ITEM BACKGROUND: The Land Authority has been purchasing lots in Crains subdivision on Grassy Key in Marathon in partnership with the Florida Department of Environmental Protection (DEP) and the City of Marathon to protect property rights and the natural environment pursuant to Marathon Resolution 2016-48. The majority of the undeveloped property in this subdivision is located within the State Florida Forever project boundary, which provides the Land Authority an opportunity to resell the property to the State and recover some or all of its funding. However, the subject property addressed in this agenda item (Block 6, Lot 15 and Block 49, Lots 1, 2, 3, 14, 15, and 16, Crains Subdivision) is outside the Florida Forever project boundary and is therefore not eligible for resale to the State. For this reason, the proposed resolution authorizes the conveyance of the subject lots to the City of Marathon, subject to a conservation easement. The conservation easement allows conservation land management activities and the construction of resource-based public recreational facilities permitted by DEP and the US Army Corps of Engineers, but otherwise prohibits development of the subject property. This will allow the City to manage the property as a natural area with boardwalks and nature trails in accordance with the City's plans for the area. The estimated closing costs for this transaction are listed in the agenda documentation. ADVISORY COMMITTEE ACTION: On July 26, 2022 the Committee voted 2/1 to approve the proposed resolution.
