ITEM BACKGROUND: The BOCC at its March 2008 meeting gave permission to advertise a public
hearing for the purpose of considering an Initial Assessment Resolution to institute and collect a non-ad
valorem assessment for the funding and purchase of flIe protection equipment, programs and personnel
in Monroe County. The non-ad valorem assessment is necessary in order to fund incremental
equipment, programs, service and personnel.

STAFF RECOMMENDATIONS: Staff is recommending approval of a conservative Year 1 Initial

RELATING TO THE PROVISION OF FIRE PROTECTION
SERVICE TO PROPERTIES; DESCRlBING THE SYSTEM
DEVELOPMENT FEE, COLLECTION COSTS AND THE
OTHER TERMS AND CONDITIONS OF THE NON-AD
VALOREM ANNUAL FIRE PROTECTION ASSESSMENTS;
ESTABLISHING THE AMOUNT AND TERM OF THE
ANNUAL FIRE PROTECTION ASSESSMENT FOR EACH
PARCEL OF PROPERTY TO BE ASSESSED; DIRECTING
PREPARATION OF THE INITIAL NON-AD VALOREM

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, AS FOLLOWS:

Section 1. Authority. This resolution is adopted pursuant to the provisions of
Ordinance - 2b08 (the "Ordinance"), sections 125.01 and 125.66, Florida Statutes,
and other applicable provisions oflaw.
Section 2. Purpose and Definitions. This resolution constitutes the Initial
Assessment Resolution as defined in the Ordinance. All capitalized words and terms not
otherwise defined herein shall have the meanings set forth in the Ordinance. Unless the
context indicates otherwise, words imparting the singular nature include the plural, and vice
versa. As used in this resolution, the following terms shall have the following meanings,
unless the context hereof otherwise requires.
"Annual Rate Resolution" means a resolution adopted by the Board of County
Commissioners each Fiscal Year to set the Assessed Rate.
"Assessed Properties" means the properties contained within the Benefit Area.
"Benefit Area" means the area shown in Appendix A hereto.
"Board" means the Board of County Commissioners of Monroe County, Florida.
"Building" means any structure, whether temporary or permanent, built for support,
shelter or enclosure of persons, chattel or property of any kind, including mobile homes.
"Building Area" means the adjusted area of a Building expressed in square feet and
reflected on the Tax Roll, or, in the event such information is not reflected or determined
not to be reflected accurately on the Tax Roll, the area determined by the County.
"Code Descriptions" means the descriptions listed on the Improvement Codes.
"Commercial Property" means those Tax Parcels with a Code Description

designated as Commercial in the Fixed Property Use Codes.
"Cost Apporti'onment" means the apportionment of Fire Protection Assessed Cost
among all Property Use categories according to the Demand Percentages established using
the apportionment methodology described in Section 7 and Appendix F of this Initial
Assessment Resolution.
"County" means Monroe County, a political subdivision of the State of Florida.
"County Administrator" means the chief administrative officer of the County,
designated by the Board to be responsible for coordinating the Fire Protection Assessments,
or such person's designee.
"Demand Percentage" means the percentage of demand for fire protection
services, facilities, or programs attributable to each Property Use category determined by
analyzing the historical demand for fire protection services as reflected in the Monroe
County Fire protection Incident Reports under the methodology described in Section 7 of
this Initial Assessment Resolution.
"DOR Code" means a Property Use Code generated by the Florida Department of
Revenue as established in Rule 12D-8.008, Florida Administrative Code, assigned by the
Property Appraiser to Tax Parcels within the County, as specified in Appendix D hereto.
"Dwelling Unit" means (a) a Building, or a portion thereof, to be used for
residential purposes, consisting of one or more rooms arranged, designed, used or intended
to be used as living quarters for one family entity, or (b) the use of land in which lots or
space are offered for rent or lease for the placement of mobile homes.
"Emergency Medical Services Cost" means the amount determined by the Board

to be associated with or attributable to the provision of Emergency Medical Services.

"Estimated Fire Protection Assessment Rate Schedule" means the rate schedule
attached hereto as Appendix E and incorporated herein by reference, specifying the Fire
Protection Assessed Costs and the estimated Fire Protection Assessments determined in
Section 10 of this Initial Assessment Resolution.
"Final Assessment Resolution" means the resolution described in Section 2.06 of
the Ordinance, which shall confirm, modify or repeal this Resolution.
"Fire Protection Assessed Costs" means the costs of fire protection services to be
funded through special assessments as adopted by this Initial Assessment Resolution, as
qualified by the following:
(I) In the event the County also imposes an impact fee upon that part of new
growth or development for fire protection service-related capital
improvements paid by impact fees, the Fire Protection Assessed Cost
shall not include that portion of such costs attributable to capital
improvements necessitated by new growth or development that will be
paid by those impact fees; and
(2) In no event shall the Fire Protection Assessed Cost include any amount
attributable to the Emergency Medical Services Cost.
"Fire Protection Incident Reports" means those incident reports generated by
Monroe County Fire protection minus information regarding Emergency Medical Services,
or an individual reports that documents a Monroe County Fire protection response, the type
of situation found, and the incident address.

"Fiscal Year" means the period commencing on October I of each year and

continuing through the next succeeding September 30, or such other period as may be
prescribed by law as the fiscal year for the County, which shall be the final proceeding for
the initial imposition of the annual fire protection assessment.
"Fixed Property Use Codes" means Florida Fire Incident Report System property
use codes shown on Exhibit B.
"Hotel and Motel Property" means those Tax Parcels with a Code Description
designed as "Hotel/Motel" in the Improvement Codes.
"lndustriaIIW arehouse Property" means those Tax Parcels designated as
"Industrial/Warehouse" in the Fixed Property Use Codes.
"Initial Assessment Resolution" means this document, which shall be the initial
proceeding for identification of Collection Costs and for imposition of an Annual Fire
Protection Assessment.
"Institutional Property" means those Tax Parcels designated with a Code
Description of "Institutional" in the Property Use Codes.
"Mixed Use Property" means a Tax Parcel that contains Buildings whose use
descriptions are capable of assignment under a Code Description in the Property Use Codes
in more than one Property Use Category.
"Non-Ad Valorem Assessment Roll" means a non-ad valorem assessment roll, as
defined in Section 197.3632(1)(e), Florida Statutes, approved by a Final Assessment
Resolution pursuant to Sections 10-12 of this document or an annual rate resolution
pursuant to Section 10-12 of this document.

"Non-Residential Property" means collectively, those Tax Parcels with Code
.
Descriptions designated as "Commercial," "Institutional," "Industrial/Warehouse", and
"Transient Occupancy Property" in the Property Use Codes.
"Ordinance" means Ordinance No. -2008.
"Parcel Apportionment" means the apportionment of Fire protection Assessed
Costs to each Property Use Category by Cost Apportionment among the Tax Parcels using
the methodology described in Section 8 and Appendix F of this Initial Assessment
Resolution.
"Property Appraiser" means the Monroe County Property Appraiser.
"Recreational Vehicle Park"
means a place (a) set aside and offered by a person for remuneration for parking,
accommodation, or rental of five or more recreational vehicles or tents and (b) licensed by
the Department of Health of the State of Florida under Chapter 513, Florida Statutes, as
may be amended from time to time.
"Residential Property" means those Tax Parcels with a Code Description
designated as Residential in the Property Use Codes.
"Tax Collector" means the Monroe County Tax Collector.
"Tax Parcel" means a parcel of property located within the County to which the
Property Appraiser has assigned a distinct ad valorem property tax identification number.
"Tax Roll" means the real property ad valorem tax assessment roll described in
Section 193.114(2), Florida Statutes.

