County, Florida.
ITEM BACKGROUND: The petition has been made on behalf of the County requesting abandonment of a portion of
MacDonald Avenue as described more specifically in the attached survey dated 3/25/11, in order increase access, parking,
stormwater retention, and landscaping for the future Stock Island fire station. The section of road to be abandoned is a
curved section of road way between the existing Stock Island Fire Station and Lots 12, 13, 14, and 15, which the County
owns and Lot 11. Lot 11 is presently owned by Dr. Fred R. Burrin, who has filed a letter of no objection to the
abandonment. Subsequent to abandonment, Dr. Burrin will be left owning a rectangle of land containing 1,500.00 square
feet or 0.0344 acres more or less, which is part of the road adjacent to Lot 11. Dr. Burrin is presently considering the
County's offer to purchase that rectangle after the abandonment; the purchase or lack of purchase will not significantly
impact the proposed Stock Island Fire Station. Abandoning the road between the properties will allow use of that land as
part of the full site plan and will not impact vehicular access to any other properties. The County recognizes that Florida
Keys Aqueduct Authority, AT&T, Keys Energy Services, and Key West Resort Utilities have not provided complete
letters of no objection to the road abandonment based on their requests for easements onto the property. The County does
not object to utility easements and is cooperating with these utilities to obtain the easements. Allowing the easements is
not required by state statute or county code prior to BOCC approval for the road abandonment.
PREVIOUS RELEVANT BOCC ACTION: The BOCC approved the purchase of Lots 12, 13, 14, and 15 in late
2011. At the June 20, 2012 BOCC meeting, the BOCC approved a resolution setting a public hearing for July 18, 2012 in
Key West to consider this road abandonment petition.

COMMISSIONERS OF MONROE COUNTY RENOUNCING

WHEREAS, the Board of County Commissioners of Monroe County, Florida, desires to
renounce and disclaim any right of the County and the public in and to the hereinafter streets,
alley -ways, roads or highways; and
WHEREAS, it serves a public purpose to renounce and disclaim any right to the County
and the public in and to the hereinafter streets, alleyways, roads, or highways, in order to provide
improved access to the fire station, increase storm water retention, provide for parking of
emergency vehicles, allow for landscaping adjacent to the road of the future fire station; and
WHEREAS, due notice has been published and a public hearing has been held in
accordance with Chapter 336, Florida Statutes; and
WHEREAS, at said public hearing the Board considered the argument of all parties
present wishing to speak on the matter, and considered the renouncing and disclaiming of any
right of the County and public in and to the hereinafter described streets, alley -ways, roads, or
highways as delineated on the hereinafter described map or plat; and

WHEREAS, the Board has determined that vacation of the said road is for the general
public welfare, and conforms to the requirement of Florida Statute Sections 336.09 and 336.10;
and
NOW THEtEFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, that it hereby renounces and
disclaims any right of the County and public in and to the following described streets, alley-
ways, roads, or highways as delineated on the hereinafter described map or plat, to -wit:
A portion of MacDonald Avenue, lying South of Lots 11, 12, 13, 14, & 15, Block
31 and North of Lots 8, 9, & 10, Block 35, and Northerly of Maloney Avenue (as
existing and constructed).
"MALONEY'S SUBDIVISION OF STOCK ISLAND", a subdivision of
Government Lots 1, 2, 3, 5, & 6, Section 35, Government Lot 2, Section 36,
Government Lot 3, Section 26, and Government Lot 2, Section 34, all in Township
67 South, Range 25 East on Stock Island according to the plat thereof, as
recorded in Plat Book 1 at Page 55 of the Public Records of Monroe County
Florida, and being more particularly described as follows:
BEGIN at the Southeast corner of said Block 31; thence S 00°0534" E along the
Southerly extension of the Easterly line of said Block 31 for 60.00 feet to the
Northeast corner of said Block 35, thence S 89°5426" W along the North lines of
said Lots 8, 9, & 10 for 142.91 feet to the Northerly Right -of —Way line of
Maloney Avenue and a point on a curve, concave to the Southwest, having a
radius of 985.40 feet, a central angle of 06°30'34 ", a cord bearing of N
73°15'02"W and a cord length of 111.89 feet; thence along the arc of said curve,
an are length of 111.95 feet to the Southerly Extension of the Westerly Line of
said Lot 15, thence N 00005134" W along the Southerly extension of the Westerly
line of said Lot 15 for 27.58 feet to the Southwest corner of said Lot 15, and also
being the Northerly Right -of -Way line of MacDonald Avenue, thence N

