Monroe County, 19-CA-460-P. Property owner filed a complaint alleging that various state laws including the Right to Farm Act, preempt the County's land development regulations from applying to Q its parcel and seeking judicial declarations that its alleged agricultural activities are immune from the County's land development regulations. Mediation was held on 8/9/22. At the mediation, the parties agreed to recess and 0. reconvene on a date and time to be agreed upon by the parties, to allow the plaintiff to go through the development preapplication process. The parties also agreed to abate the litigation. 2. Goodman v. Monroe County, U.S. Dist. Ct. S. Dist. Of Florida Case No. 21-cv-10099 — On 1/7/22, plaintiff Laura Goodman sued Monroe County for discrimination and retaliation under Title VII, Age Discrimination in Employment Act (ADEA), and Americans with Disability Act (ADA). Ms. Goodman, formerly employed as a collections facilitator in the Code Compliance department, alleges that she was discriminated against due to her disability and retaliated against when she complained about the discriminatory treatment. Monroe County alleges that it terminated Ms. Goodman during her probationary period for legitimate non- discriminatory reasons. A mediation is scheduled for 9/13/22. 1 Packet Pg. 3218 P.1.a 3. Barter v. Monroe County, 16t" Cir. 21-CA-418-K. Mr. Barter filed this personal injury action, alleging that he was injured while driving his scooter on N. Roosevelt Blvd. when a Monroe County Transit bus pulled out into the roadway from the parking lot at 3706 N. Roosevelt, causing Mr. Barter to lay his scooter down in the roadway next to the bus and causing injuries. Closed session will be held on 9/12/22. Other Cases of Interest at Trial Court Level 4. Galleon Bay Corp. v. Monroe County and State of Florida — 02-CA-595-K. This takings case resulted in a final judgment in the amount of $480,511. A Satisfaction of Judgment was issued. The parties are engaged in discovery on the only remaining issue of attorneys' fees. CN 5. Monroe County v. Villalobos, 16t" Cir. 21-CA-257-P. Lien foreclosure case. The parties are in the process of attempting to settle the case. 6. Tommy Alfonso on behalf of T.A., a Minor, v. Monroe County, Florida, 16th Cir. CL 22-CA-108-K. Parent of minor sues alleging that child was injured on an It observation deck at the back of Bernstein Park. Discovery is ongoing. 7. Manuel Melo v. Monroe County, 16t" Cir. 22-CA-091-P. On 2/24/22, Plaintiff filed a complaint against the County relating to a Final Order of the Code Compliance Special Magistrate that was entered in CE17110041 on 4/19/19. The order found Plaintiff in violation for clearing his property, which is endangered species habitat, without a permit. The complaint, inter alia, seeks to invalidate the Final Order. On 3/17/22, the County filed its motion to dismiss U the complaint. On 7/26/22, the Court entered an order giving the Plaintiff twenty (20) days to file the amended complaint. The County has agreed to a request CL for extension of time until 9/12/22 for Plaintiff to file the amended complaint. U 8. Mark Thompson v. Monroe County and Monroe County Planning Department N 16t" Cir. No. 22-CA-113-K. On 2/24/22, Plaintiff, a former pumpout boat � employee, filed a complaint suing Monroe County under the Jones Act for injuries arising during his employment. On 6/1/22, Plaintiff filed an amended complaint, adding the City of Key West as a party. The County has requested defense and indemnification from the City pursuant to the terms of an interlocal agreement. On 8/5/22, the City filed an answer. On 8/22/22, the Court assigned a projected trial date of 12/6/23. All parties are now engaged in discovery. 9. Burke Construction Group, Inc. v. Monroe County, CA-M 19-80. On 7/11/19, Burke Construction Group sued to challenge the County's bid protest procedure and decisions to award contracts for the Marathon Library and Cudjoe Fire Station projects to other contractors. The County answered and is engaged in discovery. 