ITEM BACKGROUND: Two changes are proposed to the 2022 Land Authority Acquisition List.
The first change is to add two lots to the Acquisition List as potential affordable housing sites. The
lots are adjoining parcels totaling 12,228 square feet at 28269 Julia Avenue on the bay side of Little
Torch Key near mile marker 28. One of the lots was previously developed with a dwelling unit and
is therefore ROGO exempt. The other lot is vacant and has 1 TDR. These two lots are next to a
third lot the Land Authority purchased for affordable housing development after Hurricane Irma.
The Land Authority has a contract to purchase the two subject lots, plus adjacent acreage property
that will be reserved for conservation for $300,000.
In order to purchase the property, the subject lots must first be added to the Acquisition List.
After purchase, the two lots may be developed as affordable housing. One lot could use the ROGO
exemption and the other is being processed for consideration of receipt of an affordable housing
ROGO allocation.
These lots could potentially be developed by the County for employee housing, by the Housing
Authority as affordable Rental Housing, or by a non-profit for affordable housing.
The second change to the Acquisition List is to amend the affordable housing eligibility criteria to
define environmentally sensitive land and reference Comprehensive Plan Policy 601.1.11. MCLA
staff have worked with the Sr. Director of Planning and Environmental Resources on this language.
The Comprehensive Policy reads:

The Land Authority shall not list or acquire lands as potential affordable housing sites if the lands
exhibit any of the following characteristics.
1. Any portion of the land lies within a known,probable, or potentially suitable threatened
or endangered species habitat.
2. The land has a Tier designation other than Tier III
3. The land is located in a V-Zone, on an offshore island or within a CBRS unit.
The County Land Development Code defines Environmentally Sensitive land as follows:
Environmentally sensitive lands means areas of native habitat requiring special management
attention to protect important fish and wildlife resources and other natural systems or processes.
Environmentally sensitive lands typically include wetlands and other surface waters, tropical
hardwood hammocks and pinelands.
ADVISORY COMMITTEE ACTION: On May 25, 2022 the Advisory Committee voted 4/0 to
approve these changes to the Acquisition List.

The MCLA Advisory Committee will promote acquisition, by fee simple purchases or other means provided in HB 1173,to 0
address affordable workforce housing damaged or destroyed by Hurricane Irma by adding to the Acquisition List, on a M
case-by-case basis, affordable housing sites that are preferably ROGO-exempt to be acquired by government partners
provided the sites are not located in a V flood zone and do not include environmentally sensitive habitat or possible
wetlands, and are not located in areas prohibited by Comprehensive Plan Policy 601.1.11. The Monroe County Code °
defines environmentally sensitive lands as "areas of native habitat requiring special management attention to protect y
important fish and wildlife resources and other natural systems or processes. Environmentally sensitive lands typically

include wetlands and other surface waters,tropical hardwood hammocks and pinelands." Native habitat includes Species CL
Focus Areas identified by the US Fish and Wildlife Service but does not include Species Focus Area Buffers. Therefore, <-
