RESOLUTION NO. 483 - 1998
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, REVISING RESOLUTION NO. 293-1998, IN ORDER TO CORRECT AN ERROR
ON THE SURVEY LEGAL DESCRIPTION OF AN ABANDONED PORTION OF SIXTH
AVENUE WEST, CUDJOE GARDENS SIXTH ADDITION, MONROE COUNTY, FLORIDA
WHEREAS, the survey submitted with the road abandonment petition granted by
Resolution No. 293-1998 had errors in the legal description; and
WHEREAS, petitioner requested abandonment of a portion of Sixth Avenue West
Cudjoe Gardens Sixth Addition, Cudjoe Key, depicting a trapezoidal area considerably larger
than the area which was covered by the legal description: and
WHEREAS, the corrections to the legal description which are necessary to align the area
abandoned with the lot line between Lot 15 and Lot 16 will result in an area smaller than that
crosshatched in the survey exhibit of the road abandonment petition: and
WHEREAS, the original western arced line of the cross-hatched area of the original
survey will be reduced from 7 feet to 3.13 feet thereby reducing the area drawn as the
abandonment; now, therefore,
BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA, that the Board hereby renounces and disclaims any right of the County and the
public in and to the following described streets, alley-ways, roads or highways as delineated on
the hereinafter described map or plat to-wit:
Commence at the Southeast corner of Lot 16, Block 19, Cudjoe Gardens Sixth
Addition, according to the Plat thereof as Recorded in Plat Book 6, Page 66 of
the Public Records of Monroe County, Florida, said point to be known as the
Point of Beginning; thence run S26045'E, 15.91 feet: thence N63015'E, 25.00 feet: \D ."
