Please review the attached drawings, sheets E-1 through E-6, dated
4-14-98. If you have any changes to the drawings, such electrical
outlets and telephone jack locations, indicate those changes on
drawings and return the drawings to Gonzalez Architects to insur~ your
changes are implemented. If no changes are necessary, please initial
this letter and fax it to my office indicating your approval.

Dear Jose':
There were additional costs on the above-stated project, which have been paid to
contractors, by Monroe County, due to Inaccuracies In the construction documents.
First, the Site Plan, sheet 51-1, did not Indicate an existing change In elevation at the Lester
Building and that stairs and a retaining wall would be required In that area of the new
sidewalk. Th"cost Monroe County an additional $3,979.21, all of Which)8'GOnZalez
Architects Is responsible for. See attached approved Change Order #10.
second, the Clerk of court's mailboxes were not designed to meet the needs of the Clerk.
Therefore, Mr. Kolhage required the mailboxes to be removed, reconstructed, and
enlarged. This cost Monroe County an additIonal $6,152.34. However, Gonzalez Architects
Is only being held responsible for the removal and replacement of the original mailbox
Installation which cost $2,382.04. See attached approved Change Order #10.
Third, the built-In desks for the Public Counter/Queue area and in Room 1038 were shown
to 36" high and were constructed as designed. However. this casework had to be
reworked to lower it to the standard desk height of 30". This cost Monroe county an
additional $4,015.60 for Gonzalez Architects Is responsible. See attached approved Change
Order #9.
Fourth, as the property Appraiser, the Clerk of Court and Commissioner spehar prepared
to move Into the building it was discovered that there was Inadequate pressure to flush
the toilets. GOnzalez Architects was Informed of this potential problem during design.
Immediate action was now required so a temporary system was ordered and Installed
prior to the building being occupied. Tests were performed by Public works to determine
whether there was a leak in the lines causing the problem. The test showed that this was
not the case. See attached test results. Thus a permanent pressure system was
engineered, fabricated, delivered and Installed to solve the problem. Monroe County paid
Gonzalez Architects for full engineering services to ensure problems SUCh as this dO not
arise. To correct this problem Monroe County paid a total of $18,142.00. This Is Gonzalez
Architects responsibility.
The total of these cost. ...ctributed to inadeQuacies in the corl_Juction documents is
$28,518.85. Please let my office when to expect repayment.

There are two important Issues that we have repeatedly asked for your assistance in order
to insure commissioner Spehar, Mr. Kolhage and Mr. Higgs a smooth transition to their
new offices.
The first Issue is the lack of water pressure and volume to flush the toilets in the building.
This problem was brought up by Rovel construction on RFI118 dated 313/99. The engineer
responded that there would be no problem with the two-Inch line as long as the line was
not blocked, and that a larger line was not needed. When we last spoke I Informed you
that we have a new two-Inch line from the meter to the building but we stili have a
pressure problem. You stated that you would contact the engineer and get back to me.
The second Issue concerns Mr. Kolhage's mallroom. Mr. Kolhage stated that he has spoken
with you several times In the past about the InadeQuate size of the mailboxes. You
responded that you would take care of the problem. Mr. Kolhage's office called and said
that the problem Is not resolved.
As we have not been able to get these critical Issues resolved through your office, and the'
move In dates begin on 16 April 2001, we have been forced to act IndependentlY and
Immediate action on to resolve these problems.

We are at the most critical stage In this project. It Is Imperative that all of the outstanding
Issues be resolved so as not to hold up the scheduled moving dates of Commissioner
spehar, Mr. Kolhage and Mr. Higgs. The final Punch List meetln,g Is scheduled for this
Thursday, the new furniture Is scheduled for delivery on 02 April, etc. Therefore the
critical path schedule leaves only a short period of time to complete punch list Items and
to resolve these outstanding Issues.
The outstanding Issues are as follows:
1. The architectural Issues holding up the certificate of occupancy.
2. Mr. Kolhage's mailbox design.
3. Revised plans required by the Key west Building Department.
4. Response to outstanding Requests for Information.
5. Recommendation on outstanding Change Order Requests.
Please respond as soon as possible to take care of these Issues In the tlmeframe required.

