A RESOLUTION DIRECTING THE PUBLIC WORKS DIVISION AND THE COUNTY
ENGINEER TO INITIATE DISCUSSIONS WITH THE STATE OF FLORIDA AND THE CITY OF
KEY WEST TOWARD CONSOLIDATING OWNERSHIP OF, AND MAINTENANCE
RESPONSIBILITIES FOR, All THE STREETS OF THE CITY OF KEY WEST, FLORIDA
WHEREAS. ownership of, and maintenance responsibilities for. streets and roads on the Island
of Key West ("City Streets") are divided among the City of Key West ("The City"), Monroe County
and the State of Florida; and
WHEREAS. such division of ownership and maintenance invites confusion and has produced
numerous tort lawsuits naming all three government entities as defendants at substantial cost; and
WHEREAS, the existence of multiple jurisdictions on City Streets impedes the City's ability to
regulate commercial vehicle traffic; now, therefore
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY. FLORIDA:
Section 1.
The Division of Public Works and the County Engineer are directed to initiate
discussions with the State of Florida and The City toward consolidating ownership of, and
maintenance responsibility for, all City Streets in The City.
Section 2.
At the time any City Streets are transferred from Monroe County to The City, an
equitable adjustment shall be made in City-County division of gas tax revenues. substantially
equivalent to the resulting reduction in County road maintenance costs.
