AGENDA ITEM WORDING: Discussion and direction regarding moving the November BOCC
meeting from Tuesday November 22, 2022 to Wednesday November 16, 2022.
ITEM BACKGROUND: The November BOCC meeting is currently scheduled for Tuesday
November 22, 2022, consistent with Section 1.04(a) of the BOCC's administrative procedures.
That locally adopted rule requires that the November meeting in election years be held on the
"date newly elected commissioners assume office as provided by law." By law, commissioners
elected on his or her district seat's normal cycle (Districts 1, 3, & 5 in Presidential Elections;
Districts 2 & 4 in Gubernatorial Elections)take office on the Tuesday two (2)weeks after
election day. F.S. 100.041(2)(a). Commissioner elected to fill the remaining two (2)year term
for that district seat's normal term take office on the first Tuesday after the first Monday
following election day. F.S. 114.04. Election day this year is on Tuesday, November 8th.
The reason behind this local rule is to allow newly elected commissioners to participate in the
November meeting instead of any outgoing commissioners whom the voters just replaced.
Since none of the current commissioners face general election opponents, there will be no
"newly elected commissioners" to seat at the November meeting.
The currently scheduled date is November 22nd, which is the 4th Tuesday in November, a mere
two (2) days before the Thanksgiving Holiday. Moving the monthly business meeting up to
Wednesday, November 16th, would be consistent with the Board's normal process for other
months, when monthly business meetings are scheduled for the 3rd Wednesday of the month.
PREVIOUS RELEVANT BOCC ACTION: On 12/8/21, the Board set the 2022 meeting schedule
including the November 22, 2022 meeting date.
