Agenda Item Wording: Approval of a resolution opposing the proposal to sell 17 State-owned

Item Background: The Florida Department of Environmental Protection is seeking public input on a
proposal to sell certain State-owned conservation properties, including 17 properties located in Monroe
County.
Advisory Committee Action: N/A
Previous Governing Board Action: Over the years the Board has taken many actions to support the
State's purchase of conservation land in the Keys. Twelve of the subject properties were pre-acquired
from private owners by the Land Authority and subsequently sold to the State. One of the subject
properties was purchased by the State directly from the private owner with assistance from the Land
Authority.

RESOLUTION NO.
A RESOLUTION OF THE MONROE COUNTY
COMPREHENSIVE PLAN LAND AUTHORITY OPPOSING
THE PROPOSAL TO SELL 17 STATE-OWNED
CONSERVATION PROPERTIES IN MONROE COUNTY.
WHEREAS, the Monroe County Comprehensive Plan Land Authority (hereinafter "Land
Authority"), a land authority pursuant to section 380.0663, Florida Statutes, has
received notice that the Florida Department of Environmental Protection (hereinafter
"DEP") is seeking public input on a proposal to sell certain State-owned conservation
properties; and
WHEREAS, said proposal includes 17 properties located in Monroe County listed in
Attachment A (hereinafter "subject properties"); and
WHEREAS, all of the subject properties are located within the Florida Keys Area of
Critical State Concern; and
WHEREAS, the number of privately owned undeveloped parcels in the Florida Keys
greatly exceeds the amount of development currently allowed by the State; and
WHEREAS, 15 of the 17 subject properties have tropical hardwood hammock
vegetation; and
WHEREAS, the State acquired 13 of the 17 subject properties through a partnership
with the Land Authority; and
WHEREAS, 4 of the 5 subject properties on Key Largo are designated Tier 1 — Natural
Area; and
WHEREAS, the 12 subject properties on Plantation Key are documented in a 2009
Florida Fish and Wildlife Conservation Commission study as having 11 plant species
listed by the State as either threatened or endangered; and
WHEREAS, 15 of the 17 subject properties are part of the 1992 Tropical Flyways
proposal submitted to DEP by the National Audubon Society to establish a network of
habitat "stepping stones" linking protected areas in the Upper and Lower Keys based on
the biology of White-crowned pigeons; and
WHEREAS, the US Fish and Wildlife's FEMA Biological Opinion and Permit Referral
Program identify at least 13 of the 17 subject properties as potentially suitable habitat
for one or more of the following federally protected species: Eastern Indigo Snake, Key
Tree Cactus, Schaus Swallowtail Butterfly, and the Stock Island Tree Snail; NOW,
THEREFORE,

BE IT RESOLVED BY THE MONROE COUNTY COMPREHENSIVE PLAN LAND
AUTHORITY that the Land Authority opposes the proposal to sell the State-owned
conservation properties in Attachment A.

at a meeting on this 17th day of September 2013.
