AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY,
FLORIDA, REVOKING ORDINANCES NO. 039-1996, 040-1996, 041-1996, 042-1996, AND
058-1996; ESTABLISHING RULES OF CONDUCT AND OPERATIONAL PROCEDURE FOR:
BAY POINT PARK, BERNSTEIN PARK, BIG COPPITT PARK, PALM VILLA PARK, WILHELMINA
HARVEY PARK, COCO PLUM BEACH PARK, JESSE HOBBS PARK, LITTLE DUCK KEY PARK,
SOMBRERO BEACH PARK, ANNE'S BEACH, ISLAMORADA PARK, AND OLD SETTLERS PARK,
BY PROVIDING FOR RESTRICTIONS ON ALCOHOLIC BEVERAGES; POSTING OF SIGNS
REGARDING DRUG POSSESSION AND EXCHANGE; HOURS OF OPERATION; PROCEDURES
FOR USE FOR SPECIAL EVENTS, ASSEMBLIES AND OTHER RECREATIONAL ACTIVITIES;
PROVIDING FOR SEVERABILITY; PROVIDING FOR THE REPEAL OF ALL ORDINANCES

BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA,
Section 1. Monroe County Ordinances No. 039-1996, 040-1996, 041-1996, 042-1996, and
058-1996 are hereby revoked. ,

Section 2. Sec. 13.5-4(d) is hereby amended to read to follows: �T
A. Definitions.

1. Alcoholic beverages means distilled spirits and all bevgragesl
containing one half of one percent or more alcohol by volume. The perceniige of
alcohol by volume is determined by measuring the volume of the standar+p ethyl^
alcohol in the beverage and comparing it with the volume of the remain'der as
though the remainder ingredients were distilled water.
2. Bay Point Park means the area described as follows:
Lots 13, 14, 15, 16, 17, 18, 19 and 20, Block 2, Bay Point Amended Plat, Bay Point Key
according to the Plat thereof as recorded in Plat Book 3, Page 75 of the Public
Records of Monroe County, Florida, RE#'s 00160060, 00160070. 00160080, 00160090,
00160100- 0160130.
3. Bernstein Park means the area described as follows:
Lots 1, 2, 3, 4 and 5, Block 57, George L. McDonalds Plat of Part of Stock Island, less the
Westerly eight feet (8') of Lot 1 and less the Easterly thirty feet (30') of Lot 5, according
to the plat thereof as recorded in Plat Book 1, Page 55, of the Public Records of
Monroe County, Florida. Also, a parcel of submerged land lying South of said Block
57, less that portion sold to Stock Island Utility Company by Warranty Deed recorded
in Official Records Book 866, Pages 2446-2450, of the Public Records of Monroe
County, Florida, TWP .67/68 RNG. 25 SEC. 35, 36 & 2 RE# 12385 OR 380-381-382.
4. Big Coppitt Park means the area described as follows:
Block 4, Lots 3, 4 and 5 Coppitt Subdivision Amended Plat, Big Coppitt Key, OR: 761-
408, Plat Book: 4-50, Section 22, Township 67S, Range 26E.
5. Palm Villa Park means the area described as follows:
Park -Palm Villa, Big Pine Key RE# 00285080-000000; Plat Book 1-89, Section 23, Township
66S, Range 29E (.61 acres)
6. Wilhelmina Harvey Park means the area described as follows:
Block 2, Lot 4, 5, 6 and 7, Amended Plat of Coppitt Subdivision, Section 22, Township
67S, Range 26E as recorded in Plat Book 4, Page 50 of the Public Records of Monroe
County, Florida. Said Amended Plat is a resubdivision of that subdivision originally
recorded in Plat Book 3, Page 116.
7. Coco Plum Park means the area described as follows:
Lots 33 through 40, plus the Westerly 1/2 of Lot 41, Block 21, Coco Plum Beach
Subdivision, according to the plat thereof as recorded in Plat Book 4, Page 166 of the
Public Records of Monroe County, Florida.
8. Jesse Hobbs Park means the area described as follows:
Lot 1, Block 1, Marathon Beach Subdivision, as recorded in Plat Book 2, Page 16, of the
Public Records of Monroe County, Florida, and part of Lot 2, Block 1, Marathon Beach
Subdivision, as recorded in Plat Book 2, Page 16, of the Public Records of Monroe
County, Florida, and better described as: Commencing at a point of said Lot 2, Block
1, which said point is 100 feet, from the Overseas Highway, and running in a Northerly
direction along First Avenue, 50 feet, thence at right angles in an Easterly direction 125
feet; thence at right angles in a Southerly direction 50 feet; thence at right angles in a
Westerly direction, 125 feet, to the Point of Beginning. RE# 00336470 & RE# 00336490.
9. Little Duck Key Park means the area described as follows:
Little Duck Key, Lot 1, Section 19, Township 66S, Range 31E, OR: 15-374-376, RE#
00106160-000000; Alternate Key: 1124800.
10. Sombrero Beach Park means the area described as follows:
Boot Key, Pt. Lot 7, Section 15, Township 66S, Range 32E, OR: 544-210-214 RE# 00104820-
000000.
11. Anne's Beach Park means the area described as follows:
The southeasterly 50 feet of State Road Number 5 (US1) right-of-way, as shown on
Florida State Department of Transportation Right of Way Map for Section 90050 lying in
the NW 1/4 of Section 29 and extending to the NE 1/4 of Section 30, Township 64
South, Range 36 East, in Lower Matecumbe Key, Monroe County, Florida, and being
more particularly described as follows: Commence at the most westerly corner of
Tract "A" of "Lower Matecumbe Beach," according to the plat thereof as recorded in
Plat Book 3, at Page 34, of the Public Records of Monroe County, Florida, said point
being 50.00 feet southeasterly of station 724+00 of the Baseline of said Right of Way
Map; thence run S33026'01 "E, along the most southwesterly line of said Tract "A" for a
distance of 100.00 feet to the intersection with a line 150 feet southeasterly and
parallel with the Baseline of said Right of Way Map and the POINT OF BEGINNING;
thence continue S33026'01 "E, along the most southwesterly line of said Tract "A" and
its extension, for a distance of 50.00 feet to the intersection with the southeasterly right-
of-way line of SR5 as shown in said Right of Way Map; thence run S56035'59"W, along
said right-of-way line for a distance of 2,747.67 feet to the West line of the NW 1/4 of
said Section 29, as shown in said Right of Way Map; thence continue S560 35'59"W,
along said southeasterly right-of-way line now in the NE 1/4 of said Section 30, for a
distance of 152.33 feet more or less to the shore line; thence run on a mean bearing of
S750 00'05"W meandering along said shore line for a distance of 158.11 feet more or

