FOR KEY WEST LIGHTHOUSE STABLES BUILDING AND ADA RENOVATIONS In accordance with the Consultant Agreement for Professional Architectural and Engineering Services, made and entered into on December 19, 2018 between MONROE COUNTY, ("County") and BENDER & ASSOCIATES ARCHITECTS, P.A. , ("Consultant"), where professional services are allowed if construction costs do not exceed $4,000,000.00, or for study activity if the fee for professional services for each individual study under the contract does not exceed $500,000.00 ("Agreement"), as provided in Subsection 287.055(2)(g), Florida Statutes, as amended by Section 2, Chapter 2020-127, Laws of Florida, pursuant to which Recital No. 2 and Attachment A, Subsection 1.01 of the Agreement is hereby modified, the parties enter into this Task Order with an effective date of November 15, 2022 ("Task Order"). All terms and conditions of the Agreement apply to this Task Order, unless this Task Order amends, adds, or modifies a provision or an Article of the Agreement of which will be specifically referenced in this Task Order and the amendment, addition, or modification shall be precisely described. This Task Order is effective on the 15th day of November 2022. WHEREAS, the Key West Lighthouse is a significant historic resource in Key West and, as such, all work is required to be in compliance with the Secretary of Interior's Standards for Rehabilitation and any other requirements of the State Division of Historical Resources; and WHEREAS, the Key West Lighthouse, as a Monroe County facility, needs professional architectural and engineering services to develop new ADA-compliant restrooms and provide renovations to its Stables Building. NOW, THEREFORE, in consideration of the mutual promises and covenants set forth below, the parties agree as follows: 1. In accordance with Article II, SCOPE OF BASIC SERVICES of the Agreement, the Consultant will provide design and support services for the development of the scope of construction work. The scope of services will include the following tasks: • Verify the existing conditions at the Key West Lighthouse • Procure all HARC approvals • Provide two sets of construction documents o One for the complete desired scope of this project and one showing a reduced scope, as to what can be afforded with the existing TDC funding. • Assist in the bidding process • Provide construction administration services, for: o Construction of a new 250 square foot Restroom building containing 3 new unisex restrooms o Construct a new 250 square foot retail storage building Page 1 of 2 o Renovate the existing Gift Shop, removing one restroom and converting it to storage and move the checkout area to provide more retail space. 2. In accordance with Article VII paragraph 7.1.1 of the Agreement, the.County shall pay the Consultant a lump sum total of Sixty-Three Thousand Four Hundred Seventy-Nine and 00/100 dollars ($63,479.00) paid upon completion of the drawings and services and approval by the Director of Project Management paid on a percent complete basis for the following phases: a. Existing condition and design drawings $22,217.00 b. Construction documents $22,217.00 c. Bidding Phase $3,173.00 d. Construction phase contract administration $15,872.00 All other Terms and Conditions of the Agreement remain unchanged and in full forces and effect.
