AGENDA ITEM WORDING: Approval of resolution establishing additional rules for the use of

ITEM BACKGROUND: Monroe County passed resolution 165-2011 on June 15, 2011 in an attempt
to curtail the recreational misuse of Bay Dnxe. Bay Drive ends on the open water and, as a result, the
area was being used for recreational access to the water however, it was also being misused as a party
location. The misuse led to the County passing the aforementioned resolution. Ongoing complaints
have led to staff drawing up the current resolution further restricting the hours the area can be used.

A RESOLUTION BY THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS SETTING RULES FOR USE OF
BAY DRIVE SUNSET POINT,PB2, PAGE
KEY LARGO. FLORIDA
WHEREAS,Bay drive is a county road located in Key Largo; and
WHEREAS,Bay Drive ends upon the open waters of Florida Bay;and
WHEREAS, the end of Bay Drive has been and is currently used by
residents and non-residents alike to access open water however said access is being
misused and creating a nuisance; and
WHEREAS, on the 150' day of June 2011, the county passed resolution
number 165-2011 to attempt to curtail the misuse of Bay Drive by limiting the hours the
Bay Drive can be used by the public; and
WHEREAS,the county finds it to be in the best interests of its citizens to
further limit the hours that Bay drive may be use by the public in order to further curtail
its misuse,
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF
COUNTY COMM[SSIONERS OF MONROE COUNTY,FLORIDA THAT:
Section 1. The following -rules are established for the use of Bay Drive,
Sunset Point,PB2, Page 81 13,1�� [1,artci u, 11132, Page 1)1, Key Largo,Florida:
1. The area is open to the public Monday through Friday, excluding
holidays, from 7:30 a.m. until sunset. The area is closed to the public
on Saturdays, Sundays and holidays.
2. No alcoholic beverages are allowed.
3. No glass containers are allowed.
4. No person shall cook or light or maintain any cooking fire, campfire,
or other fire, except in county-provided permanently installed grill
structures.
5. No animals are allowed in the area except for service animals.
6. Commercial activity of any type is prohibited.
7. The Director of Facilities Maintenance must post signs in the area of
the above rules.
Section 2. The Clerk of Courts is requested to provide a certified copy of
this resolution to the Monroe County Sheriff s Office.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
Florida, at a regular meeting held on the 20th day of November, 2012.