"Transient Occupancy Property" means those Tax Parcels that meet the definition
.
of Hotel and Motel Property and Recreational Vehicle Park.
"Uniform Assessment Collection Act" means Sections 197.3632 and 197.3635,
Florida Statutes, or any successor statutes authorizing the collection of non-ad valorem
assessments on the same bill as ad valorem taxes, and any applicable regulations
promulgated thereunder.
"Unit" means (a) the use of land in which lots or spaces are offered for rent or lease
for the place of recreational vehicles within a Recreational Vehicle Park, or (b) the use of
land whereby an individual room within a Hotel and Motel is offered for rent or lease for
temporary occupancy.
Section 3. Provision and Funding of Fire Services.
(A) Upon the imposition of a Fire Protection Assessment for fire protection
services, facilities, or programs against the Assessed Property located within the area of the
County described in Appendix A hereto, the County shall provide fire protection services to
said Assessed Property. All or a portion of the cost to provide the fire protection services,
facilities, or programs shall be funded from the proceeds of the Fire protection Assessments.
The remaining cost, if any, required to provide fire protection services, facilities, and
programs shall be funded by available revenues from sources other than the Fire Protection
Assessments.
(B) It is hereby ascertained, determined, and declared that each parcel of Assessed
Property located within the Benefit Area will be benefitted by the County's provision of fire

protection services, facilities, and programs in an amount not less than the Fire Protection
.
Services Assessment imposed against such parcel computed in the manner set forth herein.
Section 4. Imposition and Computation of Fire Protection Assessments. Fire
Protection Assessments shall be imposed against all Tax Parcels within the Property Use
Categories within Benefit Area. Fire Protection Assessments shall be computed in the
manner set forth in this Initial Assessment Resolution.
Section 5. Legislative Determinations of Special Benefit and Fair
Apportionment. It is hereby ascertained and declared that the Fire protection Assessed
Costs provide a special benefit to the Assessed Property within the Benefit Area based
upon the legislative determinations set forth below, and based upon the report entitled
"Monroe County, Florida/Fire Assessment Memorandum": presented by Government
Services Group, Inc. in February 2008 and other information presented by the Government
Services Group, Inc. at the March 5, 2008 workshop of the Board, all of which are
incorporated herein by reference.
A. General
(I) Article VIII, Section I of the Florida Constitution, and Sections 125.01 and
125.66, Florida Statutes, grant to a board of county commissioners all powers of local self-
government to perform county functions and to render services for county purposes in a
manner not inconsistent with general law, or with special law approved by vote of the
electors, and such power may be exercised by the enactment of county ordinances.
(2) Upon the adoption of this Initial Assessment Resolution determining the Fire
Protection Assessed Cost and identifying the Assessed Property to be included in the

Assessment Roll, the legislative findings ascertained and declared in Sections 1.03 and
1.04 ofthe Ordinance 'are hereby ratified and confinued.
(3) It is hereby ascertained and declared that the fire protection services,
facilities, and programs provide a special benefit to property because fire protection
services possess a logical relationship to the use and enjoyment of property by
(a) protecting and safeguarding the value and integrity of improvements and structures and
the real property on which they are located through the delivery of comprehensive fire
protection services; (b) protecting and safeguarding the life and safety of intended
occupants in the use and enjoyment ofland; (c) lowering the cost of fire insurance by the
presence of a fire protection services program within the County; and (d) containing fire
incidents that would otherwise have the potential to spread and endanger property and
property features as well as human lives.
(4) It is fair and reasonable to use the Situation Found Codes and the Property
Use Codes from the Florida Fire Incident Report System and the DOR Codes from the
Florida Department of Revenue for Cost Apportionment and Parcel Apportionment
because (a) this information is the most comprehensive, accurate, reliable, and centralized
database of information readily available to determine the property use, Building Area for
improvements, and acreage for Land within the County; and (b) the information has been
cross-checked against property appraiser information and is thus consistent with the parcel
designations on the Tax Roll, which compatibility permits the development of an
Assessment Roll in conformity with the requirements of Chapter 197, Florida Statutes, and
the Uniform Method of Collection.

(5) The data available in the Property Use Codes is more useful and accurate in
.
determining Building Area than relying exclusively on the data maintained in the DOR
codes alone because the data maintained in the Property Use Codes reveals the existence of
a Building with a different use than the ones described in the DOR Codes.
B. Cost Apportionment
(I) It is appropriate and consistent with the decision of the Florida Supreme
Court in the case of City of North Lauderdale v. SMM Properties, Inc., 825 So.2d 343 (Fla.
2002) to exclude from the Fire Protection Assessed Costs any amounts to determined to
constitute Emergency Medical Services Costs.
(2) Apportioning the Fire Protection Assessed Costs among classifications of
property based on historical demand for fire protection services, but not Emergency
Medical Services, is fair, reasonable, and proportional to the special benefit received.
(3) The Monroe County Fire Incident Reports are the most reliable data available
to understand the current and projected demand for fire protection services from property
use and to determine the benefit to property resulting from the availability of fire protection
services, in order to protect and serve Buildings located within Assessed Property and its
intended occupants. The Fire Incident Reports are sufficiently numerous such that they
document the historical demand for fire protection services by Property Use Categories.
The Demand Percentage derived for each Property Use Category through examination and
analysis of Fire Protection Incident Reports is consistent with the experience of the County.
Therefore, the use of the Demand Percentage is a fair and reasonable method of
apportioning Fire Protection Assessed Costs among the Property Use Categories.

(4) The historical demand for fire protection service availability for multi-family
.
and single family Residential Property is substantially similar and any difference in the
percentage of calls to these two properties is statistically insignificant.
(5) The level of service required to meet anticipated demand for fire protection
services and corresponding annual fire budget required to fund fire protection services
provided to non-specific property uses would be required notwithstanding the occurrence
of any incidents from non-specific property uses. Therefore, it is fair and reasonable to
omit from the Demand Percentage calculation the Monroe County Fire Protection Incident
Reports document fire protection services provided to non-specific property uses.
(6) It is appropriate to exclude vacant land from the assessments at this time,
because the suppression of fires on vacant land and agricultural property primarily benefits
adjacent property by containing the spread of fire, rather than preserving the integrity of the
vacant parcel. The 39 calls to these two property use categories within the sampling period
were removed.
(7) The County provided information in an electronic format, identifying the
number and type of fire rescue incident responses by County fire rescue vehicles for
calendar year 2006. The County uses the Florida Fire Incident Reporting System (FFIRS)
to record its fire rescue incidents. The FFIRS is a tool for fire rescue departments to report
and maintain computerized records of fire rescue incidents and other department activities
in a uniform manner. Appendix A provides a codes list for the "type of situation found" as
recorded on the fire rescue incident reports used to identify EMS and non-EMS calls. Fixed
property use codes shown on Appendix B identify the type of property that fire rescue

departments respond to for each fire rescue incident. The fixed propelty uses correlate to
.
property uses determined by the Monroe County Property Appraiser on the ad valorem tax
roll. Appendix B provides a codes list for the "fixed property use" as recorded on the fire
rescue incident reports. Data from calendar year 2006 fire rescue incident data from the
FFIRS files was used to evaluate trends and determine if aberrations were present. County
fire rescue incident data for the stated time period represents 3,514 fire rescue incidents.
Using the fixed property use codes, the fire type incidents corresponding to specific
properties were assigned to the following property use categories: residential, commercial,
industrial/warehouse, and institutional. Incidents to government properties, religious
buildings, institutional parcels, and educational properties were aggregated into an
"institutional" category and incidents to RV parks were aggregated into the "commercial"
category.
(8) It is appropriate to exclude governmental and institutional tax-exempt
properties from assessments within Monroe County for several reasons. First, the majority
of' governmental properties are located within land located outside the Benefit Area, in
incorporated sections of Monroe County. In addition, historical data at this time supports
the conclusion that more fire protection resources are expended on the attack of a building
rather on the defense of vacant land. Funds raised through this non-ad valorem assessment
will not be used on the governmental or institutional tax-exempt property. Rather, the
County will fund its fire services for these parcels from the ad valorem fund within the
general budget.