REQUEST:
The petitioner, the Monroe County Project Management Department, has requested abandonment of that
portion of MacDonald Avenue, lying South of Lots 11, 12, 13, 14, & 15, Block 31 and North of Lots 8,
9, & 10, Block 35, and Northerly of Maloney Avenue (as existing and constructed), "Maloney's
Subdivision of Stock Island", a Subdivision of Government Lots 1, 2, 3, 5, & 6, Section 35, Government
Lot 2, Section 36, Government Lot 3, Section 26, and Government Lot 2, Section 34, all in Township 67
South, Range 25 East on Stock Island according to the plat thereof, as recorded in Plat Book 1 at Page
55 of the Public Records of Monroe County, Florida.
If this request is approved, the additional land area would allow for a better design for the future Stock
Island Fire Station. It is in the interest of public service in that the better design will enhance the ability
for emergency vehicles to efficiently enter and exit the facility, which could improve response time.
REVIEW:
The petition has been made on behalf of the County requesting abandonment of a portion of MacDonald
Avenue as described more specifically in the attached survey dated 03/25/11. The section of road to be
abandoned is a curved section of road way between the existing Stock Island Fire Station and Lots 12,
13, 14, and 15 (which is presently owned by the County) and Lot 11 (which is presently owned by Dr.
Fred R. Burrin).
The presently vacant lots owned by the County, Lots 12-15, are identified by real estate
#00124460.000000. The lots currently owned by the County and developed with the existing fire
station, part Lots 8-10, are identified by real estate #00124830.000000.
This petition has been reviewed by relevant County staff and written documents recommending
approval and/or stating no objection were received from the Engineering Department (12/20/2011), the

1 Office of the Fire Marshal (12/02/2011), the Sheriff s Office (12/12/2011) and the Code Compliance
2 Department (12/22/2011).

4 Letters of no objection have been received from both affected property owners: Dr. Fred R. Burrin,
5 owner of Lot 11, identified by real estate #00124440.0000000 (5/22/2012) and Steve Eid/Kit Carson
6 Smith/H-Try, LLC, owner of Lot 16, identified by real estate #00124470.0000000 (5/22/2012). Dr.
7 Burrin has filed a letter of no objection to the abandonment. Subsequent to abandonment, Dr. Burrin will
8 be left owning a rectangle of land containing 1,500.00 square feet or 0.0344 acres more or less, which is
9 part of the road adjacent to Lot 11. Dr. Burrin is presently considering the County's offer to purchase
10 that rectangle after the abandonment; the purchase or lack of purchase will not significantly impact the

14 Letters have been received from all relevant utility providers: Key West Resort Utility (wastewater —
15 11 /02/2011), Keys Energy Services (electric — 11 /29/2011), Florida Keys Aqueduct Authority (FKAA)
16 (water - 11/16/2011), AT&T (telephone/internet - 11/02/2011) and Comcast (cable — 09/15/2011).
17 Letters of no objection for Florida Keys Aqueduct Authority, AT&T, Keys Energy Services and Key
18 West Resort Utilities are reliant on the BOCC approving a utility/access easement(s), the County is
19 cooperating with these utilities to obtain the easements; however, obtaining the easements are not
20 required by state statute or county code prior to BOCC approval for the road abandonment.

22 Monroe County Code Section 19-1, Abandonment of rights -of -way, states:
23
24 (a) No dedicated and accepted right-of-way in the county shall be abandoned where:
25
26 (1) The right-of-way terminates on a body of open water; or
27
28 [In compliance; the right-of-way does not terminate on a body of open water.]
29
30 (2) The right-of-way provides access to the public to land on open water; or
31
32 [In compliance; the right-of-way does not provide access to the public to land on open
33 water.]

35 (3) The abandonment would preclude a way for the public to maintain access to the water.
36
37 [In compliance; the abandonment would not preclude a way for the public to maintain
38 access to water.]

40 (b) In all other cases of abandonment, no right-of-way shall be abandoned unless there is an agreement to
41 do so by all affected property owners. For purposes of this subsection, an affected property owner is
42 the owner of property which, if the right-of-way is abandoned, will:
43
44 (1) Have access that is currently used by that property owner eliminated;
45

47 affected property owners.]

