ITEM BACKGROUND: The purpose of this agenda item is to revise an ordinance regarding
method of selection of three Monroe County employees who sit on the Monroe County Personnel
Policies and Procedures Review Board ("Review Board"), to delete a reference to another advisory
board that has been disbanded.
On July 15, 1988, Monroe County Board of County Commissioners adopted Ordinance No. 038-
1988 ("Ordinance"), setting up the Monroe County Personnel Policies and Procedures Review Board
("Review Board"). The purpose of the Review Board is to review any proposed changes to the
Monroe County Personnel Policies and Procedures Manual prior to presentation to the BOCC for
approval, and also to make sure that BOCC employees are aware of the changes. The Ordinance
also provides that all members of the Review Board shall serve for a term of 2 years, at which time
they can be reappointed or replaced.
The Ordinance provides that the composition of the Review Board is as follows: one (1) on-line
direct supervisor; two (2) department heads; the Director of Employee Services, and three (3) non-
supervisory employees (plus one alternate).
The Ordinance also provides for the method of selection of each category. The Ordinance currently
states that the non-supervisory employees and the direct on-line supervisor will be chosen by the
Employee Relations Committee (ERC). The ERC, which was created by Administrative Instruction
1008, was composed of non-supervisory employees from each department. In March 2022,
Administrative Instruction 1008 was cancelled and the Employee Relations Committee was
disbanded. As a result, it is now necessary to find a new method to select the non-supervisory
employees and direct on-line supervisor who will serve on the Review Board.

The proposed ordinance revises that selection procedure. The proposed ordinance states that the
three non-supervisory employees and one direct on-line supervisor for the Review Board will now
be selected via direct nomination by department heads followed by a vote of all department heads
(Senior Management Team), instead of being chosen by the Employee Relations Committee.

WHEREAS, on July 15, 1988, via adoption of Monroe County Ordinance No. 038-
1988 ("Ordinance"), Monroe County created the Monroe County Personnel Policies and

Procedures Review Board for the purpose of reviewing any proposed changes to the Monroe
County personnel policies and procedures prior to presentation to the Monroe County Board
of County Commissioners for approval and to assure that all appropriate employees of Monroe
County are made aware of any such proposed changes; and
WHEREAS, section 1 of the Ordinance, now codified in Section 2-79 of the Monroe
County Code of Ordinances, provides that the Personnel Policies and Procedures Review c�

Personnel Policies and Procedures Review Board.

It is the purpose of the Monroe County Board of County
Commissioners and the County Administrator to create and
establish this advisory board to review any and all proposed
changes to the Monroe County Personnel Policies and Procedures
prior to presentation to the Monroe County Board of County

Commissioners for approval , and to assure that all appropriate 00

employees of Monroe County are made aware of any such proposed

Section 2 . PROCEDURES.
Proposed changes to the Monroe County Policies and

Procedures may be submitted in writing to any member of the
review board by any employee of the County at any time. Board
members will then submit the proposed changes to the Chair-
person, who will review said changes with the Director of
Administrative Services and a meeting of the review board will be
called if appropriate.
Subsequent to the meeting of the review board, the Chair-
pe on will present a draft of the proposed changes that have
board for reconsideration. If the review board and the County
Administrator cannot agree on the proposed changes , the final
decision will be that of the Monroe County Board of County
Commissioners .
Any proposed changes/amendments to the Monroe County
Personnel Policies and Procedures manual will be handled as
provided for in this section and will ultimately be reviewed by
the Monroe County Board of County Commissioners and, if approved,
adopted by Resolution.
Section 3. MEMBERSHIP.
The Monroe County Personnel Policies and Procedures Review
Board will consist of seven (7) members as follows :
1 . Three (3) members of the Employees Relations Committee; E

2. One (1) Supervisor providing direct on-line supervision
(such as an Operator Foreman, Maintenance Foreman, etc. ) ; >
3. One (1) representative of middle management (such as a

2. Distribute all appropriate material to board members ;
3. Prepare board meeting agendas;
4. Assist the Chairperson with board matters ; and >
5 . Chair board meetings in the absence of the Chairperson.
Section 5. MEETINGS.

The meetings of the Monroe County Personnel Policies and
Procedures Review Board will be called by the Director of

A special meeting may be requested by any three (3) concur-
ring members of the review board and/or called by the Director of
Administrative Services at any time a change to the Personnel
Policies and Procedures needs to be promptly made.

All meetings shall be public and shall have at least three
(3) days published notice in a newspaper of general circulation
in the County.
Section 6 . SEVERABILITY.
If any section, subsection, sentence, clause or provision of
this ordinance is held invalid, the remainder of this ordinance

Section 8. INCLUSION IN THE MONROE COUNTY CODE.