C. Residential Parcel Apportionment
.
(I) Neither the size nor the value of the Residential Property determines the
scope of the required fire protection response. The potential demand for fire protection
services is driven by the existence of the Dwelling Unit and the anticipated average
occupant population.
(2) Apportioning the Fire Protection Assessed Costs for fire protection services
attributable to Residential Property on a per Equivalent Dwelling Unit basis is therefore a
fair and reasonable method of Parcel Apportionment based upon historical call data.
D. Non-Residential Parcel Apportionment
(1) The use of actual square footage to calculate apportionment of assessments
for Non-Residential Property Buildings is fair and reasonable for the purposes of Parcel
Apportionment because the demand for Fire Protection Services can be determined and
measured by and is correlated to the actual square footage of structures and improvements
on the benefited parcels.
(2) In accordance with Section 125.0168, Florida Statutes, which mandates that
the County treat Recreational Vehicle Property as a commercial entity in the same manner
as a hotel, motel, or other similar facility for purposes of non-ad valorem special
assessments levied by the County, including this Fire Protection Services Assessment, it is
fair and reasonable to treat each space within a Recreational Vehicle Park and each room in
a Hotel/Motel property as a Unit because the potential demand for fire protection services
is driven by the existence of each Unit and the anticipated average occupant population.

Section 6. Cost Apportionment Methodology.
(1) Utilizxing date from Fire Rescue Incident Reports regarding the type of calls
and physical location of each call, the County assigned Fixed Property Use categories to the
fire rescue incidents.
(2) Based on the assignment of fire rescue incidents to property use categories,
the number of Incident Report filed within a sampling period was determined for each
Property Use Category.
(3) A Demand Percentage for each Property Use Category was then determined
by dividing the number of fire Incident Reports for any given Property User Category by
the total number of fire Incident Reports for all Property Use Categories within the
sampling period. The Demand Percentage for each Property Use Category was then applied
to the Fire Protection Assessed Cost and the resulting number is the product, or the
allocation of that portion of the Fire Protection Assessed Cost allocated to each individual
Property Use Category. Assessable costs calculated in this manner were then apportioned
aII)on property use categories based upon historical demand for fire services reflected by
fire incident data. The share of assessable costs apportioned to each property use category
was further apportioned among individual buildings of property within each Property Use
Category.
(4) Further details are shown in Appendix F, and the methodology is hereby
approved, adopted, and incorporated into this Initial Assessment Resolution by reference.
Section 7. Parcel Apportionment Methodology.
(1) The apportionment among the Tax Parcels of that portion of the Fire

Protection Assessed Costs apportioned to each Property Use Category under the Cost
.
Apportionment shall be consistent with the Parcel Apportionment methodology described
and determined in Appendix F hereto, which methodology is hereby approved, adopted, and
incorporated into this Initial Assessment Resolution by reference.
(2) It is hereby acknowledged that the Parcel Apportionment methodology
described in Appendix F is to be applied in the calculation of estimated Fire Protection
Services Assessment rates established in Section 8 of this Initial Assessment Resolution.
Section 8. Determination of Fire Protection Assessed Costs; Establishment of
Initial Fire Protection Assessments; Collection Method; Application of Assessment
Proceeds.
(1) The Fire Protection Assessed Costs to be assessed and apportioned among
benefitted parcels pursuant to Cost Apportionment and Parcel Apportionment for the Fiscal
Year commencing October 1, 2008 is the amount determined n the Estimated Fire
Protection Assessment Rate Schedule. The approval of the Estimated Fire Protection
Assessment Rate Schedule by the adoption of this Initial Assessment Resolution determines
the amount of the Fire Protection Services Assessed Costs. The remainder of such Fiscal
Year budget, if any, for fire protection facilities, programs, and services shall be funded
from legally available County revenue sources other than the Fire Protection Assessment
proceeds.
(2) The estimated Fire Protection Assessments specified in the Estimated Fire
Protection Assessment Rate Schedule are hereby established to fund the specified Fire
protection Services Assessed Costs determined to be assessed in Fiscal Year commencing

(3) The estimated Fire Protection Service Assessments specified in this Initial
Assessment Resolution shall be the estimated assessment rates applied by the County
Administrator in the preparation of the preliminary Assessment Roll for the Fiscal Year
commencing October 1, 2008, as provided in Section 9 below.
(4) Funds raised through the Fire Protection Servie Assessments will be collected
using the Uniform Assessment Collection Act, Sections 197.3632 and 197.3635, Florida
Statutes, or any successor statutes authorizing the collection of non-ad valorem assessments
on the same bill as ad valorem taxes, and any applicable regulations promulgated
thereunder.
(5) Proceeds derived by the County for the Fire Protection Assessments will be
used exclusively for the provision of fire protection services, facilities, and programs within
the proposed Benefit Area. In the event there is any fund balance remaining at the end of
the Fiscal Year in which the assessments are collected, such balance shall be carried
fotward and used only to fund fire protection services, facilities, and programs within the
Benefit Area.
Section 9. Assessment Roll.
(A) The County Administrator is hereby directed to prepare, or cause to be
prepared, the preliminary Non-Ad Valorem Assessment Roll for the Fiscal Year
commencing October 1, 2008 in the manner provided in the Ordinance. The Non-Ad
Valorem Assessment Roll shall include all of the Tax Parcels within the Property Use

Categories within the geographic unincorporated area of the County covered by this
resolution, and shall apportion the estimated Fire Protection Services Assessed Cost to be
recovered through Fire Protection Service Assessment in the manner set forth in this Initial
Assessment Resolution.
(B) A copy of this Initial Assessment Resolution, supporting documentation
relative to the estimated amount of Fire Protection Services Assessed Cost to be recovered
through the imposition of the assessments, and the preliminary Non-Ad Valorem
Assessment Roll shall be maintained by the County Administrator and open to public
inspection. The foregoing shall not be construed to require that the preliminary Non-Ad
Valorem Assessment Roll be in printed form if the amount of the Fire Protection Services
Assessment for each Tax Parcel can be determined by use of a computer terminal available
to the public.
(C) It is hereby determined, ascertained and declared that the method of
determining the Fire Protection Assessment as set forth in this Initial Assessment
Resolution is a fair and reasonable method of apportioning the Assessed Cost among
parcels of Assessed Property within the County.
Section 10. Authorization of Public Hearing. A public hearing shall be
conducted by the Board at 5:01 p.m., or as soon thereafter as the matter can be heard, on
June 18, 2008, at the Marathon Government Center, 2798 Overseas Highway, Marathon,
Florida (Mile Marker 50), at which time the Board will receive and consider any comments
on the Fire Protection Services Assessment from the public and affected property owners
and will consider imposing the Fire Protection Service Assessments and collecting the

assessments on the same bill as ad valorem taxes.
Section 11. .
Notice by Publication. Upon completion of the Non-Ad Valorem
Assessment Roll, the County Administrator shall publish or cause to be published a notice
of the public hearing authorized by Section 10 above in the manner and the time provided in
Section 2.05 of the Ordinance. Such notice shall be in substantially the form attached hereto
as Appendix G. Said notices must be sent out no later than May 28, 2008.
Section 12. Notice by Mailing. In addition to the notice provided in accordance
with Section 11, above, at least 20 days prior to the public hearing, the County
Administrator shall mail or cause to be mailed a notice of the public hearing to each person
owning property subject to the assessment. Said notice shall be mailed by first-class mail
by no later than May 28, 2008; shall include all of the information required by Section
197.3632(4)(b), Florida Statutes; and shall be substantially in the form attached hereto as
Appendix H.
Section 13. Hardship Exemption.
(A) To qualify for a hardship exemption, the owner of Residential Property shall
meet the following criteria:
1. The Owner shall occupy the Residential Property and be entitled to a
homestead exemption pursuant to Chapter 196, Florida Statutes;
2. For the continuous 12 months immediately prior to the date on which
an application for homestead exemption is filed, the Owner and all other occupants
of the Residential Property must meet eligibility requirements for the Florida Work

