A RESOLUTION REQUESTING THAT MONROE COUNTY'S LEGISLATIVE
DELEGATION INTRODUCE AN AMENDMENT TO CHAPTER 380, PART I, F.S., TO
ALLOW FLORIDA KEYS CRITICAL AREA LOCAL GOVERNMENTS TO ADOPT
ORDINANCES THAT HAVE A 30-DAY TIME PERIOD FOR ON-SITE SEWAGE
SYSTEMS TO CONNECT TO A CENTRAL SYSTEM WHEN THE CENTRAL SYSTEM
BECOMES AVAILABLE,
WHEREAS, due to the sensitive ecology of the Florida Keys area of critical state
concern, its immediate proximity to living coral reefs, and the adverse impact of

WHEREAS, general law presently allows 365 days for the properties ~!lf2n-~

sewage systems to connect to a central sewage system, beginning with the~atgw~
connection to the central sewage system first becomes available; and
WHEREAS, coordinated simultaneous hookup of neighborhoods will reduce
hookup costs to residents and will minimize the disruption of excavation and
infrastructure work; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA:
Section .1) Monroe County's state legislative delegation is hereby requested
to introduce legislation amending Chap. 380, Part I, F.S" in order to enact as general
law the following:
Notwithstanding any provision of general or special law to the contrary, a
local government within the Florida Keys area of critical state concern

may enact an ordinance that requires: (1) connection to a central
sewerage system within thirty days of notice of availability of service; and
(ii) provides a definition of on-site sewage treatment and disposal systems
that does not exclude package sewage treatment facilities unless such
facilities are in full compliance with all regulatory requirements and treat
sewage to advanced wastewater treatment standards or utilize effluent
reuse as their primary method of effluent disposal.
Section 2.\ The Clerk of the Circuit Court is directed to send a certified copy of
this Resolution to the members of the Monroe County delegation to the Legislature of
the State of Florida.
