RESOLUTION NO.034 -1999
A RESOLUTION DIRECTING THE COMMENCEMENT OF THE SEC. 189.428.
F.S.. OVERSIGHT REVIEW PROCESS FOR THE MONROE COUNTY
MOSQUITO CONTROL DISTRICT (DISTRICT); PROVIDING FOR THE
PREPARATION OF A REPORT CONTAINING AMONG OTHER ITEMS AN
ANALYSIS AND RECOMMENDATION CONCERNING THE DISSOLUTION OF
THE DISTRICT; PROVIDING FOR THE CONSIDERATION AND ADOPTION OF
SUCH A REPORT AT A PUBLIC MEETING OF THE COUNTY COMMISSION;
AND PROVIDING THAT. IF THE REPORT ADOPTED BY THE COUNTY
COMMISSION RECOMMENDS THE DISSOLUTION OF THE DISTRICT. THE
FILING OF THAT REPORT WITH THE LEGISLATURE
WHEREAS, the Board of County Commissioners voted at their December 9, 1998 regular
meeting to request the Monroe County legislative delegation introduce a special act in the
1999 session of the Legislature abolishing the Monroe County Mosquito Control District (District)
and consolidating its functions within County government; and
WHEREAS, the members of the legislative delegation have requested that the County
Commission conduct the oversight review of the District authorized by See, 189.428, F.S" prior to
making a final request for the dissolution of the District, now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA:
Section 1 .\
The County Commission hereby determines to undertake an oversight
review of the District pursuant to Sec. 189.428, F.S. In undertaking such a review, particular (but
not sole) attention must be given the following criteria:

a.) Whether there is a less costly alternative method of ~~n~th~

services currently provided by the District; and
b,) Whether the transfer of the responsibility for delivery of the mosquito
control services to the County government could be accomplished without jeopardizing the
District's existing contracts, bonds, or other outstanding indebtedness.

The County Administrator is directed to immediately commence
the review process and may utilize in carrying out the review whatever County staff he
determines are necessary, The County Administrator is also authorized to employ an
independent management consultant and (if necessary) an auditor, without further action of
the County Commission, so long as the contracts do not equal or exceed $25,000,
b,) The County Administrator must keep the County Commission members
informed of the progress of his review with written updates furnished the members weekly
(which are public records) plus an update report at the February County Commission meeting.
c.) The County Administrator shall prepare a draft of a final report and
present the draft to the County Commission for consideration at a public hearing at a meeting
of the County Commission, If the dissolution of the District by the Legislature is proposed in the
final report, then the report must also propose a plan for the dissolution. That plan must
address the following factors in evaluating the proposed dissolution:
(i) Whether, in light of independent fiscal analysis, level-of-service
implications, and other public policy considerations, the proposed
dissolution is the best alternative for delivering mosquito control services
to the District area;
(H) Whether the mosquito control services to be provided pursuant to
dissolution will be compatible with the capacity and uses of existing local
services and facilities;
(iii) Whether the dissolution is consistent with applicable provisions of the
state comprehensive plan, the strategic regional policy plan, and the
local government comprehensive plans of the District area;

(iv) Whether the proposed dissolution adequately provides for the
assumption of all District indebtedness,
d.) If, at the public hearing, the County Commission adopts a final report
that recommends the dissolution of the District, the report must then be filed with the
Legislature and the County legislative delegation. The County legislative delegation will then
be requested to introduce a special act dissolving the District.
