ITEM BACKGROUND:
The Department of Economic Opportunity (DEO) awarded Monroe County $15 million in CDBG-
DR funding, via Subrecipient Agreement I0092, to acquire Irma-damaged properties in low to
moderate income areas or from households with low to moderate income. As of June 1, 2022, the
County has acquired eight properties that were damaged by Hurricane Irma. These and future
VHBP acquisitions are being made to reduce the impact of disasters by acquiring properties that are
in high-risk flood.
The Subrecipient Agreement requires the County to demolish the homes and restrict VHBP acquired
properties in perpetuity to open space uses, storm water improvements, or to restore and conserve
the natural floodplain functions. Some of the homes that will be demolished may contain building
materials that are suitable and appropriate for reuse. Staff is seeking to donate reusable materials
rather than disposing of them in landfills. Staff proposes to contact Habitat for Humanity and other
suitable Not-for-Profit 501(C)(3) organizations to allow them to salvage reusable items from the
homes, such as doors, windows, and cabinets on a first come, first serve basis. Any salvage will be
supervised and coordinated by County staff, and a Release of All Claims (attached)will be required.
Pursuant to Monroe County Procurement Code Chapterl2. Surplus Items, (5):
"Property which value is estimated by the BOCC to be under $5,000.00 deemed to have no further
use to the County due to obsolescence, inefficiency, or being uneconomical may be donated to
another governmental entity within the County; may be donated to a private not-for-profit
organization within the County or may be disposed of for value in compliance with 274.06 Florida
Statutes as amended." Excerpt provided below.

274.06 Alternative procedure.—Having consideration for the best interests of the county or district, a
governmental unit's property that is obsolete or the continued use of which is uneconomical or
inefficient, or which serves no useful function, which property is not otherwise lawfully disposed of,
may be disposed of for value to any person, or may be disposed of for value without bids to the state,
to any governmental unit, or to any political subdivision, or if the property is without commercial
value it may be donated, destroyed, or abandoned. The determination of property to be disposed of
by a governmental unit pursuant to this section instead of pursuant to other provisions of law shall be
at the election of such governmental unit in the reasonable exercise of its discretion. Property, the
value of which the governmental unit estimates to be under $5,000, may be disposed of in the most
efficient and cost-effective means as determined by the governmental unit.
PREVIOUS RELEVANT BOCC ACTION:
On July 22, 2019, the BOCC approved the CDBG-DR VHBP grant application to DEO (Agenda
Item B.1).
On May 20, 2020, the BOCC approved Resolution 150-2020 allowing the county to execute the
CDBG-DR VHBP Subrecipient Agreement with DEO (Agenda Item D.2).
