ITEM BACKGROUND: A building permit was applied for on 3/19/2007 and a ROGO application was applied for on 6/19/2007. The applicant applied for administrative relief on 1/9/2012 and is within the allowable time frame to be eligible for administrative relief under Section 138-27 of the Monroe County Code. The property is in Tier 1. The property is on the FEMA Injunction List. As of Quarter 3 Year 20 this application's market rate ranking was #9 out of 11 applications in the Lower Keys subarea. If the owner does not accept the offer provided by the Land Authority, the property remains in ROGO. The application will continue to earn perseverance points pursuant to the vesting provision for applications in the ROGO system prior to the effective date of Ordinance 09-2006. The adjacent parcel to the west is developed with a single 10 family residence and the western portion of the subject parcel was partially cleared in the past 11 and is vegetated with the invasive lead tree (Leucaena leucocephala). The properties to the 12 north, across Mariposa Road, are Tier III. GIS habitat data and the vegetation survey submitted 13 by the applicant both indicate that the vegetative community on the eastern portion of the subject 14 parcel consists of tropical hardwood hammock. According to the survey vegetation on the 15 property includes several native plant species, including the endangered Key thatch palm 16 (Thrinax morrisii) and maiden bush (Heterosavia bahamensis). The hammock community on 17 the parcel is contiguous with over 1 acre of native upland habitat and according to the Species 18 Focus Area Maps (SFAM's) prepared by the U.S. Fish and Wildlife Service is potentially 19 suitable habitat for the following Federally listed species: 20 ® Keys tree cactus 21 • Stock Island tree snail 22 • Silver rice rat 23 e Key deer 24 . Eastern indigo snake 25 In addition to the above, the parcel is also within the 500 meter buffer for the Lower Keys marsh 26 rabbit. 27 28 III. LEGAL ELIGIBILITY AND OPTIONS 29 30 Eligibility for Administrative Relief Options: 31 Section 138-27 of the Monroe County Land Development Regulations and Policy 101.6.1 of the 32 2010 Comprehensive Plan provides a mechanism whereby an applicant who has not received an 33 allocation award in the ROGO system may apply to the Board of County Commissioners for 34 Administrative Relief. The applicant is eligible for Administrative Relief having complied with 35 all requirements of the dwelling unit allocation system and having been considered in at least the 36 first sixteen consecutive quarterly allocation periods, and not having received an allocation 37 award. The application was timely submitted for administrative relief in the form of one (1) 38. ROGO allocation award and Ale -applicant -has, not expressed a desire --to sell the -property to the 39 County. 40 41 Relief Options under Administrative Relief: 42 The remedies available to the Board of County Commissioners for Administrative Relief 43 pursuant to Section 138-27 include: 44 - 45 - - a. Suggest or provide such other relief as may be necessary and appropriate. 9 10 In the event purchase is recommended and the owner refuses the purchase offer, the 11 applicant may remain in the ROGO System and continue earning perseverance points 12 according to Monroe County Code Section 138-28. 13 14 IV. Monroe County Code (MCC) Section 138-27 provides a mechanism whereby an applicant who has not received an allocation award in ROGO may apply to the Board of County Commissioners for administrative relief. 5. The Board of County Commissioners (BOCC) has the authority to grant administrative relief under Section 138-27(f) and may grant the applicant a building allocation, offer to purchase the property at fair market value, or provide such other relief as may be necessary and appropriate. Monroe County Code (MCC) Section 138-27(f) states the Board may offer to purchase property at its fair market value as the preferred action for property located within Tier 1. (1) If an applicant for an allocation award: a. Whose application has-been denied an allocation award for four (4) successive years in the Permit Allocation System, and fails to receive an allocation award, said applicant may apply to the board for administrative relief pursuant to the tenns and conditions set forth herein; and b. (4) Upon receipt of an application for administrative relief, the board shall notice and hold a public hearing at which time the applicant will be given an opportunity to be heard. (5) The board may review the relevant applications and applicable evaluation ranking, taking testimony from county staff and others as may be necessary and hear testimony and review documentary evidence submitted by the applicant. (6) At the conclusion of the public hearing, the board may take the following actions pursuant to Monroe County Code Section 138-27(f) and Monroe County Comprehensive Plan Policy 101.6.1 and Policy 101.6.5: a. Offer to purchase the property at fair market value as the Board of County Commissioners preferred action if the property is located within: i. a designated Tier I area; ii. a designated Tier 11 area (Big Pine Key and No Name Key); iii. a designated Tier 111-A area (Special Protection Area); or iv. a designated Tier III area on a non -waterfront lot suitable for affordable housing. "Fair market value" shall be an amount which is no less than ad valorem valuation in the Monroe County Real Property Tax roll for the year 1992. b. Permit the minimum reasonable economic use of the property. "Minimum reasonable economic use" means; as applied to any residentially zoned lot of record, which was buildable immediately prior to the effective date of the Plan, no less than a single-family residence. c. Suggest such other relief as maybe necessary and appropriate. (7) Limits on administrative allocations per quarter: The number of allocations that may be awarded under administrative relief in any one quarter shall be no more than fifty percent of the total available market rate allocations available in a quarter for that subarea. Any allocations in excess of fifty percent shall be extended into the succeeding quarter or quarters until the number of such ,allocations is fifty- percent or Jess_ of the total number of market rate allocations available to be awarded. A site visit was performed on the above referenced property on April 14, 2012. Site Description: The property is bordered on the south and east by vacant vegetated parcels, on the west by a single-family residence and on the north by a paved road Mariposa Drive. For purposes of this report the front of the property is considered that which borders Mariposa Drive. The unimproved site is densely vegetated. A portion of the parcel adjacent to the single-family residence has been cleared and appears to be utilized by the adjacent homeowners. There are two areas of significant garbage and yard debris dumping. Lead tree has significantly invaded this portion of the parcel. In addition there is a considerable amount of dead vegetation onsite, possibly due from a stressor such as storm surge. Several large dead gumbo limbos showed signs of invasion from the gumbo limbo beetle Pigeon plum is one of the most predominant native species on site. In addition mature native species including poisonwood, willow bustic, blolly and long -stalked stopper are located onsite. The most notable feature on site is a portion of a solution hole which straddles the eastern property line and is shown on the attached map. No water was located in the solution at the time of the site visit. The site visit did occur during the dry season. Species of Note: There are no invasive exotic species regulated by Monroe County on site. However, there is a significant amount of Lead Tree onsite. Although its removal is not required, it is a highly invasive species and its removal is recommended. There are eleven (11) Listed species on site. A species is considered Listed if it is designated Endangered (E), Threatened (T), Regionally Important (RI), or Commercially Exploited (CE), or if it is a Native species greater than 4" diameter at breast height (N>4"dbh). All listed species require mitigation if impacted by development and all have been tagged on site with pink tape. Current Monroe County Code requires monetary mitigation for all impacted species. The mitigation amount is calculated by Monroe County depending on the species and its size. All protected species are shown on the attached map.. All species impacted by the proposed development (construction footprint & five foot construction buffer) are noted on the map. Please note that locations are approximate due to the density of the vegetation and the limitation of the measuring device used (measuring tape). Appropriate permits must be obtained from Monroe County prior to removal of any vegetation. Please consult the Monroe County Biologist for specific requirements.
