ITEM BACKGROUND: On January 3, 2011, Code Compliance received complaints regarding the rental of a duplex and the poor condition of the structure at 642 Diane Street, Little Torch Key. Property is owned by Robert L. Charles and Marilyn E. Engel. An investigation ensued and research revealed the following facts: • Property Real Estate Number is 00220610-000000. • Property is zoned IS (improved subdivision)with a Flood Zone of AE8. • A Certificate of Occupancy was issued on April 27, 1977 for an elevated 2 bedroom 2 bath wood frame house with a 750 gallon septic tank on a concrete column foundation with a concrete ground slab. The dwelling floor elevation is at 11.71' and no lower enclosure was permitted. • A permit was issued on October 15, 1990 for a 1209 S.F. Below Base Flood Elevation enclosure for parking and storage only; no electric,plumbing permitted. Habitation prohibited. • A site visit was conducted on April 6, 2011 and photos were taken. Inspection revealed concrete spalling and deterioration of structural parts. • The County also received several complaints and supporting documentation as to rental activity at the property,both upstairs and the downstairs enclosure. A Notice of Violation/Notice of Hearing was mailed to the property owner on April 21, 2011 and Notice was posted at the subject property and the Monroe County Courthouse on May 23, 2011. A Hearing was held on June 30, 2011 and the property owner did not attend. The Special Magistrate found the property owner in violation of the five charges as cited and ordered a compliance date of July 29, 2011 and ordered a daily fine for each code violation for each day a violation remains uncorrected beginning July 30, 2011. The Special Magistrate also ordered an immediate cease and desist of the use of the downstairs enclosure for habitation. A referral was also made to the Department of Health for investigation. On August 4, 2011, the Final Order was recorded in the Official Records of Monroe County as a lien. As of August 29, 2013, the daily accruing fines in the amount of$800.00 per day have existed for 777 days totaling $621,600.00. Additionally the county continues to receive complaints and documentation that the rental activity continues in the downstairs enclosure and there has been no attempt by the property owner to achieve compliance with any of the violations of the Monroe County Code or with the Department of Health. The property owner has previously been the subject of a separate code compliance action, (CE07080101), for property located at 150 Doubloon Lane, Cudjoe Key. As a result of that independent matter, a Final Order was filed on June 11, 2012 as a lien resulting in a cross-attached lien on 642 Diane Street. As of August 30, 2013, the daily fines in the amount of$600.00 per day have accrued for 1133 days for a total of$679,800.00 and continue to accrue. There has been no effort on the part of the Property Owner to gain compliance on either property. The total to date of both liens is $1,302,200.00.
