AGENDA ITEM WORDING: A public hearing to consider an ordinance establishing Monroe County Code Section
130-102, Horses and other livestock, establishing regulations related to the keeping of horses and other livestock in
Monroe County.
ITEM BACKGROUND:
Currently, the Monroe County Land Development Code and Monroe County Comprehensive Plan do not contain any
provisions that clearly regulate the keeping of horses and other livestock on properties in Monroe County. Previously,
horses have been allowed or prohibited by varying administrative interpretations of planning directors.
Horses are a type of livestock, as defined in Monroe County Code Section 4-1: "Livestock means horses, stallions, colts,
geldings, mares, sheep, rams, lambs, bulls, bullocks, steers, heifers, cows, calves, mules, jacks, jennies, burros, goats,
kids, swine, and any other fur-bearing animals being raised in captivity, including those other animals recognized by the
department of agriculture as being within the jurisdiction of its department." Monroe County Code Section 4-76, which
pertains to the keeping of livestock does not address horses: "No livestock, such as cows, goats, sheep or pigs, barnyard
animals such as chickens, ducks, rabbits or geese, shall be kept either penned or loose in any zone where not otherwise
permitted in the county.Animals considered wild shall not be kept in any residential zone in the county."
Although Monroe County Code Section 4-76 implies that the County should allow livestock in appropriate zones,no such
zones have been established in the Land Development Code. The purpose of this amendment is to clarify where horses
and other livestock may be kept.
During a regularly scheduled meeting held on June 26, 2012, the Monroe County Development Review Committee
reviewed the ordinance and recommended approval to the BOCC. During a regularly scheduled meeting held on August
29,2012,the Planning Commission reviewed the ordinance and recommended approval to the BOCC.
PREVIOUS RELEVANT BOCC ACTION: This proposed text amendment was discussed by the Board of County
Commissioners at its October 17, 2012 meeting. At that time, the Board requested that staff make the following
modifications:
• For keeping a horse for personal use, increase the minimum size requirement of a parcel of land from 1/2 acre of
upland(Staff increased to 2 acres)
• Prohibit the keeping of horses in Improved Subdivision (IS) and Urban Residential Mobile Home (URM) land use
districts(Staff added the prohibition)

23 WHEREAS, this ordinance is intended to establish criteria and clarify where horses and other
24 livestock may be kept in unincorporated Monroe County; and
25
26 WHEREAS, prior to this ordinance, the Monroe County Land Development Code and Monroe
27 County Comprehensive Plan did not contain any provisions directly related to the keeping of
28 horses and livestock; and
29
30 WHEREAS, Section 4-76 of the Monroe County Code implies that zoning should allow
31 livestock in an appropriately zoned areas; however, no such areas have been established in the
32 Land Development Code; and
33
34 WHEREAS, based upon the information and documentation submitted, the Commission makes
35 the following Conclusions of Law: 1) the text amendment is consistent with the Principles for
36 Guiding Development in the Florida Keys Area of Critical State Concern; 2) the text amendment
37 is consistent with the provisions and intent of the Monroe County Comprehensive Plan; and 3)
38 the text amendment is consistent with the provisions and intent of the Monroe County Code; and
39
40 WHEREAS, during a regularly scheduled meeting held on June 26, 2012, the Monroe County
41 Development Review Committee reviewed the ordinance and recommended approval to the
42 Board of County Commissioners; and
43
44 WHEREAS, during a regularly scheduled public hearing held on August 29, 2012, the Monroe
45 County Planning Commission reviewed the ordinance and recommended approval to the Board
46 of County Commissioners;

2 NOW, THEREFORE, BE IT ORDAINED BY THE MONROE COUNTY BOARD OF
3 COUNTY COMMISSIONERS:

5 Section 1. Section 130-102 of the Monroe County Code shall be established as follows
6 (deletions are stfieken thfough and additions are underlined):

8 Sec. 130-102. Horses and Other Livestock.
9
10 (a) Definition of livestock. Livestock means horses stallions coltsgeldings, mares sheg,
11 rams lambs bulls bullocks steers heifers cows calves mules jacks jennies burros
12 goats, kids, swine, and any other fur-bearing animals being raised in captivity, including
13 those other animals recognized by the Florida Department of Agriculture and Consumer
14 Services as being within the jurisdiction of its department.