Section 9. EFFECTIVE DATE.
This ordinance shall take effect immediately upon receipt of

Section 1_. Sec. 2-214, Monroe County Code, is hereby
amended to read as follows :
"Sec. 2-214. Procedures.
Proposed changes to the Monroe County Policies and

Procedures may be submitted in writing to any member of
the review board by any employee at any time. Board
members will submit the proposed changes to the
Chairperson, who will review said changes with the ,2
Director of Human Resources and a meeting of the Review
Board will be called if appropriate.
Subsequent to the meeting of the Review Board, the

Chairperson will present a draft of the proposed
changes that have been approved by a majority of the
board membership to the County, Administrator for

review. If the County Administrator rejects any
proposed changes, or proposes any additional changes,
said changes will return to the Review Board for review
and reconsideration. If the Review Board and the
County Administrator cannot agree on the proposed
changes , the final decision will be that of the Monroe
County Board of County Commissioners.

dures Review Board will consist of seven (7) members as
follows :
(1) Three (3) members of the Employees Relations
Committee;
(2) One (1) Supervisor providing direct on-line
supervision (such as an Operator Foreman, Maintenance
Foreman, etc. ) ;
(3) One (1) representative of Middle Management (such
as a Section Coordinator, Project Director, etc. ) ;
(4) The Director of Human Resources; and
(5) One (1) Division Director appointed by the County

Administrator.
The membership of the Review Board shall be selected
in the following manner:
(1) The three (3) members of the Employees Relations
Committee (ERC) will be elected by a majority of the E
general membership of the ERC, not to include any
supervisory personnel.

(2) The direct on-line Supervisor will be elected by
a majority of ERC members in attendance at a meeting of
the ERC, after each Division Director has submitted one
(1) name for nomination.
(3) The representative of Middle Management will be
elected by a majority of ERC members in attendance at a
meeting of the ERC, after each Division Director has

(5) The Division Director will be appointed by the
County Administrator.
(6) One alternate who may attend any/all meetings,
but will have voting privileges only when it is
necessary to make a quorum, will be elected by members
of the ERC.
(c) All members will serve for two (2) years and will

manner stated above.
In the event a board member can no longer serve, the
current alternate will fill any vacancy that occurs in
Membership Category 1 and a replacement alternate will
be elected by the members of the ERC. A vacancy in
Membership Category numbers 2 through 5 will be
elected/appointed as originally elected or appointed.
Any member may be removed from the Review Board by a
majority vote of the board members."
Section 3 . Sec. 2-217, Monroe County Code, is hereby

amended to read as follows :
"Sec. 2-217. Meetings.

and Procedures Review Board will be called by the
Director of Human Resources at least twice a year to E
review the Monroe County Personnel Policies and
Procedures Manual and proposed changes thereto.

concurring members of the Review Board and/or called by
the Director of Human Resources at any time a change to
the personnel policies and procedures needs to be
promptly made.
Five (5) members will constitute a quorum.
All meetings shall be public and shall have at least
this Ordinance shall not be affected by such invalidity.
Section 5. All ordinances or parts of ordinances in
conflict with this Ordinance. are hereby repealed to the extent of
said conflict.
Section 6. The provisions of this Ordinance shall be
included and incorporated in the Code of Ordinances of the County
of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform
numbering system of the Code.
Section 7. This Ordinance shall take effect immediately
upon receipt of official notice from the Office of the Secretary
of State of the State of Florida that this Ordinance has been
filed with said Office.

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
MONROE COUNTY, FLORIDA, as f-ollows :
Section 1 . Section 2-215 , Monroe .County Code, is hereby
amended to read as follows :
"Sec. 2-215. Membership.
(a)- The Monroe County Personnel Policies and Procedures
Review Board will consist of seven (7) members as
follows :

(1) "Three (3) members of elected by the Employees
Relations Committee;
(2) One (1) Supervisor providing direct on-line ,
supervision (such as an Operator Foreman, Maintenance
Foreman, etc. ) ;
(3) One (1) representative of Middle Management (such ..
as a Section Coordinator, Project Director, etc. ) ;

(4) The Director of Human Resources ; and
(5) One (1) Division Director appointed by the County
Administrator.

AN ORDINANCE AMENDING MONROE COUNTY CODE
SECTION 2-79 REGARDING THE MEMBERSHIP OF THE
MONROE COUNTY PERSONNEL POLICIES AND
PROCEDURES REVIEW BOARD; AMENDING MONROE
COUNTY CODE SECTION 2-81 REGARDING MEETINGS OF
THE MONROE COUNTY PERSONNEL POLICIES AND
PROCEDURES REVIEW BOARD; PROVIDING FOR
SEVERABILITY; PROVIDING FOR REPEAL OF ALL
ORDINANCES INCONSISTENT HEREWITH; PROVIDING
FOR INCORPORATION INTO THE MONROE COUNTY
CODE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, since 1988, Monroe County created the Monroe County Personnel Policies
and Procedures Review Board for the purpose of reviewing any proposed changes to the Monroe
County personnel policies and procedures prior to presentation to the Monroe County Board of
County Commissioners for approval and to assure that all appropriate employees of Monroe
County are made aware of any such proposed changes; and
WHEREAS, the Monroe County Board of County Commissioners has approved a
reorganization of County positions on July 15, 2015, and as a result, clarification of the positions
that will constitute the membership of the Personnel Policies and Procedures Review Board is E
advisable; 0
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF MONROE COUNTY, FLORIDA, as follows:
Section 1. Section 2-79, Monroe County Code, is hereby amended to read as follows:

"Sec. 2-79. Membership.
(a) The Monroe County Personnel Policies and Procedures Review Board will consist of
seven (7)members as follows:
(1) Three (3) members elected by the Employees Relations Committee;
(2) One (1) Supervisor providing direct on-line supervision (including but not limited
to Administrator or Sr. Administrator classification);
(3) Two (2) Department Heads; and ..
(4) The Director of Employee Services.

(b) The membership of the Review Board shall be selected in the following manner:
(1) The three (3) members selected by the Employee Relations Committee (ERC)
