RESOLUTION 394-1997
WHEREAS, Mr.. and Mrs. Burnham have submitted an application for a building permit
allocation under th~I?~~ling Unit Allocation Ordinance, commonly known as the Rate of Growth
Ordinance or "ROGO'" and

WHEREAS~Mr.and Mrs. Burnham's application has been in the system for at least four (4)

years; and
WHEREAS, Monroe County has made an offer to purchase Mr. and Mrs. Burnham's
propertY, which offer has been rejected; and
WHEREAS Monroe County does not wish to acquire the property through eminent domain
proceedings; and
WHEREAS, Mr. and Mrs. Burnham's property is not environmentally-sensitive land, but a
disturbed, scarified lot within an existing, nearly built-out Improved Subdivision served by existing
infrastructure; and
WHEREAS, Mr. and Mrs. aurnham would have received a building permit allocation with
minor design and construction ch~ges; and
WHEREAS, Mr. and Mrs. Burnham~s application scored 15 points in the last allocation; and
WHEREAS only 19 PouUs.were required to obtain an allocation in the last ROGO allocation
for the Upper Keys; and

WHEREAS, Mr. and Mr. BllJ.11ham.'s application will receive one (1) additional perseverance
point in November 1997; and
WHEREAS, with this Or1e (I) additional perseverance point only three (3) additional
design/constrUction points are requited for tQ.e Burnhams to receive an allocation; and
WHEREAS, the Board of C(\\1111ty Commi~sioners has the authority to granta<4ninistrati~
relief to an applicant ",110 meets the. criteria set forth in Code ~9 .5-122 (h), anet the BOCC has'.
previously detelmined that the applicant meets those criteria.: .
BE IT RESOLVED, as follows:

1. Mr. and Mrs. Burnham are hereby awarded a building permit allo~~tibn in~!he
November 1997 ROGO allocation to be deducted from the total number of permits avaj:table,under-
the Year 2010 Monroe County Comprehensive Plan with the following conditions: ;7
a. Installation of low-flow plumbing fixtures generally available in Monroe County
hardware shops (which will result in one (1) additional ROGO point); and

b. Exceedance of the wind load standard contained in ASCE Standard #7-95
(adopted by Ordinance No. 016-1997, effective May 20, 1997) by five (5) mph
(which will result in two (2) additional ROGO points).
2. Mr. and Mrs. Burnham may also substitute any of the design or construction features
listed in Monroe County Code ~9.5-121.1 to obtain these additional points, including plans
demonstrating an EPI energy efficiency rating of 70 or better; air conditioning units rated at 12
(SEER/HV AC) or better; a solar panel serving an electric hot water heater; or a secondary cistern
or secondary reverse osmosis facility.
3. Upon submittal of revised construction drawings demonstrating compliance with the
above-listed conditions and payment of the building permit fee, the Building Official shall issue a
building permit pursuant to this Resolution.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County,
Florida, at a regular meeting of said Board held on the 15th day of October, A.D., 1997.
