ITEM BACKGROUND: On April 27, 2022, the County received a letter from Lindsay Fast, Executive Director of Habitat for Humanity of the Upper Keys, Inc. (HfHUK), requesting the consideration of donating two County-owned lots/parcels of land to HfHUK for the development of affordable housing (see attached letter). HfHUK is a 501(c)3 not-for-profit organization engaged in the construction of affordable housing in the Upper Keys. In 2021, as required by F.S. 125.379, staff reviewed the various County-owned real property and developed an inventory of four (4) Tier III parcels that may be appropriate for use as affordable housing. On April 16, 2021, the BOCC adopted Resolution 167-2021 approving the inventory. The inventory includes two developed parcels, and two vacant parcels. The lots requested for donation (Block 6, Lots 14 and 15 of the Holiday Homesites Subdivision) are the vacant parcels from the inventory. These lots are located on Poinsetta Drive in Key Largo, directly adjacent to land that the County has previously donated to HfHUK for development of affordable units. Donation of Lots 14 and 15 would allow HfHUK to build a total of four single family homes on four adjacent lots on Poinsetta Drive. HfHUK is also requesting a reservation of affordable housing ROGO allocations for these lots under a separate agenda item. The two requested lots were dedicated to the County in 2010 as Land Dedication Lots for Affordable Housing by a permit applicant seeking additional points in the ROGO system for a market rate allocation award, pursuant to section 138-28 of the Land Development Code. The statute provides that the BOCC may donate properties identified as appropriate for use as affordable housing on the inventory list adopted by the county to a nonprofit housing organization for the construction of permanent affordable housing. F.S. 125.379 Disposition of county property for affordable housing. (1) By July 1, 2007, and every 3 years thereafter, each county shall prepare an inventory list of all real property within its jurisdiction to which the county holds fee simple title that is appropriate for use as affordable housing. The inventory list must include the address and legal description of each such real property and specify whether the property is vacant or improved. The governing body of the county must review the inventory list at a public hearing and may revise it at the conclusion of the public hearing. The Qbdlfu!Qh/!3496 P/5 governing body of the county shall adopt a resolution that includes an inventory list of such property following the public hearing. (2) The properties identified as appropriate for use as affordable housing on the inventory list adopted by the county may be offered for sale and the proceeds used to purchase land for the development of affordable housing or to increase the local government fund earmarked for affordable housing, or may be sold with a restriction that requires the development of the property as permanent affordable housing,or may be donated to a nonprofit housing organization for the construction of permanent affordable housing. Alternatively, the county may otherwise make the property available for use for the production has the same meaning as in s. 420.0004(3). If the Board supports donating the lots, staff should be directed to prepare a resolution consistent with F.S. 125.38, which sets for the requirements for conveying County owned property to non- profit entities. PREVIOUS RELEVANT BOCC ACTION: On April 12, 2017, the BOCC approved donation of Lots 16 & 17, Block 6, Holiday Homesites, Key Largo, to Habitat for Humanity of the Upper Keys for construction of affordable housing. On August 18, 2021, the BOCC adopted Resolution 263-2021, reserving two Moderate-Income Affordable Housing ROGO Allocations, for the construction of two affordable housing dwelling units at 110 Poinsettia Drive, Lots 16 & 17, Block 6, Holiday Homesites, Key Largo, having property identification number 00530750-000000 until August 18, 2023. On April 16, 2021, the BOCC adopted Resolution 167-2021 approving the inventory of county- owned real property which may be appropriate for affordable housing. CONTRACT/AGREEMENT CHANGES: N/A STAFF RECOMMENDATION: Direction to staff to prepare a resolution to effectuate the transfers of the two county-owned parcels (Block 6, Lots 14 and 15, Holiday Homesites Subdivision) to Habitat for Humanity of the Upper Keys, Inc., for the construction of two affordable housing dwelling units.
