AGENDA ITEM WORDING: Approval of a resolution authorizing the donation of Block 19, Lot
1, Breezeswept Beach Estates located at 11 West Indies Drive on Ramrod Key near mile marker 27
to the Monroe County Comprehensive Plan Land Authority for conservation and authorizing the
Mayor to execute the deed and associated closing documents.
ITEM BACKGROUND: This property was acquired by Monroe County in 2004 via settlement of
a Code Compliance case. It was known as the "Stairway to Heaven" property because the prior
owner built a set of stairs but never completed construction of the remainder of the house. Since
then, the wetland habitat has expanded and the lot is no longer suitable for development.
The subject property consists of a 6,200 square foot lot at 11 West Indies Drive on the ocean side of
Ramrod Key near mile marker 27.

COUNTY COMMISSIONERS AUTHORIZING THE
DONATION OF BLOCK 19, LOT 1, BREEZESWEPT BEACH
ESTATES LOCATED AT 11 WEST INDIES DRIVE ON
RAMROD KEY NEAR MILE MARKER 27 TO THE MONROE
COUNTY COMPREHENSIVE PLAN LAND AUTHORITY
FOR CONSERVATION AND AUTHORIZING THE MAYOR
TO EXECUTE THE DEED AND ASSOCIATED CLOSING
DOCUMENTS.

WHEREAS, the Monroe County Board of County Commission (hereinafter "BOCC")
received title to Block 19, Lot 1, Breezeswept Beach Estates (hereinafter "Subject -
Property") located at 11 West Indies Drive on Ramrod Key in lieu of foreclosure due to a
code violations; and

WHEREAS, the BOCC acquired this property through foreclosure of a code compliance
lien; and
0
WHEREAS, the Subject Property has environmentally sensitive wetland habitat and is
not suitable for development or for any other County purpose other than conservation;
and
0
WHEREAS, the Monroe Comprehensive Plan Land Authority (hereinafter "Land
Authority") owns and manages many environmentally sensitive properties for
conservation; and
WHEREAS, the BOCC desires to donate the Subject Property to the Land Authority for

conservation; and
WHEREAS, F.S. 125.38 authorizes the County to transfer County owned property at no
cost to another governmental entity regardless of value of the property provided that the
property is not needed for county purposes if the Board adopts a resolution setting forth
the future purpose for which such property is to be used and the price, if any.
NOW, THEREFORE, BE IT RESOLVED BY THE MONROE COUNTY BOARD OF
COUNTY COMMISSIONERS: 0.

Section 1. The BOCC hereby authorizes the donation of the Subject Property to the Land U
Authority for conservation. U
Section 2. The Mayor is hereby authorized to execute the deed and associated closing
documents to complete the real estate transaction.
