ITEM BACKGROUND: A building permit was applied for on 3/19/2007 and a ROGO application was applied
for on 6/19/2007. The applicant applied for administrative relief on 1/9/2012 and is within the allowable time
frame to be eligible for administrative relief under Section 138-27 of the Monroe County Code.
The property is in Tier 1. The property is on the U.S. Fish& Wildlife Service list of parcels in Species Focus
Areas.As of Quarter 1 Year 21 this application's market rate ranking was#9 out of 12 applications in the Lower
Keys subarea. If the owner does not accept the offer provided by the Land Authority, the property remains in
ROGO. The application will continue to earn perseverance points pursuant to the vesting provision for
applications in the ROGO system prior to the effective date of Ordinance 09-2006. After the application has
been in ROGO 5 years, it will begin earning 2 perseverance points per year for each year thereafter that the
application remains in the ROGO system. The applicant may amend the ROGO application to increase points
through land dedication or purchasing points.
All Lower Keys Tier 1 allocations for the current year have been awarded. If an allocation is granted it will be
awarded in the next ROGO year.
Staff recommends that administrative relief be awarded in the form of a purchase offer by the Monroe
County Land Authority.

15 The property is located in Tier 1. The adjacent parcel to the west is developed with a single
16 family residence and the western portion of the subject parcel was partially cleared in the past
17 and is vegetated with the invasive lead tree (Leucaena leucocephala). The properties to the
18 north, across Mariposa Road, are Tier III. GIS habitat data and the vegetation survey submitted
19 by the applicant both indicate that the vegetative community on the eastern portion of the subject
20 parcel consists of tropical hardwood hammock. According to the survey vegetation on the
21 property includes several native plant species, including the endangered Key thatch palm
22 (Thrinax morrisii)and maiden bush(Heterosavia bahamensis). The hammock community on
23 the parcel is contiguous with over 1 acre of native upland habitat and according to the Species
24 Focus Area Maps(SFAM's)prepared by the U.S. Fish and Wildlife Service is potentially
25 suitable habitat for the following Federally listed species:
26 • Keys tree cactus
27 • Stock Island tree snail
28 • Silver rice rat
29 • Key deer
30 • Eastern indigo snake

32 In addition to the above, the parcel is also within the 500 meter buffer for the Lower Keys marsh
33 rabbit.

35 III. LEGAL ELIGIBILITY AND OPTIONS

37 Eligibility for Administrative Relief Options:
38 Section 138-27 of the Monroe County Land Development Regulations and Policy 101.6.1 of the
39 2010 Comprehensive Plan provides a mechanism whereby an applicant who has not received an
40 allocation award in the ROGO system may apply to the Board of County Commissioners for
41 Administrative Relief. The applicant is eligible for Administrative Relief having complied with
42 all requirements of the dwelling unit allocation system and having been considered in at least the
43 first sixteen consecutive quarterly allocation periods, and not having received an allocation
44 award. The application was timely submitted for administrative relief in the form of one (1)
45 ROGO allocation award and the applicant has not expressed a desire to sell the property to the
46 County.

3 Relief Options under Administrative Relief:

5 The remedies available to the Board of County Commissioners for Administrative Relief
6 pursuant to Section 138-27 include:

8 a. Offer to purchase the property at its fair market value as its preferred action if the
9 property is located within: a) a designated Tier I area; b) a designated Tier II area
10 (Big Pine Key and No Name Key); c) a designated Tier III-A area (Special
11 Protection Area); or d) a designated Tier III area on a non-waterfront lot suitable
12 for affordable housing.
13 b. Grant the applicant an allocation award for all or a number of dwelling units
14 requested in the next succeeding quarterly allocation period or extended pro rata
15 over several succeeding quarterly allocation periods as the preferred action for
16 buildable properties not meeting any of the criteria in(1)above.
17 c. Suggest or provide such other relief as may be necessary and appropriate.

19 In the event purchase is recommended and the owner refuses the purchase offer, the
20 applicant may remain in the ROGO System and continue earning perseverance points
21 according to Monroe County Code Section 138-28.

23 IV. RECOMMENDATION

25 It is recommended that the Board of County Commissioners find that the applicant has met the
26 criteria and qualifies for Administrative Relief. It is further recommended that a Resolution be
27 adopted that establishes this relief by an offer to purchase by the Monroe County Land
28 Authority.