I have taken the liberty of conducting a water pressure test, at the recenUy renovated Courthouse
located at Jackson Square. This test included monitoring the water supply pressure at a janitor sink on
the third floor while flushing different combinations of toilets throughout the building. No more than two
(2) toilets were flushed at the same time with a sixty-second Interval between flushes.
The pressure at the third floor was indicated at twenty-two (22) psi, the same pressure noted by a
previous Construction Management and FKAA investigation. Immediately after flushing two (2) toilets
on the first floor the pressure dropped to eight- (8) psi. One minute later I directed staff to flush two
more toilets on the second floor, they did not function property and the water pressure dropped again,
this time to four- (4) psi. This procedure was repeated again by flushing two more toilets on the third
floor, now the pressure gauge indicated.zero (0) psi. . .
The new facility has a total of eighteen (18) toilets, twenty-one (21) sinks and three (3) urinals with the
majority located on the second and third floors. The water supply for the facility is provided via a two-
(2) inch PVC schedule 40 pipe that also supports the facilities irrigation system.
It is very apparent the existing water volume and pressure will not accommodate the facility's water
requirements especially during moderate to heavy use periods. I will try to calculate the volume
required for the water storage tank and size the in-Jine pump system to provide a constant pressure for
the flush-o-meters. Locating a space for the placement of the tank and pump is limited, due to access
of the water line itself. I am also concemed with the reported condition of the existing two- (2) inch water
line. ApparenUy it was damaged numerous times during the site work phase of the project and has
multiple 90 degree turns installed to avoid other new underground utilities. This itself is problematic
when considering using the line under a higher than nonnal pressurized system.
I plan to consult the contractor that installed the water pumps at the Detention Facility, in order to
expedite the solution to this problem. As you are aware, the facility has been given a temporary
certificate ot occupancy and will be occupied in a few weeks. I will keep you intonned as to my progress
and will be consulting my procedures with Dave Koppel and the Construction Management Cept.

I met with Ed Nicole In reference to the lack of water pressure on the third floor of
the Addition. We tested only 30 pounds of pressure in the janitor's closet. This
would be consistent with the inability to operate the Flushometers in both the
Men's and Ladies Rooms on the third floor. It is Ed's Recommendation that we
install a pump to increase the pressure. A pump could be installed in line at the
back of the Lester Building and housed in the room that contains the Sprinkler
pump. I would suggest the possibility of this being done in-house or sent out for
proposal.

Key West Courthouse Water Main Leak Test 7 -
RE:
Monroe County Facility Maintenance Plumber Foreman, Fred Gartenmayer, conducted a leak test,
Work Order #3238, on the two inch waterline that supplies potable water to the recently renovated
Key West Courthouse. The test was conducted on June 7, 200 I. The section of waterline tested
started at the FKAA meter and ended at the point of connection with the new pump system. The
isolation valve was shut that feeds 310 Fleming St. and 510 Thomas St.
The FKAA installed water meter has a leak detector indicator visible on the site glass. After the line
was isolated at the valve and pump system, FKAA pressure was maintained with no leaks and or
water flow detected.

RE: Old Courthouse Renovation & Addition - Inadequate Water Pressure
Dear Jose:
The problem of inadequate water pressure was discovered just before the building
was to be occupied. This was a serious problem that required immediate action, so a
temporary system was ordered and installed prior to the building being occupied. Monroe
County Construction Management (MCCM) sent several letters to you requesting
assistance to resolve this problem. Inasmuch as we did not receive a response from you,
we had to hire someone to engineer, fabricate and install a system to correct the problem.
The problem ,was finally resolved by installing a pump pressure system to supply the
additional pre'ssure needed, There were different tests performed to insure that this was
not due a leak in the line, and you were provided with the test results in a letter from
MCCM dated June 19, 2001. Monroe County paid a total of $18,142.00 to correct the
problem, and we believe that Gonzalez Architects is liable for these charges.
Please give me a call to discuss this matter as soon as possible.

RE: Old Courthouse Renovation & Addition - Humidity Problem
Dear Jose':
According to the ASH RAE standard 621-989R, dated August 1996, "Mechanical systems
installed ih humid climates shall be capable of maintaining the daily average relative
humidity no greater than 60% during occupied periods, and no greater than 70% during
unoccupied periods, in all occupiable spaces served by the system at expected full load
and part load conditions". The humidity readings recently taken are considerably higher
than considered acceptable.
I have received reports of mold growing on the newly purchased furniture and in the
files, including Commissioner Spehar's area. Please provide a solution, as this problem
must be taken c soon as possible.
