RE:
Insurance for NAPA vendor in Marathon (NAPA parts contract)
...................................
As we discussed, the NAPA franchisee in Marathon has gone out of business. NAPA
has indicated that they hope to have a new franchisee in Marathon soon. Since the
contract is non-exclusive, you may purchase parts from other Marathon vendors.
Obviously, then insurance for the Marathon NAPA outlet is unnecessary until such
time as there is, in fact, a Marathon outlet and the County elects to make its
purchases from them. At that point, the insurance becomes important and the
vendor must provide proof of insurance before you can make any purchases from the
Marathon NAPA vendor. However, I do not believe this unfortunate state of affairs
prevents the Mayor from executing the NAPA contract on behalf of the County.
(Later, when a new NAPA vendor is available in Marathon, if that vendor is a
different corporate entity than the one that pulled out, then the BCC will have to
approve the substitution of the new NAPA vendor. At the moment that is a problem
for a later day.)