2 Packet Pg. 3219 P.1.a 10.Monroe County v. Kenneth & Anita Buirley, 19-CA-565-K. This is a code lien enforcement action where the fines exceed $700,000.00. The property is located on El Monte Lane on Big Coppitt Key. The Court authorized the County to demolish and clear the property of the unsafe structures. After suit was filed, the Buirleys sold the property to Jay Archbell, P.A., which demolished the structures and brought the property into compliance. The Archbell company was added into the lawsuit as a defendant on 8/5/22. Mr. Archbell offered to resolve the case for $16,500.00, which the BOCC rejected. On 8/9/22, Archbell was added to the lawsuit as a defendant. Also on 8/9/22, Archbell presented a revised settlement offer, for $75,000. At the 9/21/2022 meeting, the County Attorney's Office will present the second settlement offer to the BOCC. a N 11.Burke Construction Group v. Monroe County, U.S.D.C. S.D. of FL, 4:22-cv-10017- DPG. On 3/24/22, Burke, a disappointed bidder and plaintiff in Circuit Case CAM19- 80 (see #8 above), filed a second, federal suit against the County, alleging federal claims. Burke complains that it was deprived of a property interest when it failed to t get the award of the contracts to build the Marathon Library and the Cudjoe Fire Station. The County filed a motion to dismiss on 4/28/2022. On 6/8/22, Burke filed a Second Amended Complaint. On 7/15/22, Burke filed a motion to stay or abate the federal court case pending resolution of the state court case. On 7/19/22, the County filed another motion to dismiss. On 7/20/22, the County filed a response to ° the motion to abate. Awaiting a ruling on both motions. 0 12.Roy's Trailer Park v. Noel & Monroe County, 19-CA-175-K. Declaratory Judgment U suit filed by Roy's against County as part of its eviction suit against its tenant. On 10/4/18, the County countersued the trailer park and the park residents, seeking an injunction prohibiting occupancy at the park until serious fire and life safety issues have been addressed, and for appointment of a receiver, and a declaratory relief cause of action to determine whether the owner or tenants are responsible for the code violations. The park owner has submitted an application to the Planning a Department to redevelop the park for affordable housing. 13.Monroe County v. Sugarloaf VFD, Inc. & Sugarloaf Wi-Fi, Inc., 17-CA-631-K. The County sued both SVFD and Wi-Fi to invalidate a lease between SVFD and Wi-Fi on the grounds that SVFD had not approved the lease in an open meeting. The trial court ruled in favor of the County and voided the lease. Wi-Fi appealed and lost. On 1/31/21, the County filed a motion for attorneys' fees to recover attorneys' fees and costs from SVFD as the prevailing party. Mediation between Wi-Fi, the SVFD, and the County is ongoing. On 11/22/2021, the Court entered a judgment for attorneys' fees and costs in favor of the County in the amount of $217,159.86. The parties are still in mediation. At Wi-Fi's request, Fortress Secured LLC submitted a public private partnership (P3) proposal that would serve as the basis for settlement. At the 4/20/22 meeting, the Board approved beginning the P3 process. No competing proposals were submitted by the 6/28/22 deadline to build a new fire station. On 7/20/22, the BOCC authorized Assistant County Administrator Kevin Wilson to negotiate agreements with Fortress Secured, LLC to design, build and finance a replacement fire station on Sugarloaf Key at the current location of the Sugarloaf Volunteer Fire Department Station #10. 3 Packet Pg. 3220 P.1.a 14.AshBritt, Inc. v. Monroe County & FDOT 16t" Cir. 17-CA-802-K. AshBritt sued the County for breach of contract and for breach of implied covenant of good faith and fair dealing. The County answered and moved for summary judgment (MSJ). On 2/24/20, Judge Koenig denied the County's MSJ and the County appealed. On 3/9/22, the Third DCA affirmed the denial of the County's MSJ, on the grounds that there were triable issues of fact in the case and therefore summary judgment could not be issued, and the case was remanded to the trial court. On 7/25/22, AshBritt issued a settlement offer. On 8/17/22, the BOCC approved a closed session for 9/12/22. On 8/31/22, AshBritt issued a revised settlement offer. 15.Gregory Burkhardt v. Monroe County, No. 22010041-CIV. On 4/28/22, Plaintiff filed a Complaint for Declaratory and Injunctive Relief in state court seeking to declare a N whether Plaintiff has a right to engage in commercial fishing uses on his Big Pine Key property. The complaint also seeks to invalidate the Habitat Conservation Plan and Incidental Take Permit issued by USFWS. On 5/25/22, the County removed the action to federal court because the litigation presents a federal question. On 7/12/22, the County filed its motion to dismiss and in the alternative, motion fora t more definite statement. On 7/26/22, Plaintiff filed its response to that motion and a motion to remand back to state court for lack of a substantial federal question. Awaiting the court's ruling on the motions. 