OF COUNTY COMMISSIONERS APPROVING THE
REQUEST FOR ADMINISTRATIVE RELIEF MADE BY
ANGELA R.WTTTKE ON PROPERTY DESCRIBED AS
LOT 4, BLOCK 7, RAMROD SHORES MARINA SEC.,
RAMROD, RE # 00210811.009500 IN THE FORM OF A
PURCHASE OFFER FROM THE MONROE COUNTY
LAND AUTHORITY.
WHEREAS, Angela R.Wittke submitted an application for administrative relief
under Sec. 138-27 of the Monroe County Land Development Regulations; and
WHEREAS, the Board of County Commissioners continued the Administrative
Relief to the December 12, 2012 meeting at the request of the applicant; and
WHEREAS, the matter was considered at a public hearing before the Monroe
County Board of County Commissioners(BOCC); and
WHEREAS, the BOCC considered the staff report from Development
Administrator Tiffany Stankiewicz and Senior Administrator of Environmental
Resources Michael Roberts; and
WHEREAS,the public had an opportunity to speak; and
WHEREAS, the Monroe County Board of County Commissioners makes the
following findings of fact and conclusions of law:
1. The application for administrative relief from Angela R.Wittke is for Lot
4, Block 7, Ramrod Shores Marina Sec., Ramrod in Monroe County,
Florida having RE#00210811.009500.
2. The date of the ROGO application is 6/19/2007.
3. The ROGO allocation application has been in the ROGO system for at
least four (4) consecutive years and qualifies for administrative relief
under Policy 101.6.1 of the Monroe County Year 2010 Comprehensive
Plan.
4. Monroe County Code (MCC) Section 138-27 provides a mechanism
whereby an applicant who has not received an allocation award in
ROGO may apply to the Board of County Commissioners for
administrative relief.
5. The Board of County Commissioners (BOCC) has the authority to grant
administrative relief under Section 138-27(f) and may grant the
applicant a building allocation, offer to purchase the property at fair

market value, or provide such other relief as may be necessary and
appropriate.
6. The applicant applied for administrative relief on 1/9/2012, under
Section 138-27 of the MCC and Policy 101.6.1 of the 2010
Comprehensive Plan.
7. Policy 101.6.5 of the 2010 Comprehensive Plan provides criteria to be
used for determining lands that are appropriate for acquisition and the
criteria includes the environmental sensitivity of the vegetative habitat
on the lot and the applicable Tier designation.
8. The subject property has the land use district designation of Improved
Subdivision (IS), is located in the Ramrod Shores Marina Sec. and is
located in a Tier 1 designated area and is also within the Florida Forever
acquisition boundary.
9. Monroe County Code (MCC) Section 138-27(f) states the Board may
offer to purchase property at its fair market value as the preferred action
for property located within Tier 1.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY,FLORIDA:
Administrative relief is granted to Angela R.Wittke, for Lot 4, Block 7, Ramrod Shores
Marina Sec., Ramrod in the form of a purchase offer by the Monroe County Land
Authority.

Dear Ms.Wittke,
On January 18, 2012, I sent a letter regarding the incomplete Administrative Relief Application
requesting a current vegetation survey and a corrected application to be submitted by February 8,
2012. I called your previously, and have not heard from you. To date the Department has not
received a response.
In order to proceed with Administrative Relief Application, we need a current vegetation survey
(survey is dated within six months of the Administrative Relief submittal)along with a corrected
Administrative Relief Application. The application was missing the date of the most recent
ROGO Application which is June 19, 2007, a copy of the recorded deed, and the kind of
administrative relief which you are seeking. Are you seeking an allocation award for a building
permit or a purchase offer?
The documentation is to be submitted to the Monroe County Planning&Environmental Resources
Department by April 25, 2012. Failure to return a complete application shall constitute a waiver
of any rights to Administrative Relief and to used that the subject property has been taken by the
County without-Payment of just compensation as a result of the dwelling unit allocation system.
After that date, we will then process a lefimd for this incomplete Administrative Relief
Application.

