AGENDA ITEM WORDING: Authorization to initiate litigation against PATRICK G. KNIGHT
and his property, 30422 Oleander Boulevard, Big Pine Key, Florida, to seek compliance with the
County Code and enforce the lien(s) arising from code compliance case number CE20010021.
ITEM BACKGROUND:
CE20010021: This property has been the subject of a code compliance case for failure to obtain
required building permit(s) for construction/installation of a) deck with tiki hut cover (not compliant)
and b) storage container (compliant), prohibited parking (compliant) and storage and habitation
prohibited (compliant). The fines total $28,100.00 as of April 14, 2022 and will continue to accrue
at $50.00 per day, until compliance is achieved.
A hearing was scheduled for July 30, 2020 and on July 25, 2020, the property owner signed a
Stipulation for an Extension of Time to comply with the County. On July 30, 2020, the Special
Magistrate approved the stipulated agreement with two compliance dates of August 7, 2020 and
was held on May 27, 2021 and the property owner was present. The Special Magistrate found the
code case remains open for non-compliance and failure to pay outstanding fines and costs.
The property is not homesteaded and there are no pending foreclosure actions at this time.The
priority over the mortgage company.
Under the policy adopted in Resolution 057-2014 the available legal options in regard to the
1. Initiate litigation against the property owner for injunction, foreclosure, money judgment
and/or writ of execution;
2. Allow the liens to remain against the property owner, the subject property and any other
property owned by the property owner; and/or

3. Release the lien.
County staff recommends initiating litigation (option 1) against the property owner for injunction,
foreclosure, money judgment and/or writ of execution.
