Aguiar, Employee Services Director DATE: August 24, 2012 SUBJ: Approval of Workers Compensation Settlement File #WC11000285-GH BOARD OF COUNTY COMMISSIQNERS Mayor David Rice, District 4 Mayor Pro Tem Kim Wigington, District 1 George Neugent, District 2 Heather Carruthers, District 3 Sylvia I Murphy, District 5 This item requests approval for the settlement of a workers' compensation claim on a former Sheriff s Department employee for the dates of accident/injury on October 5, 2008, April 18, 2009, and January 4, 2010. A private mediation was conducted and both parties agreed to settle the case for $130,000 inclusive of attorney fees and costs contingent on the Monroe County BOCC approval. The worst case scenario of annual lifetime medical expenses of the claimant is valued in excess of $500,000 as well as the possibility of the claimant at some point being PTD (permanent total disabled). In addition, the current indemnity benefit owed to the claimant is approximately $25,000. An agreement was reached to resolve the claimant's three claims in the sum of $130,000 which includes a general release and is inclusive of all fees and costs.