and Gain Economic Self-Sufficiency (WAGES) program and the Owner must be an

eligible participant in the WAGES program; the Owner must be a recipient of food
stamps or Supplemental Security Income; or the Owner must be certified for any
service offered by the Monroe County Department of Social Services as of the date
of the application; and
3. The Owner shall have the present intent to maintain the Residential
Property as his/her permanent place of residence within the entire fiscal year for
which the Fire Protection Services Assessment is to be imposed.
(B) On an annual basis, by no later than September I of the year preceding the
start of the fiscal year in which the assessment is to be imposed, the Owner seeking the
hardship exemption shall file an application with the Monroe County Department of Social
Services to obtain a hardship exemption. Such an application shall contain the following
information:
1. Name and address of the Owner;
2. Address and legal description of the Residential Property for which the
hardship exemption is sought;
3. Names and ages of all occupants of the property;
4. Certification from the Florida Department of Children and Family
Services or other such satisfactory proof that the Owner is an eligible participant of
the WAGES program, or a recipient of food stamps or SSI, or must be certified to
receive services from the Monroe County Department of Social Services; and

5. A statement by the Owner agreeing to notify the County immediately if
.
the property is sold or conveyed or if the Owner vacates the Property.
(C) On an annual basis, by no later than September I of the year preceding the
start of the fiscal year in which the assessment is to be imposed, the Owner seeking the
hardship exemption shall file an application with the Monroe County Department of Social
Services to obtain a hardship exemption. Such an application shall contain the following
information: Name and address of Owner; address and legal description of Property for
which hardship exemption is sought; names of all occupants of Property; certification from
Florida Department of Children and Family Services indicating that the applicant is a
participant in the WAGES program, a recipient of food stamps or Supplemental Social
Security within the past 12 months; and an agreement by the Owner to immediately notify
the County if said property is conveyed.
(D) The Director of the Community Service Division shall render his/her decision
as to eligibility of the Owner for a hardship exemption in writing, with copies to the County
Administrator and the Tax Collector. If the Owner qualifies for the hardship exemption, the
exemption shall be granted and payment of the Owner's Fire Protection Services
Assessment shall be made from funds appropriated by the Board for that purpose. The
Owner may request review of a denial of a request for a hardship exemption by filing a
petition in writing with the County Administrator within 30 days of notification of the
denial. The County Administrator shall review the denial within 30 days of the filing of the
request for review, and issue a decision in writing. If the County Administrator upholds the
denial, the owner shall have a further right of review by the Board. An owner shall file a

request for review by the Board with the County Administrator within 30 days of the

notification of the County Administrator's decision. The Board shall review the matter
within 90 days of the filing of the request for review. Failure to file the petition in
accordance with the time limits set forth above shall be deemed a waiver of any right of
revIew.
(E) The hardship exemption shall be for one fiscal year only and the Owner shall
be required to file a new application to obtain a hardship exemption for each subsequent
fiscal year.
(F) An interim Fire Protection Services Assessment shall be imposed against
Residential Property that has received a hardship exemption in the event the Owner sells or
conveys the Property in the year in which the hardship exemption was granted. The interim
assessment will be prorated, calculated on a monthly rate which is l/lzth of the Fire
Protection Services Assessment imposed during that Fiscal Year. Each interim Fire
Protection Services Assessment shall be deemed delinquent on the last day of the second
full month subsequent to the month in which the property was sold or conveyed, or the last
day of the Fiscal Year, whichever occurs first, and shall constitute a lien on the Property.
The lien shall be equal in rank and dignity to the liens of any and all state, county, district or
municipal taxes and special assessments, and superior in rank and dignity to any other liens,
encumbrances, titles in and claims to the affected real property.
(G) The County Administrator shall administer or provide for the collection of all
interim Fire protection assessment.
Section 14. Effective Date. This Initial Assessment Resolution shall take effect

P'ARCEL APPORTIONMENT METHODOLOGY
The Cost Apportionment to each Property Use Category shall be apportioned among the Tax
Parcels within each Property Use Category as follows:
Section F-1. Residential Property. The Fire Protection Services Assessment for each
Tax Parcel of Residential Property shall be computed by multiplying the Demand Percentage
attributable to Residential Property by the Fire Protection Service Assessed Costs, dividing such
product by the total number of dwelling units shown on the Tax Roll for the County and then
multiplying the quotient by the number of Dwelling Units located on such Tax Parcel.
Section F-2. Non-Residential Property. The Fire Protection Services Assessment for
each Building of Non-Residential Property, with the exception of recreational vehicle park spaces
which are computed at 191 sq. feet, shall be computed as follows:
(A) Respectively, multiply the Demand Percentage attributable to each
category of Non-Residential Property by the Fire Protection Service
Assessed Costs. The resulting dollar amount reflects the portions of the
County's fire protection budget to be funded from assessment revenue
from each of the non-residential Property Use Categories.
(B) Separate each Building of Non-Residential Property into the appropriate
non-residential Property Use Category for that Building.
(C) For each non-residential Property Use Category, add the Building Area
square footage of all Buildings in each non-residential Property Use
Category. This sum reflects the aggregate square footage for each

Non-Residential Property Use Category.
(D) . Divide the product of subsection (A) by the sum of the square foot
allocations for each Non-Residential Property Use Category in
subsection (C) ofthis section. The resulting quotient is equal to a dollar
amount per square foot of improved area ("the square foot rate") to be
used in computing Fire Protection Service Assessments for Non-
Residential Property Use Categories.
(E) For each such category, multiply the applicable square foot calculated
under subsection (D) above by the number of square feet for each
Building in the Non-Residential Property Use Category. The resulting
number is equal to the amount of Fire protection Assessments to be
imposed on each Building of Non-Residential Property.
Section F-3. Mixed Use. The Fire Protection Services Assessment for each Tax Parcel of
mixed use (two or more categories) of property shall be the sum of the Fire Protection Service
Assessment computed for each Property Use Category.

NOTICE OF HEARING TO IMPOSE AND PROVIDE FOR COLLECTION OF FIRE
PROTECTION SERVICES SPECIAL ASSESSMENTS
Notice if hereby given that the Board of County Commissioners of Monroe County, Florida, will
conduct a public hearing to consider the imposition of an annual fire protection service special
assessment for the funding of fire protection services, facilities, and programs within the
unincorporated areas of Monroe County less certain areas as shown in the chart below.
The hearing will be held at 5:01 p.m. or as soon thereafter as may be heard on June 18,2008 at the
Marathon Government Center, 2798 Overseas Highway, Marathon, Florida (Mile Marker 50), for
the purpose of receiving public comment on the proposed assessments. All affected property
owners have the right to appear at the hearing and to file written objections with the County
Administrator within 20 days of this notice. If any person decides to appeal a decision made by the
County Commission with respect to any matter considered at the hearing, such person will need a
record of the proceedings and may need to ensure that a verbatim record of the proceeding is made,
including the testimony and evidence upon which the appeal is to be based. In accordance with the
Americans with Disabilities Act, persons needing accommodation or an interpreter to participate in

hereby given to you by the Board of County Commissioners of Monroe County, Florida, that an
annual assessment for fire protection services using the tax bill collection method may be levied on
your property for fiscal year October 1, 2008 - September 30, 2009.
The purpose of this assessment is to fund fire protection equipment, facilities and programs
benefiting property located within the unincorporated area of Monroe County. The total annual
Fire Protection Assessment revenue to be collected via this method is estimated to be $1,764,186.
The annual fire protection assessment is based on the classification of each parcel of property and
the number ofbiIling units contained therein.

