AGENDA ITEM WORDING: Approval of a contract to purchase property within the City of
Marathon for conservation Block 49, Lots 1, 2, 3, 14, 15, and 16, Crains Subdivision, Grassy Key
near mile marker 58.
ITEM BACKGROUND: This acquisition is proposed to protect property rights and the natural
environment.
The Land Authority staff have been working on purchasing vacant, privately owned lots in Crains
Subdivision. The area has a substantial number of publicly owned lots and George Garrett, City of
Marathon Manager, met with us several months ago and requested we engage the State of Florida
Department of Environmental Protection (DEP) and try to finish purchasing the remaining private
vacant lots in the Crains Subdivision. Unfortunately, these lots are not within the Florida Forever
boundary at this time; however, they could be added in the future. Nonetheless, the Marathon City
Council passed resolution 2016-48, requesting the Land Authority purchase these lots (as well as
others). This subdivision has vacant lots without enough density to build one house. The lots are
eligible for Building Permit Allocation System (BPAS) dedication points. In other words, someone
who has applied for a building permit and is waiting on a BPAS allocation can increase their score
by purchasing and dedicating these lots. The value of dedication points was used to develop the
offering price for purchases in this subdivision.
We obtained sample appraisals of 4 different lots that were for sale in the Crains Subdivision, on the
Multiple Listing Service (MLS).
Some of these lots contain habitat that is wet and we have verified with the City of Marathon (the
City) that they are still eligible for the dedication points.
The City has asked us to purchase all lots, even submerged lands, in the Crains Subdivision area for
their purpose as an environmental / recreational area. Th
include the restoration of the natural water flow between the various lakes within the subdivision and
then to develop a system of boardwalks and observation platforms and towers. Mr. Garrett has
indicated owning the submerged lands in the subdivision will be an important part in accomplishing
that goal.
The map below shows you the current ownership of the lots, as well as the lots that are within the

Florida Forever Acquisition Boundary (shown in green). These are not within Florida Forever.
Therefore, these lots will likely be conveyed to the City of Marathon, after closing.
The subject property consists of six adjoining lots totaling 45,000 square feet fronting Peachtree
Avenue and Tropical Avenue on the bay side of Grassy Key near mile marker 58.
The property attributes are:
Tier designation: None (City of Marathon).
Zoning designation: Residential Conservation (RC).
Vegetation: Mostly buttonwood and hammock with some saltmarsh and mangroves.
Sea Level Rise: The Southeast Florida Regional Climate Change Compact sea level rise

projection for the period from 2000 to 2070 is 21 to 54 inches. In the event of a 12-inch
increase in sea level, estimates provided by the South Florida Water Management District
indicate about two-thirds of this property will have a 25.1% to 100% probability of being
inundated.
Acquisition List qualification: The property qualifies because the property is impacted by
local government regulations.
Florida Forever Boundary: This property is outside the Florida Forever boundary.
Transferrable Development Rights (TDRs): 0.36 TDRs
BPAS Dedication Points: 12 points (2 points per lot)
The property owner has agreed to sell the property for the price of $114,000 ($19,000 per lot). The
estimated closing costs for this transaction are listed in the agenda documentation.
ADVISORY COMMITTEE ACTION: On April 27, 2022 the Committee voted 5/0 to approve
purchasing this property for the price of $114,000.
PREVIOUS RELEVANT GOVERNING BOARD ACTION: The Board has approved the
purchase of other conservation properties in this subdivision.

Subject: Commitment to Accept and Manage Conservation Lands
Dear Christine:
Per our recent conservation, the City of Marathon is committed to either receiving in fee simple or
under a management lease, any conservation property purchased by the Monroe County Land
Authority, the Florida Department of Environmental Protection, or any other state or federal
agency The City
will further deed restrict said properties as appropriate and manage them for the purposes of
conservation.
We understand that the Land Authority has currently developed contracts with five owners holding
a total of sixteen parcels on Grass Key, with
manages some over 300 parcels within that subdivision. Our management in the area extends to
multiple interests, including removing a number of the unimproved roads and restoring wetland
habitats effectively as a mitigation banking effort. Further, we are working through this process
to create a network of trails, boardwalks, and observation platforms to function as the Grassy Key
Birding Trail.