16.Monroe County v. Sosa, 16t" Cir. 22-CA-517-K. For injunctive relief and money judgment following code compliance lien for unsafe structures. Complaint was filed on 7/26/22. U 17.Monroe County v. Purdue Pharma L.P. et al. No. 4:19-cv-10049. This case was filed by Monroe County against opioid manufacturers/marketers and distributors on 4/3/19. The complaint seeks damages including punitive damages, attorneys' fees, costs, and injunctive relief. The case is part of multi-district litigation under a judge in Cleveland, Ohio. The parties are in settlement discussions with the distributor defendants and Johnson & Johnson. Three of the other manufacturer defendants Q (Purdue Pharma, Insys and Mallinckrodt) have filed bankruptcy. The County has filed claims in the bankruptcy cases. Counsel representing local governments and the Attorneys General for states in the national litigation have developed a formula CL for distribution of settlement proceeds. On 9/15/21, the BOCC approved a resolution that expressed approval for the settlement formula. On 12/8/21, the BOCC approved a settlement agreement with three Distributors and one Manufacturer (J&J) under which the County is estimated to receive approximately $200K/year for 18 years beginning in April 2022 if the settlement is finalized by the court. At the 3/16/22 meeting, the BOCC approved settlement with another defendant manufacturer(Endo) and authorized the County Attorney's Office to enter into further settlement with other defendants as they become available. On 4/12/22, the County Attorney (on behalf of the BOCC) approved settlements with Teva, Allergan, and CVS. On 5/9/22, the County Attorney (on behalf of the BOCC) approved a settlement with Walgreens. The County expects payouts to begin during fall 2022. 4 Packet Pg. 3221 P.1.a Appellate Cases of Interest 18.Maschal et al. v. Monroe County and FKAA(now known as Crawford et al. v. Monroe County and FKAA), CA K 19-186 (Third DCA Case No. 22-754) — Suit against Monroe County and FKAA by Banks Prevatt and 11 other individuals seeking similar relief to the Delaney lawsuit, which the County won. On 9/30/21, the Court dismissed the Plaintiffs' Second Amended Complaint, but also granted the Plaintiffs' motion to file a supplementary complaint. On 10/11/21, Plaintiffs filed a different supplementary complaint. On 10/12/21, Plaintiffs filed a Motion to Disqualify the trial judge; the Court granted the order on 10/14/21 and the case was reassigned to Judge Jones. On 10/15/21, Plaintiffs filed a motion to reconsider the 9/30/21 order granting the County's Motion to Dismiss. The County and FKAA filed a Motion to Strike the supplementary complaint and also a Motion for Reconsideration of the a Court's 9/30/21 order granting leave to file the supplementary complaint. On 4/4/22, the Court denied the Plaintiff's motion for reconsideration and granted the County and FKAA's motion for reconsideration, thus denying the Plaintiff's motion to file a supplementary complaint. On 5/3/22, the Plaintiffs appealed to the Third DCA. Appellants have until 9/9/22 to file their initial brief. 0 CL 19.Jonathan Herold v. Monroe County, 21-AP-10-P. On 11/1/21, the property owner filed a notice of appeal of the Final Order of the Special Magistrate that found him in violation for building activity without a permit. The initial brief was filed 7/21/22. The County's answer brief is due on 9/22/22. 20.Edwin and Janice Handte v. Monroe County, 20-AP-6-K & 20-AP-8-K/Third DCA Case No. 21-1527/SC22-539. On 9/25/19, Planning Director denied property U owners' application to be considered exempt from the Land Development Code's vacation rental special permit and manager license requirements. On 7/31/19, the CL Planning Commission denied property owners' appeal of the Planning Director's decision. On 7/6/20, a DOAH hearing officer denied the owners' appeal. Property owners appealed to the Circuit Court on 7/23/20. On 6/29/21, the Circuit Court U N issued an appellate opinion affirming in favor of the County. On 2/2/22, the Third N DCA issued an opinion denying the property owners' petition for writ of certiorari and denied the Petitioners' Motions for Rehearing, Rehearing En Banc, or Clarification on 4/8/22. On 8/2/22, the Florida Supreme Court issued an order declining to exercise jurisdiction and denying the property owners' petition for review. 21.Joeandy Herrera & Jessica Herrera v. Monroe County, 21-AP-0007-P. On 9/2/21 the property owners filed a notice of appeal of the Final Order of the Special Magistrate that found them in violation for building activity without a permit. The initial brief was filed on 7/20/22. The County's answer brief is due on 9/19/22. 