A public hearing to discuss the assessment will be held at 5:00 p.m. on June 18, 2008, at the
Marathon Government Center, 2798 Overseas Highway, Marathon Florida (MM 50). You and all
other affected property owners have a right to appear at the hearing and to file written objections
with the County Administrator within 20 days of this notice. Unless proper steps are initiated in a
court of competent jurisdiction to secure relief within a period of 20 days from the date of the
County Commission action at the above hearing, including the method of apportionment, rate of
assessment and the imposition of assessments, the action shall be the final adjudication of the issues
presented.
If any person decides to appeal a decision made by the County Commission with respect to any

matter considered at the hearing, such person will need a record ofthe proceedings and may need to
ensure that a verbatim record of the proceeding is made, including the testimony and evidence upon
which the appeal is to be based. In accordance with the Americans with Disabilities Act, persons

Both the non-ad valorem assessment amount and ad valorem taxes for this property will be
collected on the same tax bill mailed in November 2008. Failure to pay the assessments will cause
a tax certificate to be issued against the property and could result in loss oftitle.

ITEM BACKGROUND: The BOCC at its March 2008 meeting gave permission to advertise a public
heating for the purpose of considering an Initial Assessment Resolution to institute and collect a non-ad
valorem assessment for the funding and purchase of fire protection equipment, programs and personnel
in Monroe County. The non-ad valorem assessment is necessary in order to fund incremental
equipment, programs, service and personnel.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, AS FOLLOWS:

Section 1. Authority. This resolution is adopted pursuant to the provisions of

Ordinance - 2008 (the "Ordinance"), sections 125.01 and 125.66, Florida Statutes,
and other applicable provisions of law.
Section 2. Purpose and Definitions. This resolution constitutes the Initial
Assessment Resolution as defined in the Ordinance. All capitalized words and terms not
otherwise defined herein shall have the meanings set forth in the Ordinance. Unless the
context indicates otherwise, words imparting the singular nature include the plural, and vice
versa. As used in this resolution, the following terms shall have the following meanings,
unless the context hereof otherwise requires.
"Board" means the Board of County Commissioners of Monroe County, Florida.
"Building" means any stmcture, whether temporary or permanent, built for suppOli,
shelter or enclosure of persons, chattel or propeliy of any kind, including mobile homes.
"Building Area" means the adjusted area of a Building expressed in square feet and
reflected on the Tax Roll, or, in the event such information is not reflected or detelnllned
not to be reflected accurately on the Tax Roll, the area determined by the County.
"Code Descriptions" means the descriptions listed on the Improvement Codes.
"Commercial Property" means those Tax Parcels with a Code Description -
designated as Commercial in the Fixed Property Use Codes.
"Cost Apportionment" means the appOliionment of Fire Protection Assessed Cost
among all Property Use categories according to the Demand Percentages established using
the apportionment methodology described in Section 7 and Appendix F of this Initial

Assessment Resolution.

"County" means Monroe County, a political subdivision of the State of Florida.
"County Administrator" means the chief administrative officer of the County,
designated by the Board to be responsible for coordinating the Fire Protection Assessments,
or such person's designee.
"Demand Percentage" means the percentage of demand for fire protection
services, facilities, or programs attributable to each Property Use category determined by
analyzing the historical demand for fire protection services as reflected in the Monroe
County Fire Rescue Incident Reports under the methodology described in Section 7 of this
Initial Assessment Resolution.
"DOR Code" means a Propelty Use Code as established in Rule l2D-8.008,
Florida Administrative Code, assigned by the Property Appraiser to Tax Parcels within the
County, as specified in Appendix D hereto.
"Dwelling Unit" means (a) a Building, or a portion thereof, to be used for
residential purposes, consisting of one or more rooms ananged, designed, used or intended
to be used as living quarters for one family entity, or (b) the use of land in which lots or
space are offered for rent or lease for the placement of mobile homes.

"Emergency Medical Services Cost" means the amount determined by the Board
to be associated with or attributable to the provision of Emergency Medical Services.
"Estimated Fire Protection Assessment Rate Schedule" means the rate schedule
attached hereto as Appendix E and incorporated herein by reference, specifying the Fire
Protection Assessed Costs and the estimated Fire Protection Assessments determined in

Section 10 of this Initial Assessment Resolution.

"Final Assessment Resolution" means the resolution described in Section 2.06 of
the Ordinance, which shall confirm, modify or repeal this Resolution.
"Fire Protection Assessed Costs" means the costs of fire protection services to be
funded through special assessments as adopted by this Initial Assessment Resolution, as
qualified by the following:
(1) In the event the County also imposes an impact fee upon that part of new
growth or development for fire protection service-related capital
improvements paid by impact fees, the Fire Protection Assessed Cost
shall not include that portion of such costs attributable to capital
improvements necessitated by new growth or development that will be
paid by those impact fees; and
(2) In no event shall the Fire Protection Assessed Cost include any amount
attributable to the Emergency Medical Services Cost.
"Fire Rescue Incident Reports" means those incident reports generated by Monroe
County Fire Rescue minus information regarding Emergency Medical Services, or an
individual reports that documents a Monroe County Fire Rescue response, the type of

situation found, and the incident address.
"Fiscal Year" means the period commencing on October I of each year and
continuing through the next succeeding September 30, or such other period as may be
prescribed by law as the fiscal year for the County, which shall be the final proceeding for
the initial imposition of the annual fire protection assessment.

"Fixed Property Use Codes" means "Hotel and Motel Property" means those
"
Tax Parcels with a Code Description designed as "Hotel/Motel" in the Improvement
Codes.
"lndustrial/Warehouse Property" means those Tax Parcels designated as
"Industrial/Warehouse" in the Fixed Property Use Codes.
"Initial Assessment Resolution" means this document, which shall be the initial
proceeding for identification of Collection Costs and for imposition of an Annual Fire
Protection Assessment.
"Institutional Property" means those Tax Parcels designated with a Code
Description of "Institutional" in the Property Use Codes.
"Mixed Use Property" means a Tax Parcel that contains Buildings whose use
descriptions are capable of assignment under a Code Description in the Property Use Codes
in more than one Property Use Category.
"Non-Ad Valorem Assessment Roll" means a non-ad valorem assessment roll, as
defined in Section 197.3632(1)(e), Florida Statutes, approved by a Final Assessment
Resolution pursuant to Section 2.06 of this document or an annual rate resolution pursuant
to Section 2.08 of this document.

"Non-Residential Property" means collectively, those Tax Parcels with Code
Descriptions designated as "Commercial," "Institutional," "Industrial/Warehouse", and
"Transient Occupancy Property" in the Property Use Codes.
"Ordinance" means Ordinance No. -2008.