16 (b) Keeping of livestock Excluding horses for personal use as allowed in subsection (c) the
17 keeping of livestock is permissible only on a parcel of land that a) has an approved
18 agriculture use and b) is within a land use (zoning) district which permits agriculture
19 and/or is within an agricultural/aquacultural use overlay as set forth in section 130-120
20
21 (c) Keeping of a horse for personal use.
22 (1) A horse may not be kept on a parcel of land that contains less than two (2) acres of
23 contiguous upland and/or is within an Improved Subdivision (IS) or Urban
24 Residential Mobile Home (URM) land use (zoning) district.
25 (2) On a parcel of land that contains two (2) acres or more of conti ug ous upland a
26 horse(s)may be kept if all of the following criteria are met:
27 (i) The horse(s) shall be for personal use only. Under no circumstance shall the
28 horse(s) be related with an on-site commercial purpose such as a commercial
29 riding ground; and
30 (ii) There shall be a lawful residential dwelling unit on the same parcel of land upon
31 which the horses is kept, and
32 (iii)The owner of the horse(s) shall occupy the residential dwelling unit required in
33 ii • and
34 (iv)The areas in which the horse(s) is to roam shall be entirely enclosed with a fence
35 of at least four(4) feet in height. Excluding along a fronts and property line where
36 a fence may be constructed in accordance with the standards set forth in section
37 114-20, a fence required by this subsection shall be set back at least twenty (20)
38 feet from any side or rear non-shoreline property line; and
39 (v) The stable or other area in which the horses is kept overnight shall be located at
40 least fifty (50) feet from any residential dwelling unit excluding the residential
41 dwelling unit in which the owner of the horse(s)resides; and
42 (vi)For parcels of land containing over two (2) acres of contiguous upland an
43 additional horse may be maintained for each additional whole acre of upland

I Section 2. Severability.

3 If any section, paragraph, subdivision, clause, sentence or provision of this ordinance shall be
4 adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect,
5 impair, invalidate, or nullify the remainder of this ordinance, but the effect thereof shall be
6 confined to the section, paragraph, subdivision, clause, sentence, or provision immediately
7 involved in the controversy in which such judgment or decree shall be rendered.

9 Section 3. Conflicting Provisions.
10
11 All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the
12 extent of said conflict.

14 Section 4. Transmittal.
15
16 This ordinance shall be transmitted to the Florida State Land Planning Agency as required by F.S.
17 380.05 (11) and F.S. 380.0552(9).

19 Section 5. Filing.
20
21 This ordinance shall be filed in the Office of the Secretary of the State of Florida but shall not
22 become effective pursuant to Section 7 until a final order is issued according to F.S. 380.05(6)by
23 the Florida State Land Planning Agency or Administration Commission approving the ordinance,
24 and if the final order is challenged, until the challenge to the order is resolved pursuant to F.S.
25 Chapter 120.

27 Section 6. Inclusion in the Monroe County Code.
28
29 The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances
30 of the County of Monroe, Florida, as an addition to amendment thereto, and shall be
31 appropriately renumbered to conform to the uniform marking system of the Code.

33 Section 7. Effective Date.
34
35 This ordinance shall become effective as provided by law and stated above. This ordinance
36 applies to any applicable application submitted after the effective date.
37

4 The Planning & Environmental Resources Department is proposing an amendment to the
5 Monroe County Code (MCC) to create a new section: §130-102, Horses and other livestock.
6 The purpose of the proposed amendment is to establish clear regulations addressing and
7 managing the keeping of horses and other livestock on property in unincorporated Monroe
8 County.

6 III REVIEW

8 The Planning & Environmental Resources Department regularly receives inquiries related to
9 the keeping of horses. The most common inquiries are from property owners who want to
10 keep their personal horses on their properties. Other inquiries are from property owners who
11 want to establish commercial stables on their properties or who want to keep types of
12 livestock other than horses on their property.
13
14 Currently,the Monroe County Code and Monroe County Comprehensive Plan do not contain
15 any provisions directly related horses and livestock. Horses and other livestock have been
16 allowed or prohibited by varying administrative interpretations of planning directors.
17 Changing interpretations have led to confusion and the provision of differing information to
18 the public.

