AGENDA ITEM WORDING: A public hearing to consider approval of resolution renouncing and disclaiming

ITEM BACKGROUND: The petitioner has requested abandonment of a portion of the right-of-way of
Hakluyt Lane, as described above, in order to unify all the adjacent parcels. The portion of a platted
right-of-way for Hakluyt Lane was never constructed including the western segment northwest of the
primary section of Hakluyt Lane. A portion of the western segment of Hakluyt was abandoned in
1986 as memorialized by Resolution No. 201-1986.

REQUEST: The petitioners, John T. & Jan M. Porterfield, requested abandonment of a portion

REVIEW: The affected properties (RE Nos. 00185610-000000, 00185620-000000, and
00185630-000000) of the right-of-way to be abandoned are owned by the petitioners. The
petitioners have submitted a road abandonment petition in order to unify all of the adjacent
parcels. It should be noted that the portion of a platted right-of-way for Hakluyt Lane was never
constructed including the western segment northwest of the primary section of Hakluyt Lane. A
portion of the western segment of Hakluyt was abandoned in 1986 as memorialized by

Please note that the Map of Boundary Survey of the South 20.5 feet of Lot 10, and all of Lots 11,
12, 13, and 14, Block 12 and abandoned ROW, part of Hakluyt Lane and proposed new road
abandonment, part of Hakluyt Lane Cutthroat Harbor Estates, First Editions by Reece and White
Land Surveying, Inc., date of field work 8/30/2011 has a singular misspelling of Hakluyt Lane.
Staff has made the applicant aware of the inaccuracy and has avoided perpetuating the error.
This petition has been reviewed by County staff and written recommendations of no objection
were received from Monroe County Engineering Services, Fire Marshal, Code Compliance, and
the Monroe County Sheriffs Office.

5 Florida Keys Energy Services, Florida Keys Aqueduct Authority, AT & T, Monroe County
6 Sheriffs Office, Monroe County Fire Department, Monroe County Engineering, Monroe County
7 Code Compliance Department, and Comcast have provided letters of no objection.

9 Monroe County Code Section 19-1 - Abandonment of rights -of -way states:

11 (a) No dedicated and accepted right-of-way in the county shall be abandoned where:
12 (1) the right-of-way terminates on a body of open water; or
13 • The platted, undeveloped right-of-way does not terminate on a body of
14 open water.
15 (2) the right-of-way provides access to the public to land on open water; or
16 • The platted, undeveloped right -of -right does not provide access to the
17 public to land on open water.
18 (3) the abandonment would preclude a way for the public to maintain access to the water.
19 • The abandonment would not preclude a way for the public to maintain
20 access to water.

22 (b) In all other cases of abandonment, no right-of-way shall be abandoned unless there is an
23 agreement to do so by all affected property owners. For purposes of this subsection, an
24 affected property owner is the owner of property which, if the right-of-way is abandoned,
25 will:
26 (1) Have access that is currently used by that property owner eliminated;
27 • The requested abandonment is for a platted, undeveloped right-of-way
28 that is not being used for access by the property owner. Aerial
29 photography shows the property has been accessed by an entrance
30 southeast of the proposed abandonment.
31 (2) Have the only platted access eliminated;
32 • As noted above, the property has been accessed by an entrance to the
33 southeast of the proposed abandonment.
34 (4) Have the paved area adjacent to that property increased for turn -around purposes; or
35 • There are no paved areas adjacent to the adjoin properties and there
36 are no proposed plans for a turn -around.
37 (5) Be increased in size.
38 • The affected property will be increased in size, but there is no objection.

40 (c) A road may be abandoned only at the terminal portion of the road and in its full width unless
41 the abandonment will comply with the County Code requirements for road, tum-around, and
42 fire -rescue access and one of the following circumstances exists:
43 (1) An adjacent lot owner has on the platted right of way or within a setback a substantial
44 structure which predates the Special Session Law 59-1578 pertaining to maps, plats
45 and right of way. The term "substantial structure" specifically does not include wood
46 or metal fences, sheds or tiki huts or other items not listed which are accessory
47 structures.

1 (2) The abandonment is requested by a County department or governmental agency for a
2 public purpose.

6 (d) The board of county commissioners considers these a restriction on the rights of individuals
7 who desire to abandon properties in accordance with F.S. § 336.09.
8 • The petitioner meets the criteria above; therefore, there are no
9 restrictions on the rights of John T. & Jan M. Porterfield

11 The requested abandonment of a portion of the right-of-way of Hakluyt Lane that is adjacent to
12 Lots 11, and 13, Block 6 Cutthroat Harbor Estates, First Addition, Cudjoe Key, Monroe County,
13 Florida according to the Plat thereof as recorded in Plat Book 5, Page 60 of the public records of
14 Monroe County, Florida meets the criteria cited above and is therefore suitable for abandonment.