"Parcel Apportionment" means the appOltionment of Fire Rescue Assessed Costs

to each Property Use Category by Cost Apportionment among the Tax Parcels using the
methodology described in Section 8 and Appendix F of this Initial Assessment Resolution.
"Property Appraiser" means the Monroe County PropeIty Appraiser.
"Recreational Vehicle Park"
means a place (a) set aside and offered by a person for remuneration for parking,
accOlmnodation, or rental of five or more recreational vehicles or tens and (b) licensed by
the Department of Health of the State of Florida under Chapter 513, Florida Statutes, as
may be amended from time to time.
"Residential Property" means those Tax Parcels with a Code Description
designated as Residential in the Property Use Codes.
,
"Tax Collector" means the Monroe County Tax Collector.
"Tax Parcel" means a parcel of property located within the County to which the
Property Appraiser has assigned a distinct ad valorem property tax identification number.
"Tax Roll" means the real property ad valorem tax assessment roll described in
Section 193.114(2), Florida Statutes.
"Transient Occupancy Property" means those Tax Parcels that meet the definition
-
of Hotel and Motel Property and Recreational Vehic1e Park.
"Uniform Assessment Collection Act" means Sections 197.3632 and 197.3635,
Florida Statutes, or any successor statutes authorizing the collection of non-ad valorem
assessments on the same bill as ad valorem taxes, and any applicable regulations
promulgated thereunder.

"Unit" means (a) the use of land in which lots or spaces are offered for rent or lease

for the place of recreational vehicles within a Recreational Vehicle Park, or (b) the use of
land whereby an individual room within a Hotel and Motel is offered for rent or lease for
temporary occupancy.
Section 3. Provision and Funding of Fire Services.
(A) Upon the imposition of a Fire Protection Assessment for fire protection
services, facilities, or programs against the Assessed Property located within the area of the
County described in Appendix A hereto, the County shall provide fire protection services to
said Assessed Property. All or a portion of the cost to provide the fire protection services,
facilities, or programs shall be funded from the proceeds of the Fire Rescue Assessments.
The remaining cost, if any, required to provide fire protection services , facilities, and
programs shall be funded by available revenues from sources other than the Fie Protection
Assessments.
(8) It is hereby ascertained, determined, and declared that each parcel of Assessed
Property located within the geographical area of the County will be benefitted by the
County's provision of fire protection services, facilities, and programs in an amount not less
than the Fire Rescue Assessment imposed against such parcel computed in the manner set
-
forth herein.
Section 4. Imposition and Computation of Fire Protection Assessments. Fire
Protection Assessments shall be imposed against all Tax Parcels within the Property Use
Categories within the County. Fire Rescue Assessments shall be computed in the manner
set forth in this Initial Assessment Resolution.

Section 5. Legislative Determinations of Special Benefit and Fair
..
Apportionment. It is hereby ascertained and declared that the Fire Rescue Assessed Costs
provide a special . benefit to the Assessed PropeIiy based upon the legislative
determinations set forth below, and based upon the report entitled "Monroe County,
Florida/Fire Assessment Memorandum": presented by Government Services Group, Inc. in
February 2008 and other information presented by the Government Services Group, Inc. at
the March 5, 2008 workshop of the Board, all of which are incorporated herein by
reference.
A. General
(1) Article VIII, Section 1 of the Florida Constitution, and Sections 125.01 and
125.66, Florida Statutes, grant to a board of county commissioners all powers of local self-
government to perform county functions and to render services for county purposes in a
manner not inconsistent with general law, or with special law approved by vote of the
electors, and such power may be exercised by the enactment of county ordinances.
(2) Upon the adoption of this Initial Assessment Resolution determining the Fire
Protection Assessed Cost and identifying the Assessed Property to be included in the
Assessment Roll, the legislative findings asceliained and declared in Sections 1.03 and
.~
1.04 of the Ordinance are hereby ratified and confinned.
(3) It is hereby ascertained and declared that the fire protection services,
facilities, and programs provide a special benefit to property because fire protection
services possess a logical relationship to the use and enj oyment of property by
(a) protecting and safeguarding the value and integrity of improvements and structures and

the real property on which they are located through the delivery of comprehensive fire
"
protection services; (b) protecting and safeguarding the life and safety of intended
occupants in the useand enjoyment of land; (c) lowering the cost of fire insurance by the
presence of a fire protection services program within the County; and (d) containing fire
incidents on land that would otherwise have the potential to spread and endanger property
and property features as well as human lives.
(4) It is fair and reasonable to use the Property Use Codes and the DOR Codes
for Cost Apportionment and Parcel Apportionment because (a) the Tax Roll database
employing the use of such property use codes is the most comprehensive, accurate,
reliable, and centralized database of information readily available to determine the property
use, Building Area for improvements, and acreage for Land within the County; and (b) the
Tax Roll database with such Property Use Codes is maintained by the Property Appraiser
and is thus consistent with the parcel designations on the Tax Roll which compatibility
permits the development of an Assessment Roll in conformity with the requirements of
Chapter 197, Florida Statutes, and the Uniform Method of Collection.
(5) The data available in the Property Use Codes is more useful and accurate in
determining Building Area than relying exclusively on the data maintained in the DOR
.-
codes alone because (a) the data maintained in the Property Use Codes reveals the
existence of a Building with a different use than the ones described in the DOR Codes, and
(b) the Improvement Codes represent records maintained by the Property Appraiser with
the most information and the most recent information relative to Building Area regardless
of propeliy use.

B. Cost Apportionment
"
(1) It is appropriate and consistent with the decision of the Florida Supreme
Court in the case of City of North Lauderdale v. SMM Properties, Inc., 825 So.2d 343 (Fla.
2002) to exclude from the Fire Rescue Assessed Costs any amounts to determined to
constitute Emergency Medical Services Costs.
(2) Apportioning the Fire Protection Assessed Costs among classifications of
property based on historical demand for fire protection services, but not Emergency
Medical Services, is fair, reasonable, and proportional to the special benefit received.
(3) The Monroe County Fire Incident Reports are the most reliable data available
to understand the current and projected demand for fire protection services from property
use and to detennine the benefit to property resulting from the availability of fire protection
services, in order to protect and serve Buildings and Land located within Assessed Propelty
and its intended occupants. The Fire Incident Reports are sufficiently numerous such that
they document the historical demand for fire protection services by Property Use
Categories. The Demand Percentage derived for each Property Use Category through
examination and analysis of Fire Rescue Incident Reports is consistent with the experience
of the County. Therefore, the use of the Demand Percentage is a fair and reasonable

method of apportioning Fire Protection Assessed Costs among the Property Use
Categories.
(4) The historical demand for fire rescue service availability for multi-family and
single family Residential Property is substantially similar and any difference in the
percentage of calls to these two propelties is statistically insignificant.

(5) The level of service required to meet anticipated demand for fire protection
..
services and corresponding annual fire budget required to fund fire protection services
provided to non-spedfic propeliy uses would be required notwithstanding the OCCUlTence
of any incidents from non-specific property uses. Therefore, it is fair and reasonable to
omit from the Demand Percentage calculation the Monroe County Fire Rescue Incident
RepOlis document fire protection services provided to non-specific propeliy uses.
C. Residential Parcel Apportionment
(1) N either the size nor the value of the Residential Property determines the
scope of the required fire protection response. The potential demand for fire protection
services is driven by the existence of the Dwelling Unit and the anticipated average
occupant population.
(2) Apportioning the Fire Protection Assessed Costs for fire protection services
attributable to Residential Property on a per Equivalent Dwelling Unit basis is therefore a
fair and reasonable method of Parcel Apportionment based upon historical call date.
D. Non-Residential Parcel Apportionment
(1) The use of actual square footage to calculate apportionment of assessments
for Non-Residential Propeliy Buildings is fair and reasonable for the purposes of Parcel

