AGENDA ITEM WORDING: Approval of a contract to purchase a less than fee interest in Block
5, Lots 6, 12, 13, and the southwest 5 feet of Lot 7, Pirates Cove on Key Largo near mile marker 98
for density reduction purposes.
ITEM BACKGROUND: This acquisition is proposed pursuant to BOCC Resolution 128-2022 (the
Less Than Fee Acquisition Program) to protect property rights, to reduce density, and to reduce the
.
The subject property is a 7,750 square foot site at 34 Pirates Drive on the bay side of Key Largo near
mile marker 98 and is developed with one dwelling unit. Lots 6 and 13 are developed with a single-
family home and a storage shed. Lot 12 and the southwest five feet of Lot 7 have accessory
structures consisting of a fence, a raised garden bed, and plastic storage containers. The less than fee
interest being purchased by the County will combine the site into a single Unified Parcel and will:
Limit the total density of the Unified Parcel to one residential dwelling unit
Retire all other density and prohibit the transfer of density off site
Prohibit new accessory structures providing habitat space
Not prohibit accessory uses and non-habitable accessory structures
Not prohibit additions to the lawfully established existing residential unit
In 2019 the Planning and Environmental Resources Department determined the site had the potential
to be developed with at least one additional dwelling unit and the Seller signed and returned the
. However, the Less Than Fee Acquisition Program shut down before
the purchase agreement could be approved by the BOCC.
The Seller has now signed a new purchase agreement. The purchase price for the less than fee
interest is $30,906. Since there is no separate market land value listed for Lot 12 on the Monroe
s purchase price is based on the $30,906 current market
land value listed for a comparable lot in the subdivision on Barracoa Drive (Block 4, Lot 10). The

estimated closing costs for this transaction will be approximately $1,250.
PREVIOUS RELEVANT BOCC ACTION: The Board established and modified the Less Than
Fee program though the adoption of Resolutions 175-2018, 438-2018, and 063-2020.