49 (2) Have the only platted access eliminated;

(3) Have the paved area adjacent to that property increased for turn -around purposes; or
[No property would have the paved area adjacent to that property increased for turn-
around purposes.]
(4) Be increased in size.

affected property owners.]
(c) A road may be abandoned only at the terminal portion of the road and in its full width unless the
abandonment will comply with the County Code requirements for road, turn -around, and fire -rescue
access and one of the following circumstances exists:
(1) An adjacent lot owner has on the platted right of way or within a setback a substantial structure
which predates the Special Session Law 59-1578 pertaining to maps, plats and right of way. The
term "substantial structure" specifically does not include wood or metal fences, sheds or tiki huts
or other items not listed which are accessory structures.
[In compliance, this abandonment is not at a terminal portion of MacDonald Avenue.]
(2) The abandonment is requested by a County department or governmental agency for a public
purpose.

(d) The board of county commissioners considers these a restriction on the rights of individuals who
desire to abandon properties in accordance with F.S. § 336.09.

I received the packet in regards to requesting a 250' road
abandonment traveling from MacDonald Avenue to 2na Street in
Stock Island Florida.. I conducted a physical inspection of the area
under review for the abandonment.
I walked the area of concern and was unable to locate any
structures, residences or access to such that would hinder
emergency medical/ rescue and law enforcement services by
proceeding with this abandonment.

adjacent to Lot 15, which is owned by Monroe County. Lot 16 does not fronton the proposed road
abandonment property but lies directly north and west of the portion of MacDonald Road which is to be
abandoned. However, my property does not presently have access to Maloney Avenue, if the road is
abandoned my Lot 16 will not have road access without a curb cut from my property to Maloney
Avenue.
Please be advised that 1 have no objection to the abandonment of the above described site,
contingent upon the County building a curb cut from my property onto Maloney Avenue. The County
has agreed to build the curb cut to be completed on or about September 1, 2012 or earlier.

The Florida Keys Aqueduct Authority has reviewed your request for abandonment of a 250 foot
section of MacDonald Avenue right of way adjacent to the Stock Island Fire Station per your survey.
The FKAA has a 4" water main located in the area of the proposed abandonment along with several
water meters serving the adjacent properties. The FKAA will require a 20' easement for maintenance
of this 4" water main and reading of the meters monthly.
Please advise if a 20' easement will be possible and if so then we will submit to the Board of Directors
for approval. Please note that final decision of abandonment of the road will be decision of the Board
of Directors.

ITEM BACKGROUND: The petition has been made on behalf of the county requesting
abandonment of a portion of MacDonald Avenue as described more specifically in the attached survey
dated 3/25/11, in order to increase access, parking, storm water retention and landscaping for the future
Stock Island fire station. The section of road to be abandoned is a curved section of road way between
the existing Stock Island Fire Station and Lots 12, 13, 14, and 15, which the county owns and Lot 11.
Lot 11 is presently owned by Dr. Fred R. Burrin, who has filed a letter of no -objection to the
abandonment. Subsequent to abandonment, Dr. Burrin will be left owning a rectangle of land
containing 1,500.00 square feet or 0.0344 acres more or less, which is part of the road adjacent to Lot
11. Dr. Burrin is presently considering the County's offer to purchase that rectangle after the
abandonment; the purchase or lack of purchase will not significantly impact the proposed Stock Island

Fire Station. Abandoning the road between the properties will allow the use of that land as part of the
full site plan and will not impact access to any other properties. The County recognizes that Florida
Keys Aqueduct Authority, AT&T, Keys Energy Services, and Key West Resort Utilities have objected
to the road abandonment unless an easement is granted to them for access; the grant of these easements
will be simultaneously presented to the BOCC at the public hearing on the road abandonment.
PREVIOUS RELEVANT BOCC ACTION: The BOCC approved the purchase of Lots 12, 13, 14,
and- 15 in late 2011. The County has employed William Horn who is presently completing the plans for
the station.