A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY RENOUNCING
AND DISCLAIMING ANY RIGHT OF THE COUNTY AND
THE PUBLIC IN AND TO A PORTION OF THE RIGHT-OF-
WAY OF HAKLUYT LANE, ADJACENT TO LOTS 11, AND
13, BLOCK 6 AND A PREVIOUSLY VACATED SECTION OF
HAYLUYT LANE, CUTTHROAT HARBOR ESTATES, FIRST
ADDITION, CUDJOE KEY AS SHOWN AS RECORDED IN
PLAT BOOK 5, PAGE 60 OF THE PUBLIC RECORDS OF
MONROE COUNTY, FLORIDA.
WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to
renounce and disclaim any right of the County and the public in and to the hereinafter streets,
alley -ways, roads or highways; and
WHEREAS, due notice has been published and a public hearing has been held in
accordance with Chapter 336, Florida Statutes; and
WHEREAS, at said public hearing the Board considered the argument of all parties
present wishing to speak on the matter, and considered the renouncing and disclaiming of any
right of the County and public in and to the hereinafter described streets, alley -ways, roads, or
highways as delineated on the hereinafter described map or plat; and
WHEREAS, the Board has determined that vacation of the said road is for the general
public welfare, and conforms to the requirement of Florida Statute Sections 336.09 and 336.10;
and
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, that it hereby renounces and
disclaims any right of the County and public in and to the following described streets, alley-
ways, roads, or highways as delineated on the hereinafter described map or plat, to -wit:
"A part of Hakluyt Lane of Cutthroat Harbor Estates, First Addition, according to the
Plat thereof as recorded in Plat Book 5, Page 60, of the Public Records of Monroe County,
Florida, being more particularly described by metes and bounds as follows:
Commencing at the Southeast corner of Lot 11, Block 12 of said Cutthroat Harbor
Estates, First Addition, bear S60°00'00"W for a distance of 25.0 feet to the Point of Beginning of
the part of Hakluyt Lane hereinafter described: thence continue bearing S60°00'00"W for a
distance of 31.5 feet.. to a point, said point being forty-one feet northeasterly , of the, Northwest
terminus of Hakluyt Lane according to the plat of said Cutthroat Harbor Estates, First Addition,
said point further described as the northeasterly corner of that portion of Hakluyt Lane
described in Monroe County Board of County Commissioner's Resolution No. 201-1986; thence
bear S30°00'00'E for a distance of 25.0 feet to a point on the North line of Lot 13, Block 12 of
said plat of Cutthroat Harbor Estates, First Addition; thence bear N60°00'00'E on the North

On April 7, 2011 Code received a complaint from Joe Stickney of Monroe County Engineering Department
regarding a new fence installed across the ROW at the end of Hakluyt Lane, CudJoe Key.
Research revealed that a permit numbered 10104258 was issued on July 15, 2010 and subsequently all required
inspections were completed by the building department on January 26, 2011 for a fence and columns. Review
of that permit revealed that the contractor on the permit had mistaken a recently filed road abandonment
resolution to include the whole southern portion of the "T-intersection" as being previously abandoned with
resolution 201-1986.
Additionally this permit was to replace an existing fence with appears to have been across the ROW since 2006
and quite possibly since 1993.
This road abandonment will allow the property owner to gain compliance for code case CE 11040062 by
establishing that the fence and columns are allowed to remain as permitted.
Therefore, the Code Compliance Department has no objection to the petition.

A RESOLUTION SETTING THE DATE, TIME, AND PLACE
FOR A PUBLIC HEARING CONCERNING THE PROPOSED
ABANDONMENT OF A PORTION OF THE RIGHT-OF-WAY
OF HAKLUYT LANE, ADJACENT TO LOTS 11, AND 13,
BLOCK 6 AND A PREVIOUSLY VACATED SECTION OF
HAKLUYT LANE, CUTTHROAT HARBOR ESTATES, FIRST
ADDITION, CUDJOE KEY AS SHOWN AS RECORDED IN
PLAT BOOK 5, PAGE 60 OF THE PUBLIC RECORDS OF
MONROE COUNTY, FLORIDA.

WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to
renounce and disclaim any right of the County and the public in and to the hereinafter streets,
alley -ways, roads or highways,

WHEREAS, under Chapter 336, Florida Statutes, it is necessary to hold a public hearing
after publishing due notice of said hearing in accordance with said Chapter, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, that the Board will hold a public hearing on September 21,
2012, at 3:00 P.M. at the Marathon Government Center, 2798 Overseas Highway,
Marathon, Florida, to determine whether or not the Board will renounce and disclaim any right
of the County and the public in and to the following described streets, alley -ways, roads, or
highways as delineated on the hereinafter described map or plat, to -wit:
"A part of Hakluyt Lane of Cutthroat Harbor Estates, First Addition, according to the i
Plat thereof as recorded in Plat Book 5, Page 60, of the Public Records of Monroe County,
Florida, being more particularly described by metes and bounds as follows:
Commencing at the Southeast corner of Lot 11, Block 12 of said Cutthroat Harbor
Estates, First Addition, bear S60000'00"W for a distance of 25.0 feet to the Point of Beginning of
the part of Hakluyt Lane hereinafter described. thence continue bearing S60000'00"W for a
distance of 31.5 feet to a point, said point being forty-one feet northeasterly of the Northwest
terminus of Halduyt Lane according to the plat of said Cutthroat Harbor Estates, First Addition,
said point ,further described as the northeasterly corner of that portion of Hakhiyt Lane
described in Monroe County Board of County Commissioner's Resolution No. 201-1986, thence a
bear S30°00'00"E for a distance of 25.0 feet to a point on the North line of Lot 13, Block 12 of {
said plat of Cutthroat Harbor Estates, First Addition; thence bear N60°00'00"E on the North
line of said Lot 13 for a distance of 6.5' to a point of curvature, said curve concave to the
northeast and having a radius of 25.0 feet, a delta angle of 900, a chord bearing S7500010011E
and a chord length of 35.36 feet; thence along said curve for an arc length of 39.27 feet; thence

bear N30°00'00"W for a distance of 50.0 feet back to the Point of Beginning, containing 922 sq.
ft more or less.