22.Jacquelyn Bello v. Monroe County, 21-AP-0003-P. On 5/5/21, the property owner filed a notice of appeal of the 4/6/21 Final Order of the Special Magistrate that found her in violation for converting a utility shed into a guest house without a permit. Monroe County, 20-AP-2-P/3D22-411. On 2/27/20, the property owner filed a notice of appeal of the 1/30/20 Final Order of the Special Magistrate finding the subject property in violation of multiple land clearing and environmental violations (LDC 110-140(a), 118-7, 118-11(a)(b), 118-13, and 122- 8(d)(3)). Briefing is complete. Oral argument was held on 10/15/21. On 2/3/22, the Circuit Court issued an opinion reversing the Special Magistrate's final order and remanded the case back to the Special Magistrate. On 7/7/22, the County filed a petition for writ of certiorari. The property owner has until 9/12/22 to file a response to the petition. 24.Steve Stone v. Monroe County, 21-AP-8-P. On 9/2/21, the property owner filed a notice of appeal of the Final Order of the Special Magistrate that found him in violation for building activity without a permit. Awaiting a ruling from the Court. 25.Nicholas Sheckler v. Monroe County, 19-AP-7-K/3D21-464. On 7/25/19, the property owner filed a notice of appeal of the 6/27/19 Final Order of the Special Magistrate that found his structure to constitute an unsafe structure in multiple ways. On the morning of 11/4/20, prior to the Circuit Court's issuance or rendition 0 of an appellate opinion, the full amount of Monroe County's code enforcement lien was paid and fully satisfied, rendering the appeal moot and subject to dismissal. Later that day, after the County's code enforcement lien had been satisfied in full, the Circuit Court released an opinion affirming in part and reversing in part the Final �? Order. On 1/8/21, upon Monroe County's motion, the Circuit Court issued an order vacating its 11/4/20 opinion and dismissing the appeal. The property owner filed a petition for a writ of certiorari with the Third DCA on 2/5/21. On 3/2/22, the Third DCA quashed the Circuit Court's decision. On 4/19/22, the Third DCA denied the County's motion for rehearing. On 5/6/22, the Third DCA issued its mandate. Case is back pending before the Circuit Court. Q N 26.Keyw Kiwi Corp. v. Monroe County, 22-AP-2-K. On 3/1/22, the owner filed a notice of appeal of the Final Order of the Special Magistrate that found it in violation of building activity without a permit. On 3/16/22, the Court entered an order staying the appeal pending the outcome in Stone v. Monroe County (#23 above) because that appeal also involves a similar statute of limitations issue. On 6/8/22, the court denied the motion of Keyw Kiwi Corp. seeking leave to file an amicus brief in the Stone case. 27.Ray Rey & Ramille Rey v. Monroe County, 22-AP-2-R On 3/1/22, the owners filed a notice of appeal of the Final Order of the Special Magistrate that found them in violation due to improvements to a nonconforming lower enclosure. The County filed its answer brief on 6/16/22. A reply brief was filed on 7/21/22. Administrative petition challenging Ordinance 05-2021, amending Comp Plan to authorize 300 early evacuation ROGOs that are to be used as exchange for existing affordable ROGOs was filed on 5/21/21. The reclaimed ROGOs would be used for administrative relief. The challenge is being held in abeyance until the related Cities' challenge is resolved by the Third District in Case No. 3D20-1921 , Mattino et al. v. City of Marathon, et al. Oral argument in the Cities' case was held on 10/19/21. Awaiting a decision of the Third DCA in Mattino case. On 3/1/22, the ALJ entered an order continuing to hold the County's case in abeyance until 7/29/22. On 7/29/22, the parties filed a joint status report, asking DOAH to continue to hold the case in abeyance until N 11/30/22. 29.Lower Density for Lower Sugarloaf, LLC, et al. v. Monroe County Planning Commission, DOAH 21-494/21-CA-574-K. On 2/5/21, a group of property owners CL neighboring the proposed affordable-employee housing development filed an appeal It to DOAH, seeking to quash or reverse the Planning Commission's granting of a CL Major Conditional Use permit to applicant Lower Keys Community Center Corp., and also on 2/5/21, filed a parallel appeal of Resolution No. P36-20 to the BOCC sitting as an appellate body under Chapter 139 of the Land Development Code. On 3/22/21, the developers intervened. The appellants on 4/6/21 filed a motion for the DOAH ALJ to stay the DOAH proceeding, which the DOAH ALJ denied on 4/26/21. After argument on 7/13/21, the ALJ issued a final order on 7/22/21, upholding the Planning Commission's decision to approve the project's major conditional use U permit. On 8/23/21, the property owners filed a petition for writ of certiorari in Circuit