Monroe County Code Section 19-1 - Abandonment of rights -of -way states:
(a) No dedicated and accepted right-of-way in the county shall be abandoned where:
(1) the right-of-way terminates on a body of open water; or
(2) the right-of-way provides access to the public to land on open water; or
(3) the abandonment would preclude a way for the public to maintain access to the water.
(b) In all other cases of abandonment, no right-of-way shall be abandoned unless there is an agreement to
do so by all affected property owners. For purposes of this subsection, an affected property owner is
the owner of property which, if the right-of-way is abandoned, will:
(1) Have access that is currently used by that property owner eliminated;
(2) Have the only platted access eliminated;
(3) Have the paved area adjacent to that property increased for turn -around purposes; or
(4) Be increased in size.
(c ) A road may be abandoned only at the terminal portion of the road and in its full width unless the
abandonment will comply with the County Code requirements for road, turn -around, and fire -rescue
access and one of the following circumstances exists:
(1) An adjacent lot owner has on the platted right of way or within a setback a substantial
structure which predates the Special Session Law 59-1578 pertaining to maps, plats and right
of way. The term "substantial structure'.' specifically does not include wood or metal fences,
sheds or tiki huts or other items not listed which are accessory structures.
(2) The abandonment is requested by a County department or governmental agency for a public
purpose.

(d) The board of county commissioners considers these a restriction on the rights of individuals who
desire to abandon properties in accordance with F.S. § 336.09.
All of the following mast be submitted in order to have a complete application submittal:

ZI Correct fee (check or money order to Monroe County Planning & Environmental Resources);
91 Legal description of the portion of the roadway to be abandoned in metes and bounds;
Proof of ownership of the petitioner's property(s) (i.e. Warranty Deed);
El Current Property Record Card(s) from the Monroe County Property Appraiser for the petitioner's
property;

Location map (i.e. copy of strip map, aerial photograph);
IZI Photograph(s) of the roadway to be abandoned;
El Signed and Sealed Survey of roadway to be abandoned and all adjoining properties, prepared by a
Florida registered surveyor — 12 sets (At a minimum, survey should include a legal description of the
roadway; elevations; location and dimensions of all existing structures, paved areas and utility structures;
roadways and easements; and all bodies of water on the site and adjacent to the site. The portion of the
roadway to be abandoned should be marked with diagonal lines and the petitioner's property should be
clearly delineated);
Letters of "No Objection" from all utility companies (Florida Keys Aqueduct Authority (FKAA);
s�} Florida Keys Electric Cooperative (FKEC) or Keys Energy Services; telephone utility, gas utility, cable
utility, wastewater treatment authority, etc.);
® Letters of "No Objection" from all affected property owners (an affected property owner is a) one who
would have a means of access to his or her property closed off as a result of the abandonment even though
he or she may not actually use the right-of-way prior to abandonment or b) one whose property abuts the
portion of the roadway to be abandoned);
❑ IF A CUL-DE-SAC OR "T-TYPE" TURNAROUND IS REQUIRED to be constructed, it will be the
A responsibility of the Petitioner, if the road to be abandoned will result in an existing rock or paved road
being shortened. See Monroe County Code §9.5-296(p). Your petition should specifically state your
agreement to construct either the cul-de-sac or "T-type" turnaround per County Standard specifications and
Details. (Should you need additional information regarding this matter, please contact the Monroe County
Engineering Department directly by phoning (305) 292-4427).
If applicable, the following must be submitted in order to have a complete application submittal:

BOCC through its authorized agents. If easements are so required, copies of the executed documents will be
provided to the County before the petition is presented to the BOCC.

dedicated and accepted right-of-way (including by operation of law due to construction or maintenance by the
County).

The Florida Keys Aqueduct Authority has reviewed your request for abandonment of a 250 foot
section of MacDonald Avenue right of way adjacent to the Stock Island Fire Station per your survey.
The FKAA has a 4" water main located in the area of the proposed abandonment along with several
water meters serving the adjacent properties. The FKAA will require a 20' easement for maintenance
of this 4" water main and reading of the meters monthly.
Please advise if a 20' easement will be possible and if so then we will submit to the Board of Directors
for approval. Please note that final decision of abandonment of the road will be decision of the Board
of Directors.

I received the packet in regards to requesting a 250' road
abandonment traveling from MacDonald Avenue to 2nd Street in
Stock Island Florida.. I conducted a physical inspection of the area
under review for the abandonment.
I walked the area of concern and was unable to locate any
structures, residences or access to such that would hinder
emergency medical/ rescue and law enforcement services by
proceeding with this abandonment.