20 Horses are a type of animal defined within the definitions of animal and livestock in MCC
21 §4-1:
22
23 Animal means any living dumb creature, including any mammal, bird, fish, reptile, ferret,
24 turtle, horse, mollusk, crustacean, or any other vertebrate other than a human being.
25
26 Livestock means horses, stallions, colts, geldings, mares, sheep, rams, lambs, bulls,
27 bullocks, steers, heifers, cows, calves, mules, jacks, jennies, burros, goats, kids, swine,
28 and any other fur-bearing animals being raised in captivity, including those other animals
29 recognized by the department of agriculture as being within the jurisdiction of its
30 department.

32 However, MCC §4-76, which pertains to the keeping of wild animals and livestock does not
33 address horses. MCC §4-76(a) states:
34
35 Zoning. No livestock, such as cows, goats, sheep or pigs, barnyard animals such as
36 chickens, ducks, rabbits or geese, shall be kept either penned or loose in any zone where
37 not otherwise permitted in the county. Animals considered wild shall not be kept in any
38 residential zone in the county
39
40 Although this subsection implies that zoning should allow livestock, it states that they should
41 only be allowed in an appropriate zone. No such zones have been established in the Land
42 Development Code.

44 Many jurisdictions consider livestock and agriculture synonymous. However, as defined in
45 MCC §101-1, agriculture means mariculture, beekeeping, animal husbandry, groves and

1 nurseries, but does not mean row crops. The definition does not directly include the keeping
2 or livestock not related to animal husbandry.

4 The purpose of this amendment is to establish the zone required by MCC §4-76(a) and
5 clarify where horses and other livestock may be permitted in Monroe County.

3 IV RECOMMENDATION

5 Staff has found that the proposed text amendment would be consistent with the Principles for
6 Guiding Development in the Florida Keys Area of Critical State Concern, the Monroe
7 County Comprehensive Plan and the Monroe County Code.
8
9 Further, staff has found that the proposed text amendment would be in compliance with the
10 provisions of §102-158(d)(5)(b): 1. Changed projections (e.g., regarding public service
11 needs) from those on which the text or boundary was based; 2. Changed assumptions (e.g.,
12 regarding demographic trends); 3. Data errors, including errors in mapping, vegetative types
13 and natural features described in volume I of the plan; 4. New issues; 5. Recognition of a
14 need for additional detail or comprehensiveness; or 6. Data updates. Specifically, staff has
15 found that the proposed text amendment is necessary due to recognition of a need for
16 additional detail or comprehensiveness.

18 Staff recommends that the Board of County Commissioners amend the Monroe County Code
19 as stated in the text of this staff report.

Hi Sylvia and Pam,
Hope all is well with you! We have as our pets a miniature rescue horse named "Hunter" and a pot bellied pig named •
"Matilda". As you know the ownership of such has been under discussion for a while. I've attached last year's proposed
ordinance allowing 1 animal if you had at:_lease 1/2 acre, fenced and owneroccupied. The new ordinance has quadrupled
the minimum acreage to 2 acres. I was hoping to meet in the middle by having a;minimum of 1 acre. This is what most feel
as fair without being discriminatory. Not many folks are fortunate enough to own that large of a parcel. People who are
involved in animal rights,such as Bill Crispin, Joy and Brad Martin,and'br Bob Foley also are looking for a "happy median".
We are all worried of losing our pets. There is still another legal discussion,are these animals our "pets" or are they
"livestock or barnyard animals". The ordinance should also take advantage of this opportunity to bring some certainty to
the issues at hand and addresse the distinction between commercial livestock husbandry and keeping of a pet,defined by
Webster as "an animal that is domesticated and kept as a companion or treated with fondness".