AppOliiomnent because the demand for Fire Protection Services can be determined and
measured by and is correlated to the actual square footage of stmctures and improvements
on the benefited parcels.
(2) In accordance with Section 125.0168, Florida Statutes, which mandates that
the County treat Recreational Vehic1e Property as a commercial entity in the same manner

as a hotel, motel, or other similar facility for purposes of non-ad valorem special
"
assessments levied by the County, including this Fire Protection Services Assessment, it is
fair and reasonable to treat each space within a Recreational Vehicle Park and each room in
a Hotel/Motel property as a Unit because the potential demand for fire protection services
is driven by the existence of each Unit and the anticipated average occupant population.
E. Land Parcels
(1) It is fair and reasonable to classify all Land parcels with less than 160 acres
together because they share a similar potential for endangering structures and occupants
and because such parcels have the potential to be used as constitutionally recognized
homesteaded property.
(2) It is also fair and reasonable to apportion the costs for fire protection services
to Land parcels with more than 160 acres on a per acre basis, because the demand for fire
protection services in a parcel of that size diminishes in proportion to the size, because fire
protection services in a parcel of that size are directed not as much toward protection of the
property but rather to suppression and containment of the fire in order to prevent its spread
to adjacent properties.
Section 6. Cost Apportionment Methodology. ~
(1) To correlate the Property Use Categories within the Momoe County Fire
Rescue Incident Reports, the response addresses within the Incident Reports were tied to the
Property Use Codes and the Propelty Appraiser's parcel address tables. Such correlation
between the response addresses in the Incident Reports and the Propelty Use Codes is

necessary in order to allocate the historical demand for the fire protection services for Tax

Parcels on the Tax Rolls within the Property Use Categories.
(2) Based ,on the correlation by Property Use Category between the response
addresses in the Incident Reports and the Propeliy Use Codes, the number of Incident
Reports filed within a sampling period was detennined for each Propeliy Use Category.
(3) A Demand Percentage for each Property Use CategOlY was then determined
by dividing the number of Incident Reports for any given Property User Category by the
total number of Incident Reports for all Propeliy Use Categories within the sampling
period. The Demand Percentage for each Property Use Category was then applied to the
Fire Rescue Assessed Cost and the resulting number is the product, or the allocation of that
portion of the Fire Protection Assessed Cost allocated to each individual Property Use
Category. The methodology is hereby approved, adopted, and incorporated into this Initial
Assessment Resolution by reference.
Section 7. Parcel Apportionment Methodology.
(1) The appOliionment among the Tax Parcels of that portion of the Fire
Protection Assessed Costs apportioned to each Property Use Category under the Cost
Apportionment shall be consistent with the Parcel Apportiomnent methodology described

and determined in Appendix F hereto, which methodology is hereby approved, adopted, and
incorporated into this Initial Assessment Resolution by reference.
(2) It is hereby acknowledged that the Parcel Apportionment methodology
described in Appendix F is to be applied in the calculation of estimated Fire Protection
Services Assessment rates established in Section 8 of this Initial Assessment Resolution.

Section 8. Determination of Fire Protection Services Assessed Costs;
Establishment of Initial Fire Protection Service Assessments.
.
(1) The Fire Protection Service Assessed Costs to be assessed and apportioned
among benefitted parcels pursuant to Cost Apportionment and Parcel Apportioillllent for the
Fiscal Year commencing October 1, 2008 is the amount determined n the Estimated Fire
Protection Assessment Rate Schedule. The approval of the Estimated Fire Protection
Assessment Rate Schedule by the adoption of this Initial Assessment Resolution determines
the amount of the Fire Protection Services Assessed Costs. The remainder of such Fiscal
Year budget, if any, for fire protection facilities, programs, and services shall be funded
from legally available County revenue sources other than the Fire Protection Services
Assessment proceeds.
(2) The estimated Fire Protection Service Assessments specified in the Estimated
Fire Protection Assessment Rate Schedule are hereby established to fund the specified Fire
protection Services Assessed Costs determined to be assessed in Fiscal Year commencing
October 1,2008.
(3) The estimated Fire Protection Service Assessments specified in this Initial
Assessment Resolution shall be the estimated assessment rates applied by the County
Administrator in the preparation of the preliminary Assessment Roll for the Fiscal Year _
corrullencing October 1, 2008, as provided in Section 9 below.
Section 9. Assessment Roll.
(A) The County Administrator is hereby directed to prepare, or cause to be
prepared, the preliminary Non-Ad Valorem Assessment Roll for the Fiscal Year

commencing October 1, 2008 in the manner provided in the Ordinance. The Non-Ad
..
Valorem Assessment Roll shall include all of the Tax Parcels within the Property Use
Categories within the geographic unincorporated area of the County covered by this
resolution, and shall apportion the estimated Fire Protection Services Assessed Cost to be
recovered through Fire Protection Service Assessment in the manner set forth in this Initial
Assessment Resolution.
(B) A copy of this Initial Assessment Resolution, supporting documentation
relative to the estimated amount of Fire Protection Services Assessed Cost to be recovered
trough the imposition of the assessments, and the preliminary Non-Ad Valorem Assessment
Roll shall be maintained by the County Administrator and open to public inspection. The
foregoing shall not be construed to require that the preliminary Non-Ad Valorem
Assessment Roll be in printed form if the amount of the Fire Protection Services
Assessment for each Tax Parcel can be determined by use of a computer terminal available
to the public.
(C) It is hereby determined, ascertained and declared that the method of
determining the Fire Protection Services Assessments as set forth in this Initial Assessment
Resolution is a fair and reasonable method of apportioning the Assessed Cost among
-
parcels of Assessed Property within the County.
Section 10. Authorization of Public Hearing. A public hearing shall be
conducted by the Board at 5:01 p.m., or as soon thereafter as the matter can be heard, on
June 18, 2008, at the Marathon Government Center, 2798 Overseas Highway, Marathon,
Florida (Mile Marker 50), at which time the Board will receive and consider any comments

on the Fire Protection Services Assessment from the public and affected property owners

and will consider imposing the Fire Protection Service Assessments and collecting the
assessments on the same bill as ad valorem taxes.
Section 11. Notice by Publication. Upon completion of the Non-Ad Valorem
Assessment Roll, the County Administrator shall publish or cause to be published a notice
of the public hearing authorized by Section 10 above in the manner and the time provided in
Section 2.05 of the Ordinance. Such notice shall be in substantially the form attached hereto
as Appendix G. Said notices must be sent out no later than May 28, 2008.
Section 12. Notice by Mailing. In addition to the notice provided in accordance
with Section 11, above, at least 20 days prior to the public hearing, the County
Administrator shall mail or cause to be mailed a notice of the public hearing to each person
owning propelty subject to the assessment. Said notice shall be mailed by first-class mail
by no later than May 28, 2008; shall include all of the information required by Section
1 97.3632(4)(b), Florida Statutes; and shall be substantially in the form attached hereto as
Appendix H.
Section 13. Hardship Exemption.
(A) To qualify for a hardship exemption, the owner of Residential Propelty shall .-
meet the following criteria:
1. The Owner shall occupy the Residential Property and be entitled to a
homestead exemption pursuant to Chapter 196, Florida Statutes;
2. For the continuous 12 months immediately prior to the date on which

an application for homestead exemption is filed, the Owner and all other occupants
of the Residential Property must meet eligibility requirements for the Florida Work
and Gain Economic Self-Sufficiency (WAGES) program and the Owner must a an
eligible participant in the WAGES program; the Owner must be a recipient of food
stamps or Supplemental Security Income; or the Owner must be celiified for any
service offered by the MODIoe County Department of Social Services as of the date
of the application; and
3. The Owner shall have the present intent to maintain the Residential
Property as his/her pennanent place of residence within the entire fiscal year for
which the Fire Protection Services Assessment is to be imposed.
(B) On an annual basis, by no later than September 1 of the year preceding the
st31i of the fiscal year in which the assessment is to be imposed, the Owner seeking the
hardship exemption shall file an application with the Monroe County Depaliment of Social
Services to obtain a hardship exemption. Such an application shall contain the following
infonnati on:
I. Name and address of the Owner;
2. Address and legal description of the Residential Propeliy for which the -
hardship exemption is sought;
3. Names and ages of all occupants of the property;
4. Certification from the Florida Dep31iment of Children and Family
Services or other such satisfactory proof that the Owner is an eligible participant of

