MEMORANDUM OF UNDERSTANDING
BETWEEN
MONROE COUNTY SHERIFF'S OFFICE
AND
MONROE COUNTY FIRE RESCUE
FOR
THE ESTABLISHMENT AND ACCOMMODATION OF
THIRD-PARTY CONNECTIVITY TO THE MONROE
COUNTY SHERRIFF'S DEPARTMENT SMART
MOBILE NETWORK
This Memorandum of Understanding (MOU) is made and entered into this 'h day of ,
2022 by and between the Monroe County Board of County Commissioners, a political subdivision
of the State of Florida ("County") and Sheriff Richard A. Ramsay in his official capacity as Sheriff
of Monroe County, Florida.
1. PURPOSE: This MOU between the Monroe County Sheriff's Office, hereafter referred to as
MCSO and the Monroe County Fire Rescue, hereafter referred to as MCFR," memorializes each
party's responsibilities with regard to establishing connectivity to records services accessible via
the Smart Mobile Network.
2. BACKGROUND: The requesting organization, MCFR,being approved for access to systems of
fire and emergency services records accessible via Smart Mobile,desires connectivity via a secure
web connection through the SmartMobile application that contains encrypted services.
To ensure that there is a clear understanding between the parties regarding their respective
roles in this process, this MOU memorializes each party's responsibilities regarding the
development, operation, and maintenance of third-party connectivity to Smart Mobile. Unless
otherwise contained in an associated contract, the enclosed terms apply. SCOPE:

a. The Monroe County Sheriffs Office agrees to:
i.Provide access to the CAD data and configure the SmartMobile application for use
by the MCFR to view only fire rescue and emergency management data.
b. The Monroe County Fire Rescue agrees to:
i. Coordinate requests for third-party connectivity to Smart Mobile or the Secure
VPN with the Monroe County Sheriff s Office I.T Division.
ii. Purchase hardware and software that are compatible with Smart Mobile.
iii. Transport only official,authorized traffic over the in the use of the SmartMobile
application.
iv. Provide a POC and telephone number for MOU-related issues.
v. Install the Mobile Device Manager(MDM) specified by MCSO on each device
that will run Smart Mobile.
vi. All users will abide by CJIS and MCSO policies.
vii. All users will complete a fingerprint based background check in order to be
granted access in accordance with the CJIS FBI Security Policy.
viii.All users will complete level 2 or higher CJIS Security awareness training/test.
ix. All users will log on to Smart Mobile using their own credentials, which must
not be shared. Violation may terminate access to Smart Mobile.
x. The MCFD will notify MCSO of the following;
• Any user that is no longer employed

• Any user that breached policy. Users can face discipline up to and
including revocation of their access to Smart Mobile.
• The loss or discontinued usage of any device running Smart Mobile.
2 FUNDING: There are no reimbursable expenses associated with this level of support. Each
party will fund its own activities unless otherwise agreed to in writing. This MOU is not an
obligation or commitment of funds,nor a basis for transfer of funds,but rather is a basic statement
of understanding between the parties hereto of the nature of the relationship for the connectivity
efforts. Unless otherwise agreed to in writing, each party shall bear its own costs in relation to this
MOU. Expenditures by each party will be subject to its budgetary processes and to the availability
of funds and resources pursuant to applicable laws,regulations,and policies. The parties expressly
acknowledge that the above language in no way implies that the BOCC will appropriate funds for
such expenditures.
3. SETTLEMENT OF DISPUTES: Disagreements between the parties arising under or relating
to this MOU will be resolved only by consultation between the parties and will not be referred to
any other person or entity for settlement.
1. Notice Requirement. Any notice required or permitted under this Agreement shall be in writing
and hand delivered or mailed, postage pre-paid, to the County by certified mail, return receipt
requested, to the following:

7. AMENDMENT, TERMINATION, ENTRY INTO FORCE, AND DURATION:
a. All activities of the parties under this MOU will be carried out in accordance with the
above- described provisions.
b. This MOU may be amended or terminated by the mutual written consent of the parties'
authorized representatives.
c. Either party may terminate this MOU upon 30-days written notification to the other
party. Such notice will be the subject of immediate consultation by the parties to decide
upon the appropriate course of action. In the event of such termination,the following rules
apply:
i. The parties will continue participation, financial or otherwise, up to
the effective date of the termination.
ii. Each party will pay the costs it incurs as a result of the termination.
iii. All information and rights therein received under the provisions of
this MOU prior to the termination will be retained by the parties, subject to
the provisions of this MOU.
8 FORCE AND EFFECT: This MOU, which consists of nine numbered sections, will enter into
effect upon signature of the parties and will remain in effect for 3 years. The parties should review
the contents of this MOU annually to determine whether there is a need for the deletion, addition,
or amendment of any provision. This MOU is not intended,and should not be construed, to create
any right or benefit, substantive or procedural, enforceable at law or otherwise by any third party
against the parties, their parent agencies, the United States, or the officers, employees, agents, or
other associated personnel thereof.
The foregoing represents the understandings reached between the parties.