Hello Sylvia and Pam,
Suzan Wiese and myself own and live at Pirate Hat Marina, 199 Morris Ave, Key Largo. It is a one acre fenced and gated
area and Suzan owns the adjoining one acre Pelican Cay Harbor, 299 Morris Ave.
Suzan evicted one of her tenants for not paying rent so he turned her in to everyagency under the sun. "Typical"! One
was the FWC. They came to the site and'told°her tenant that tenant/landlord problems are civil matters. Then he saw
that we have a rescue pony and a pot bellied pig. FWC Officer Fernandez then called in Monroe County Humane Society.
Michael Ceslman, Animal Control, who then issued Suzan a citation to appear in,court on the 9th of July at 1:30 p.m. with
Judge Ptomey.
Officer Fernandez was agressive and threatened to take us to jail. She violated our civil rights as well as my animals!
She and Michael said it's the law! I asked for a copy of the law and told them that I knew of many horses and pot bellied
Digs in Monroe County. They told me to shut up or go to jail. They could not:produce the law. I went to the Humane
Society the next day and was given the attached'Ione page "4-76 Keeping Wild Animals and Livestock" of 1979. After
'aiding Paragraph (a) I see that horses are excluded. Then I contacted my lawyer, Bill Crispin, who is an agricultural,
mimal rights specialist. He forwarded me the proposed County ordinance from last September and-October. This

ITEM BACKGROUND: Currently, the Monroe County Code and Monroe County Comprehensive Plan
do not contain any provisions directly related to horses and livestock. The purpose of this amendment
is to clarify where horses and other livestock may be permitted in4Monroe County. Previously, horses
have been allowed or prohibited by administrative interpretations of planning directors. . Horses are a
type of animal defined within the definitions of animal and livestock in MCC §4-1: Animal means any
living dumb creature, including any mammal, bird, fish,: reptile, ferret, turtle, horse, mollusk,
crustacean, or any other vertebrate other,than a-human being.! Livestock means horses, stallions, colts,
geldings,mares; sheep, rams, lambs,bulls,bullocks, steers,heifers, cows, calves, mules,jacks,jennies,
burros, goats, kids, swine, and any other fur-bearing animals being raised in captivity, including those
other animals recognized by. the department of agriculture'as being within the jurisdiction of its
department. However, MCC §4-76, which pertains to the keeping of wild animals and livestock does
not address horses. MCC §4-76(a) states: Zoning. No livestock, such as cows, goats, sheep or pigs,
barnyard animals such as chickens, ducks, rabbits or geese, shall be kept either penned or loose in any
zone where not otherwise permitted in the county. Animals considered-wild shall not be kept in any
residential zone in the county. Although this subsection implies that zoning should allow livestock it
states that they should only be allowed in an appropriate zone! No such zones have been established in
the Land Development Code. During a regularly scheduled meeting held. on June 26, 2012, the
Development Review Committee reviewed the subject request and recommended approval to the
BOCC. The Planning Commission held a public hearing on August 13, 2012 and recommended
approval to the BOCC. .
This ordinance will be part of the.Land Development Code.

11 This item was heard at the June_ 26, 2012 Development Review Committee with minor
12 revisions being requested. The Development Review Committee recommended approval to
13 the Planning Commission. The Planning Commission held a public hearing on August 29,
14 2012 and recommended approval to the Board of County Commissioners.

18 The Planning & Environmental Resources Department regularly receives zoning inquiries
19 related to horses. The most common inquiries are from property owners who want to keep
20 their personal horses on their properties. Other inquiries are from property owners who want
21 to establish commercial stables onl their properties.

Thanks for your immediate response to this issue! It is a shame after 3 weeks of investigation with Steven Biel, Marsha
Garrettson (of the Humane Animal Care Coalition MM106)and Sylvia Murphy that I couldn't be given the same
information. None of them knew anything of the county's September and October' 2012 BOCC review nor the upcoming 17
July 2013 agenda. I've attached Sylvia.Murphy's email dated 21 June 201`3 where she essentially told us to litigate
rather than to just say "we're working on this and please come to the 17th of July 2013 BOCC meeting to discuss your
feelings"? No one can get anything accomplished out of the Key Largo offices.-`It's "Non Op"! I'm sorry you have to do
all of their work.
Joe,after reading the most recent changes to the proposed new code 130-102,I see that the acreage requirements have
been quadrupled from 1/2 acre to 2 acres for 1 horse. That seems a bit excessive and probably discriminatory. Not many
2 acre (+) property owners in the Keys. Maybe a 1 acre minimum would be okay. The other question that I had is on the
zoning. The proposed ordinance references IS & URM. What about SC orSR zoning? There is still a debate on whether a
miniture horse or pot bellied pig is a "pet" or barnyard animal.
Look forward to discussing this further and then passing this ordinance in a mutually accepted format. If I can be of any
asistance or if you'd like me to speak at the upcoming meeting,I'd be happy to. Thanks again.
