seller of the site has secured permit #20101242 for (4) attached affordable housing units, with each providing 940 square feet of living space with a 172 square foot enclosure area; and WHEREAS, the Monroe County Board of County Commissioners (hereinafter the "County") desire to partner with Habitat to promote affordable housing development. NOW, THEREFORE, BE IT RESOLVED BY THE MONROE COUNTY BOARD OF COUNTY COMMISSIONERS, THAT: Section 1. The above recitals are true and correct and incorporated herein. Section 2. The County hereby nominates the Sites for purchase by Habitat for affordable housing. Section 3. The County requests that the Monroe County Comprehensive Plan Land Authority (hereinafter "Authority") issue a mortgage loan to finance Habitat's purchase of the Site. Section 4. The County requests Habitat construct 4 dwelling units on the site, approximately as shown on "Exhibit A", in accordance with the permits issued by the County. Page 1 of 2 Section 5. Upon completion of the 4 units by Habitat, as evidenced by a Certificate of Occupancy for all 4 units, the County will accept title of the land from Habitat, and correspondingly lease the land back to Habitat for 99 years, offering Habitat a 2"d 99- year term to maintain affordability. Habitat will sell the units to income qualified households at 80% or below of Area Median Income (AMI). Section 6. The County requests the Authority release the mortgage upon the satisfactory completion of the 4 workforce housing units (as evidenced by issuance of certificates of occupancy); Habitat conveying marketable title to the County.