Court. Respondent Lower Keys Community Center filed its response on 9/24/21. CL Monroe County filed its response on 9/29/21. Property owners' reply brief is due on 9/30/22. U 30.6-7-8 US 1, LLC v. Monroe County Planning Department. On 5/7/21, the property N owner filed an appeal to the Planning Commission of the Department's 4/7/21 letter C"N of understanding regarding the attempted use of storage/shipping containers at its Key Largo property in the SC land use district (Property Identification No. 00149430- 000000). The Department determined that the storage/shipping containers used for commercial storage at the property were not subject to the property owner's conditional use approval or building permit for the parcel, are structures that require a permit and compliance with the Comprehensive Plan, LDC, Chapter 6 of the County Code, the Florida Building Code, local and FEMA flood regulations, and constitute non-residential floor area as defined in the LDC and are subject to NROGO. The owner's appeal of the Department's analysis and conclusions will be heard at the Planning Commission's October meeting. Packet Pg. 3224 P.1.a Vacation Rental Cases 31.Coral Hammock Rental, et al. v. Monroe County, 20-AP-11-K. On 10/29/20, the Special Magistrate heard 47 vacation rental violation cases arising from Coral Hammock, found 45 properties in violation, and assessed fines of $224,329, plus costs. Twenty-Six of the 45 property owners found in violation appealed the final order to the Circuit Court. The appeals were consolidated for purposes of briefing common issues of law. Appellants filed their brief on 6/4/21. The County filed its brief on 10/22/21. Appellants' reply brief was filed on 1/28/22. Oral argument is set for 10/13/22 before Senior Circuit Judge James M. Barton II. Constitutional Officer Cases Q N 32.League of Women Voters of FL v. Sec'y of State Lee, Joyce Griffin, et al, 4:21-cv- 00186, USDC/NDFL, 11t" Cir. Ct. App. Case No. 22-11143 Suit against the State and the Supervisors of Election for all 67 counties challenging SB 90, elections legislation enacted in 2021. Griffin and other SOEs retained outside counsel. The It County Attorney's Office is assisting in the defense. The other cases shown below raise similar challenges to SB 90. Supervisor Griffin has also been specifically named as a defendant in those cases. All cases were consolidated and tried earlier this year. The Court entered a 288-page Final Order on 3/31/22 for all cases. The Secretary of State and several other defendants filed an appeal of this Order on ° 4/7/22. The appeal of the four cases (case listed above, and three cases listed below) was consolidated under the case of League of Women Voters et al. v. Florida Secretary of State et al., 11t" Cir. Case no. 22-11143. On 5/6/22, the appellate court U stayed Judge Walker's final Order. For now, the provisions that Judge Walker had invalidated are again in effect and will remain so through the 2022 election. The Secretary of State filed its initial brief on 7/11/22. Monroe County, 20-CA-177-P Personal Injury 8 Packet Pg. 3225 P.1.a Lien Foreclosure and Mortgage Foreclosure Cases 34.The County Attorney's Office is currently prosecuting a total of 28 cases to foreclose on County code compliance liens. The Office is also currently representing the County as a defendant in 6 mortgage foreclosure cases, where the County holds an interest in the property, usually as a result of an inferior code compliance lien. Other Matters of Interest 35.Code Collections. During August 2022, County Attorney and Code Compliance staff collected $65,911.99 in code compliance fines and costs. Cumulatively N through the first eleven months of FY22, staff has collected $1,101,891.55 in fines and costs. A chart showing code collections is attached. 36.Vacation Rental Prosecutions. The Special Magistrate previously took Case CE22030005 under advisement. The Special Magistrate subsequently issued an order on 8/11/22, finding the property in violation. The Special Magistrate ordered the owners to cease and desist any advertisement with a $100 per day fine, as well as a one-time fine of $4361. Three new vacation rental cases were heard at the 8/25/22 Code Compliance hearing before the Special Magistrate. In CE22070008, the property owner brought the property into compliance and entered a stipulation to the violation with a one-time fine of $9500. The Special Magistrate reserved ruling in CE22040052 c0 and has yet to issue a ruling. The Special Magistrate dismissed the violation in C E21060028. 37.Assistant County Attorney Christine Limbert was recently named as a member of Leadership Monroe's Class XXX.
