ITEM BACKGROUND: Resolution 328-2012 was approved on October 17, 2012, and implemented the cost of providing services associated with the building permitting and inspection system through an updated fee schedule. Since that time, the primary responsibility for performing commercial stormwater plan examination has transitioned from the Engineering Department to the Planning and Environmental Resources Department as a new task for the "biology" plans examiners. Therefore, a fee for this service as currently listed under Engineering Section (I)3 likewise needs to be added to the Biologist fee Section (I) 1. The Building Department is also clarifying that by Florida Building Code and by practice, building permits are re-opened, not renewed, and is changing the terminology for this fee. In addition, this amendment removes a fee for an emergency Certificate of Occupancy as this is an outdated practice; all Certificates of Occupancy are processed expeditiously without additional charge. WHEREAS, the Monroe County Board of County Commissioners wishes to provide the citizens of the County with the best possible service in the most cost effective and reasonable manner; and WHEREAS, the Board finds that it would be in the best interests of the public to charge the true cost for such services, thereby placing the burden of such costs directly upon those parties deriving the benefit from such services; and WHEREAS, the updated fee schedule prepared by the Growth Management Director for providing these services includes the estimated direct costs and reasonable indirect costs of services; and does reflect the true cost of providing the services to the persons requesting the Building Department services; and WHEREAS, the Board concurs with the conclusions and findings of the Growth Management Director; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA: Section 1. Resolution No. 328-2012 is hereby rescinded. Any other fees schedules or provisions of the Monroe County Code inconsistent herewith are hereby repealed effective midnight February 20, 2013. Section 3. The staff is hereby directed to implement these fees beginning February 21, 2013.