Monroe County Code Section 13 -27
Requirements for Administrative Relief:
(1) If an applicant for an allocation award:
a. Whose application has been denied an allocation award for four 4) successive veazs in the
Permit Allocation Svstem,and fails to receive an allocation award,said applicant may apply to
the board for administrative relief pursuant to the terms and conditions set forth herein;and
b. Whose proposed development otherwise meets all applicable county, state, and federal
regulations;and
c. Whose allocation application has not been withdrawn;and
d. Who has complied with all requirements of the Permit Allocation System;and
e. Applicant follows procedures for administrative relief contained in the land development
regulations.
(2) An application for administrative relief shall be made on a form prescribed by the Director of
Planning and may be filed with the Director of Planning no earlier than the conclusion of the fourth
annual allocation period and no later than one hundred eichty(180)days followinc the close of the
fourth annual allocation period.
(3) Upon filing of an application for administrative relief, the Director of Planning&Environmental
Resources shall forward to the board all relevant files and records relating to the subject
applications.Failure to file an application shall constitute a waiver of any rights under this section to
assert that the subject property has been taken by the county without payment of just compensation
as a result of the dwelling unit allocation system.
(4) Upon receipt of an application for administrative relief, the board shall notice and hold a public
hearing at which time the applicant will be given an opportunity to be heard.
(5) The board may review the relevant applications and applicable evaluation ranking,taking testimony
from county staff and others as may be necessary and hear testimony and review documentary
evidence submitted by the applicant.
(6) At the conclusion of the public hearing, the board may take the following actions pursuant to
Monroe County Code Section 138-27(f) and Monroe County Comprehensive Plan Policy 101.6.1
and Policy 101.6.5:
a. Offer to purchase the property at fair market value as the Board of County Commissioners
preferred action if the property is located within:
i. a designated Tier I area;
ii. a designated Tier II area(Big Pine Key and No Name Key);
iii. a designated Tier III-A area(Special Protection Area);or
iv. a designated Tier III area on a non-waterfront lot suitable for affordable housing. "Fair
market value" shall be an amount which is no less than ad valorem valuation in the
Monroe County Real Property Tax roll for the year 1992.
b. Permit the minimum reasonable economic use of the property."Minimum reasonable economic
use" means; as applied to any residentially zoned lot of record, which was buildable
immediately prior to the effective date of the Plan,no less than a single-family residence.

e. Applicant follows procedures for administrative relief contained in the land development
regulations.
(2) An application for administrative relief shall be miade on a torn prescribed by the Diirectoir of
Planning and may be filed with the Director of Planning no earlier than the mricluseon of the fourth

(4) Upon receipt of an application for administrative relief,the board shall notice and hold a.public
hearing at which time the applicant will be gives an opportunity to be beard..
(5) The board may review the relevant applications and applicable evaluation ranking,taking testimony
from county staff and others as may be mecossary and hear tntimony and review documemary
evidence submitted by the applicant..
(6) At the conclusion of the public hearing, the board may take the frsllowing actions puvmmrtt to
ititonroe Coumy Code Section 139-27(t)and Monroe County Comprehensive Plan Policy F01.6.1
and Policy i01.6.5:
a Offer to purchase the property at fair marker value as the Bard of County Commissioners

The following report includes a site description, a list of vegetation located on site, a map
indicating the location of relevant features and all Listed species, and a mitigation plan for the
above referenced parcel.
A site visit was performed on the above referenced property on April 14,2012.
Site Description:
The property is bordered on the south and east by vacant vegetated parcels, on the west by a
single-family residence and on the north by a paved road Mariposa Drive. For purposes of this
report the front of the property is considered that which borders Mariposa Drive.
The unimproved site is densely vegetated. A portion of the parcel adjacent to the single-family
residence has been cleared and appears to be utilized by the adjacent homeowners. There are two
areas of significant garbage and yard debris dumping. Lead tree has significantly invaded this
portion of the parcel. In addition there is a considerable amount of dead vegetation onsite,
possibly due from a stressor such as storm surge. Several large dead gumbo limbos showed signs
of invasion from the gumbo limbo beetle
Pigeon plum is one of the most predominant native species on site. In addition mature native
species including poisonwood,willow bustic,blolly and long-stalked stopper are located onsite.
The most notable feature on site is a portion of a solution hole which straddles the eastern
property line and is shown on the attached map. No water was located in the solution at the time
of the site visit. The site visit did occur during the dry season.
Species of Note:
There are no invasive exotic species regulated by Monroe County on site. However, there is a
significant amount of Lead Tree onsite. Although its removal is not required, it is a highly
invasive species and its removal is recommended.
There are eleven (11) Listed species on site. A species is considered Listed if it is designated
Endangered(E), Threatened (T), Regionally Important(RI), or Commercially Exploited (CE), or
if it is a Native species greater than 4" diameter at breast height (N>4"dbh). All listed species
require mitigation if impacted by development and all have been tagged on site with pink tape.
Current Monroe County Code requires monetary mitigation for all impacted species. The
mitigation amount is calculated by Monroe County depending on the species and its size.
All protected species are shown on the attached map. Ail species impacted by the proposed
development (construction footprint & five foot construction buffer) are noted on the map.
Please note that locations are approximate due to the density of the vegetation and the limitation
of the measuring device used(measuring tape).
Appropriate permits must be obtained from Monroe County prior to removal of any vegetation.
Please consult the Monroe County Biologist for specific requirements.
