TASK ORDER
FOR PROFESSIONAL ARCHITECTURAL AND ENGINEERING SERVICES
BETWEEN MONROE COUNTY AND BENDER &ASSOCIATES ARCHITECTS, P.A.
FOR SPALLING REPAIRS AT THE GATO BUILDING
In accordance with the Agreement for Professional Architectural and Engineering Services, made
and entered into on December 19,2018,between MONROE COUNTY, ("County")and BENDER
& ASSOCIATES ARCHITECTS, P.A., ("Consultant"), where professional services are allowed
if construction costs do not exceed $4,000,000.00, or for study activity if the fee for professional
services for each individual study under the contract does not exceed$500,000.00 ("Agreement"),
as provided in Subsection 287.055(2)(g),Florida Statutes, as amended by Section 2, Chapter 2020-
127, Laws of Florida, pursuant to which Attachment A, Subsection 1.01 of the Agreement is
hereby modified, the parties enter into this Task Order.
All terms and conditions of the Agreement apply to this Task Order, unless this Task Order
amends, adds, or modifies a provision or an Article of the Agreement of which will be specifically
referenced in this Task Order and the amendment, addition, or modification shall be precisely
described. These additions apply only to the project referenced in this Task Order.
This Task Order is effective on the 151h of November, 2022.
WHEREAS, the Gato Building in Key West is an iconic structure and a significant contributing
resource in the Key West Historic District, and
WHEREAS, all work at the Gato Building is required to be in compliance with the City of Key
West HARC Board, Secretary of Interior's Standards for Rehabilitation, and any other
requirements of the State Division of Historical Resources.
NOW, THEREFORE, in consideration of the mutual promises and covenants set forth below, the
parties agree as follows:
1. In accordance with Article H, SCOPE OF BASIC SERVICES of the Agreement, the
Consultant will complete construction drawings to repair spalling throughout the building.
Services provided shall include:
• Spalling assessment and structural design work on the entire building, exterior and
interior.
• An electronic (PDF) set of Construction Drawings and Technical Specifications,
signed, and sealed as required for permitting.
• Permitting assistance, including the State of Florida Division of Historical Resources,
the Historic Architecture Review Commission, and the City of Key West Building
Department.

• Bidding support services, including pre-bid meetings and Addendums.
• Construction Administration services, including weekly jobsite meetings, Information
Bulletins, Payment Application approval, and closeout documents.
2. In accordance with Article VII paragraph 7.1.1 of the Agreement,the County shall pay
the Consultant a lump sum total of Seventy-Five Thousand Eight Hundred Seventy and
00/100 Dollars ($75,870.00)paid on a percent complete basis for the following phases:
a. Existing Conditions Assessment and schematic Design Drawings of spalling for
the entire Gato Building - $25,350.00 upon completion of site visit, document
review and approval by the Director of Project Management
b. Construction Documents - $18,310.00 upon document review and approval by the
Director of Project Management
c. Bidding Phase- $ 3,090.00 upon completion
d. Construction Phase Contract Administration - $22,620.00 upon completion
e. Reimbursable expenses - $6,500.00
All other Terms and Conditions of the Agreement remain unchanged and in full force and effect.
