AGENDA ITEM WORDING: Approval of a resolution approving the top fifteen(15)canals in rank
order by technology group, as approved by the WQPP Canal Restoration Advisory Subcommittee,and
authorize negotiations in rank order with the canal homeowners for a period not to exceed ninety(90)
days,until five(5)demonstration sites are finalized,written homeowner approval has been received,
and the projects are ready for final approval by the BOCC.Approval is also requested to allow multiple
restoration techniques for a canal if recommended by the Canal Restoration Advisory Subcommittee to
ensure full restoration,and to allow restoration of two(2)canals using the Organic Removal technique,
one of which will be combined with another restoration technique due to project ranking scores.
ITEM BACKGROUND:
April 11, 2013: the WQPP Canal Restoration Advisory Subcommittee (Subcommittee) began formally
meeting to advise on issues related to the canal master plan and subsequent demonstration projects.
July 26, 2013: the Subcommittee recommended criteria for selection of the final demonstration
projects.
September 27, 2013: the Subcommittee approved the top 15 canals, a minimum of 3 per technology
(backf lling,organic removal,pumping, weed gate removal and culvert installation).
County and AMEC staff are reviewing the projects for ease of permitting and ease of implementation,
and contacting homeowners to provide notification of the project, project details and to obtain written
approval of the restoration project. Due to a limited timeline of an EPA grant for water quality
monitoring of the demonstration canals, it is recommender) that homeowners be allowed a maximum
period of ninety (90) days to provide written voluntary approval to the County for the project in their
area Staff shall be authorized to move to the next ranked project if such written approval is not
obtained within the ninety(90)time period.
Because Canal #266 on Big Pine Key in Doctor's Arm subdivision ranked first in two categories:
Weed Barrier and Organic Removal, approval is requested to allow both restoration techniques, as
recommended by the Subcommittee to provide full restoration. Because Canal #266 is recommended
for award under these two categories,it is requested that a second Organic Removal project be allowed,
to ensure five (5) demonstration projects instead of just four (4), as recommended by the
Subcommittee. Approval is requested to negotiate in rank order with the homeowners of the next four
projects.
PREVIOUS RELEVANT BOCC ACTION:
3/21/12: BOCC approved a Grant Agreement from FDEP to fund Phase 1 of the Canal Management
Master Plan (CMMP)and also authorized execution of a task order with AMEC under the on-call
professional engineering services contract to develop the Phase 1 CMMP.
6/20/12: BOCC approved the grant application submitted to EPA requesting $100,000 for Phase 2 of
the CMMP and specified a$10,000 match of in-kind services.
9/19/12: BOCC approved a$100,000 grant agreement from EPA that funded Phase 2 of the CMMP.
11/20112: BOCC approved a Task Order with AMEC Environmental & Infrastructure, Inc. under the
on-call professional engineering services contract to develop Phase 2 of the CMMP.
5/20/13: BOCC approved FDEP Grant S0640 providing $100,000 to perform bathymetric surveys and
also approved a$100,000 Task Order with AMEC to perform the bathymetric work.
3/20/13: BOCC approved$5 million for the canal restoration demonstration projects.
5/15/13: BOCC approved a $37,725 contract with AMEC to select the demonstration projects, as a
result of a request for quotes.
8/21/13: BOCC approved the selection process for the top 15 canals.
9/17/13 BOCC approved a time extension to the AN EC contract for selection of the demo projects.