the WAGES program, or a recipient of food stamps or SSI, or must be certified to

receive services from the Momoe County Depaliment of Social Services~ and
5. A statement by the Owner agreeing to notify the County immediately if
the propeliy is sold or conveyed or if the Owner vacates the Property.
(C) On an annual basis, by no later than September I of the year preceding the
start of the fiscal year in which the assessment is to be imposed, the Owner seeking the
hardship exemption shall file an application with the Monroe County Dep31iment of Social
Services to obtain a hardship exemption. Such an application shall contain the following
information:
(D) The Director of the Community Service Division shall render his/her decision
as to eligibility of the Owner for a hardship exemption in writing, with copies to the County
Administrator and the Tax Collector. If the Owner qualifies for the h31'dship exemption, the
exemption shall be granted and payment of the Owner's Fire Protection Services
Assessment shall be made from funds appropriated by the Board for that purpose. The
Owner may request review of a denial of a request for a hardship exemption by filing a
petition in writing with the County Administrator within 30 days of notification of the
denial. The County Administrator shall review the denial within 30 days of the filing of the

request for review, and issue a decision in writing. If the County Administrator upholds the
denial, the owner shall have a further right of review by the Board. An owner shall file a
request for review by the Board with the County Administrator within 30 days of the
notification of the County Administrator's decision. The Board shall review the matter
within 90 days of the filing of the request for review. Failure to file the petition in

accordance with the time limits set forth above shall be deemed a waiver of any right of

(E) The hardship exemption shall be for one fiscal year only and the Owner shall
be required to file a new application to obtain a hardship exemption for each subsequent
fiscal year.
(F) An interim Fire Protection Services Assessment shall be imposed against
Residential Property that has received a hardship exemption in the event the Owner sells or
conveys the Property in the year in which the hardship exemption was granted. The interim
assessment will be prorated, calculated on a monthly rate which is l/lih of the Fire
Protection Services Assessment imposed during that Fiscal Year. Each interim Fire
Protection Services Assessment shall be deemed delinquent on the last day of the second
full month subsequent to the month in which the property was sold or conveyed, or the last
day of the Fiscal Year, whichever occurs first, and shall constitute a lien on the Property.
The lien shall be equal in rank and dignity to the liens of any and all state, county, district or
municipal taxes and special assessments, and superior in rank and dignity to any other liens,
encumbrances, titles in and claims to the affected real property.
(G) The County Administrator shall administer or provide for the collection of all

interim Fire Protection Services Assessments.
Section 14. Effective Date. This Initial Assessment Resolution shall take effect
immediately upon its adoption.
Section 15. Severability. If any clause, section or provision of this Resolution
shall be declared unconstitutional or invalid for any reason or cause, the remaining portion

of said Resolution shall be in full force and effect and be valid as if such invalid portion

PARCEL APPORTIONMENT METHODOLOGY
The Cost AppOltionment to each Propelty Use Category shall be appOltioned among the Tax
Parcels within each Propelty Use Category as follows:
Section F -1. Residential Property. The Fire Protection Services Assessment for each
Tax Parcel of Residential Propelty shall be computed by multiplying the Demand Percentage
attributable to Residential Property by the Fire Protection Service Assessed Costs, dividing such
product by the total number of dwelling units shown on the Tax Roll for the County and then
multiplying the quotient by the number of Dwelling Units located on such Tax Parcel.
Section F-2. Non-Residential Property. The Fire Protection Services Assessment for
each Building of Non-Residential Property, except Transient Occupancy Property, shall be
computed as follows:
(A) Respectively, multiply the Demand Percentage attributable to each
category of Non-Residential Propelty by the Fire Protection Service
Assessed Costs. The resulting dollar amount reflects the portions of the
County's fire rescue budget to be funded from assessment revenue from
each of the non-residential Property Use Categories.

(B) Separate each Building of Non-Residential Property into the appropriate
non-residential Property Use Category for that Building.
(C) For each non-residential Property Use Category, add the Building Area
square footage of all Buildings in each non-residential Property Use
Category. This sum reflects the aggregate square footage for each

(D) Divide the product of subsection (A) by the sum of the square foot
allocations for each Non-Residential Property Use Category in
subsection (C) of this section. The resulting quotient is equal to a dollar
amount per square foot of improved area ("the square foot rate") to be
used in computing Fire Protection Service Assessments for Non-
Residential Propeliy Use Categories.
(B) For each such category, multiply the applicable square foot calculated
under subsection (D) above by the number of square feet for each
Building in the Non-Residential Propeliy Use Category. The resulting
number is equal to the amount of Fire Rescue Assessments to be
imposed on each Building of Non-Residential Property.
Section F -3. Mixed Use. The Fire Protection Services Assessment for each Tax Parcel of
mixed use (two or more categories) of property shall be the sum of the Fire Protection Service
Assessment computed for each Property Use Category.

NOTICE OF HEARING TO IMPOSE AND PROVIDE FOR COLLECTION OF FIRE
PROTECTION SERVICES SPECIAL ASSESSMENTS
Notice if hereby given that the Board of County Commissioners of Monroe County, Florida, will
conduct a public hearing to consider the imposition of an annual fire protection service special
assessment for the funding of fire protection services, facilities, and programs within the
unincorporated areas of Monroe County less certain areas as shown in the chati below.
The hearing will be held at 5:01 p.m. or as soon thereafter as may be heard on June 18,2008 at the
Marathon Government Center, 2798 Overseas Highway, Mat'athon, Florida (Mile Marker 50), for
the purpose of receiving public comment on the proposed assessments. All affected property
owners have the right to appear at the hearing and to file written objections with the County
Administrator within 20 days of this notice. If any person decides to appeal a decision made by the
County Commission with respect to any matter considered at the hearing, such person will need a
record of the proceedings and may need to ensure that a verbatim record of the proceeding is made,
including the testimony and evidence upon which the appeal is to be based. In accordance with the
Americans with Disabilities Act, persons needing accommodation or an interpreter to participate in

As required by Section 197,3632, Florida Statutes, notice is hereby given to you by the Board of
County Commissioners of Monroe County, Flotida, that an annual assessment for fire protection
services using the tax bill collection method may be levied on your property for fiscal year October
1,2008 - September 30,2009.
The purpose ofthis assessment is to pay for fire protection equipment, facilities and programs
benefiting propeliy located within the unincorporated area of Monroe County. The total annual
Fire Protection Assessment revenue to be collected via this method is estimated to be $595,173. The
mlliual fire protection service assessment is calculated by determining the category of each property
and then multiplying the number of residential units on the property by $34 or multiplying the
square footage of non-residential properties by the applicable assessment per square foot. The

A public infonnation meeting to discuss the assessment will be held at 5:00 p.m. on June 18,2008,
at the Marathon Government Center, 2798 Overseas Highway, Marathon Flotida (MM 50). You
and all other affected property owners have a right to appear at the heating and to file written
objections with the County Administrator within 20 days of this notice. If any person decides to ~
appeal a decision made by the County Commission with respect to any matter considered at the
hearing, such person will need a record of the proceedings and may need to ensure that a verbatim
record of the proceeding is made, including the testimony and evidence upon which the appeal is to
be based. In accordance with the Americans with Disabilities Act, persons needing accommodation
or an interpreter to participate in this proceeding should contact the County Administrator at

Both the non-ad valorem assessment amount and ad valorem taxes for this property will be
collected on the same tax bill mailed in November 2008. Failure to pay the assessments will cause
a tax certificate to be issued against the property and could result in loss of title.
