ITEM BACKGROUND: Monroe County Fire Rescue is requesting an exception to the existing Resolution No. 156-2022 for a six (6) month Moratorium on new Certificates of Public Convenience and Necessity (COPCNs) which was put into place on June 15, 2022 to allow for certain COPCNs which have recently expired to be renewed to provide medical emergency services. Further, the existing Moratorium which was scheduled to expire on December 15, 2022 is being extended for an additional six (6) months to expire on June 15, 2023. PREVIOUS RELEVANT BOCC ACTION: 06/15/22 (C2) BOCC adopted Resolution No. 156-2022 for a six (6) month Moratorium on new COPCN applications. 07/02/21 (R3) BOCC adopted Ordinance No. 019-2021 to exempt the requirement for a public hearing or notice to current certificate holders for a renewal application and increasing the renewal fee. 07/02/21 (R4) BOCC adopted Ordinance No. 020-2021 to set forth the requirements for a new COPCN application and increasing the fee. Upon receipt of the application, the administrator shall review the application and conduct an investigation of the applicant. (d)Requirements for board approval in granting class A or class B certificates. (1) The board shall schedule public hearings to consider all applications. for ,- certificates. The administrator shall notify the applicant and all current holders o of certificates either by e-mail or postal mail of the date, time and place of the 0. public hearings at least one week in advance. The preferred method for delivery of the notice shall be via the applicants e-mail address unless the U Mlicant has requested postal mailing of the notice to a„business address. For U purposes of this sub-section, Monroe County shall contact all_certificate M holders holding Class A or Class B certificates in Monroe County as of November 1,2020 to request an e-mail address for notice purposes_Thereafter the preferred method for delivery of notice shall be via the certificate folders CL CL e-mail address unless the certificate holder has requested postal mailing of the notice to a business address. Z (2)At the hearing,the board may receive the report of the administrator, testimony U from the applicant or any other interested party and any other relevant information. The board will consider the public's convenience and the necessity 0 for the service in the zone or area requested and whether the applicant has the ability to provide the necessary service. The board will consider o U recommendations from municipalities within the applicant's requested service U zone or area.The board shall then authorize the issuance of the certificate, with - such conditions as are in the public's interest, or deny the application, setting forth the reasons for denial. SECTION 2: SEVERABILITY. If any portion of this ordinance is for any reason held invalid or declared to be unconstitutional, inoperative or void, such holding shall not affect the remaining portions of this ordinance. If this ordinance or any provision thereof shall be held to be inapplicable to any person,property or circumstances,such holding shall not affect its applicability to any other person, property or circumstances. cN SECTION 3: CONFLICT WITH OTHER ORDINANCES. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed to the extent of said conflict. N c� SECTION 4: INCLUSION IN CODE OF ORDINANCES.