A RESOLUTION OF THE MONROE COUNTY BOARD OF COUNTY
COMMISSIONERS APPROVING THE TOP 15 DEMONSTRATION
CANALS IN RANK ORDER BY TECHNOLOGY GROUP AND
APPROVING OTHER RECOMMENDATIONS CONTAINED HEREIN
AS RECOMMNEDED BY THE FKNMS WATER QUALITY
PROTECTION PROGRAM CANAL RESTORATION ADVISORY
SUBCOMMITTEE.
WHEREAS, Monroe County, Florida, encompasses the uniquely beautiful natural
environment of the Florida Keys; and
WHEREAS, the Monroe County Board of Commissioners (BOCC) is dedicated to
preservation of the built and natural environment; and
WHEREAS,the purpose of the FKNMS WQPP Canal Restoration Advisory Subcommittee is to
advise on canal restoration technologies and policies needed to address water quality issues
in canals; and
WHEREAS,the Subcommittee has recommended criteria for selection of the demonstration
projects based on scientific criteria; and
WHEREAS,the Subcommittee has approved the top fifteen (15) canals categorized by
technology group and in rank order in each group; and
WHEREAS, approval is requested of the top fifteen (15) canals and to authorize negotiations
in rank order with the homeowners on the canals until the five (5) demonstration projects are
selected; and
WHEREAS,time is of the essence and therefore a ninety (90) day time limit is requested to
receive written agreement from the homeowners from the date of first written contact to
them, and to move to the homeowners of the next highest ranked canal in that category if
written agreement is not received within the ninety (90) day period; and
WHEREAS,the Subcommittee has recommended that multiple technologies be considered on
a canal to ensure complete restoration.
NOW,THEREFORE, BE IT RESOLVED BY THE MONROE COUNTY BOCC:
Section 1. The FKNMS WQPP Canal Restoration Advisory Subcommittee recommends that
the BOCC support the top fifteen (15) canals, a minimum of three (3) canals for each of the
five (5)technologies: canal backfilling, organic removal, pumping, weed gate installation and
culvert installation. One canal shall be selected for each technology. The top fifteen (15)
canals are included in Attachment A.

ction 2. Approval is authorized to negotiate with the homeowners of the top ranked canal
in each group in rank order,for a period up to ninety(90) days, in order to obtain written
homeowner agreement. If written agreement Is not received within the ninety (90) day time
period,staff is authorized to move to the next ranked canal and so forth until five(5)
demonstration projects are selected, one per category, and written agreement has been
received from the homeowners.
Section 3. Approval is authorized to move to the next ranked canal under a category If a
canal has received a higher rating in another category and if recommended by the Canal
Restoration Advisory Subcommittee.
Section 4. Multiple restoration techniques shall be considered if recommended by the Canal
Restoration Advisory Subcommittee to ensure complete restoration.The estimated cost of
each technology for each canal shall be submitted to the BOCC for future approval before any
project proceeds further.
Section S. This Resolution was passed by the Monroe County board of County Commission
at a meeting on the 1&day of October, 2013.
Section 6. EFFECTIVE DATE.
This Resolution shall become effective upon adoption.

Dear Mayor Neugent and Commissioners,
I would like you thank you Commissioners for allowing Sexton Cove Property Owners to have
our support letter read into the record of the October 16, 2013 meeting.
e have been working with Rhonda Haag on the matter of Canal Restoration since reading
about it the newspapers.
Our Homeowners Association has been running aerators in our canals which are as deep as 42
feet deep in our canals. We have 10 canals in Sexton Cove, and been paying the electrical costs
of our members or offering free membership to help with the cost of the electricity to run the
aerators for many years. Ms. Haag has informed us that the aerators cannot aerate the water
enough in that depth or improve water quality in our canals.
Our canals need to be 8 feet deep for the tidal flow to work improve water quality according
o the study done by this Committee. When FDOT was involved with the road work on the 18
mile stretch, we inquired about the cost of the dirt FDOTwere digging up to back fill our canals
at our cost, but we were told it was contaminated soil and could not be used in our canals to help
11 in the depths of canals. This problem of the excessive depth is something our Board of
Directors and members have been dealing with or several years. Our canals ended up 15t'worst
for water quality in all of Monroe County.

We are requesting your vote and support on this agenda item to help the 250 households here in
Sexton Cove to allow back filling of one of our canals.