less to the intersection with a line 50.00 feet northwesterly and parallel with the
southeasterly right-of-way line of SR5 as shown in said Right of Way Map thence run
N560 33'59"E, from said shore line along the last described parallel line for a distance
of 335.11 feet more or less to the East line of the NE 1/4 of said Section 30; thence
continues N56033'59"E, back in the NW 1/4 of said Section 29, along said line 50.00 feet
northwesterly and parallel with the southeasterly right-of-way line, for a distance of
2,714.89 feet to the POINT OF BEGINNING. Also those lands lying contiguous to and
southeasterly of the above described lands lying above the mean high water line.
LESS AND EXCEPT: Those lands conveyed by Trustees deed #21721(05-44) which bound
the northeast end of above described property and described in said deed as
follows: A parcel of submerged land in the Straits of Florida in Section 29, Township 64
South, Range 36 East, adjoining the southwesterly end of Lower Matecumbe Key,
Monroe County, Florida, more particularly described as follows: From the most
westerly corner of Tract A, according to plat of Lower Matecumbe Beach recorded in
Plat Book 3 at Page 34, Public Records of Monroe County, Florida, run S32°53' E along
the southwesterly side of Trace A, a distance of 135 feet more or less to the mean high
tide line on the shore of the Straits of Florida and the point of beginning of the parcel
hereinafter described; thence continue S32053' E, a distance of 410 feet; thence
S72053' E, a distance of 250 feet; thence North 57007' E, a distance of 480 feet more or
less to the westerly edge of an existing channel, as shown on said plat of Lower
Matecumbe Beach; thence northerly and northeasterly meandering said edge of
existing channel, a distance of 240 feet more or less to the mean high tide line at the
most southerly corner of Lot 24, Block 2, according to said plat of Lower Matecumbe
Beach; thence westerly meandering said mean high tide line, a distance of 950 feet
more or less to the point of beginning.
12. Islamorada Park means the area described as follows:
Government Lot 1, Section 32, Township 63S, Range 37E, beginning at a point, being
the intersection of the Easterly right of way line of the Florida East Coast Railway with
Northeasterly boundary line of Lot 1 of MacDonald's Subdivision of Government Lots 1,
2, and 3 of the aforesaid Section 32, according to Plat recorded in Plat Book 1, Page
41 of the Public Records of Monroe County, Florida. RE#9508.
13. Old Settlers Park means the area described as follows:
A tract in Government Lot 2, Section 34, Township 62 South, Range 38 East, comprising
portions of Lots 16 & 17, according to the George I. McDonald Plat of the Albury
property, as recorded in Plat Book 1, Page 64, RE#90020, 90030, 90040-0001, 90070,
90090, 90100, 90120 and 90130 and that portion of Lot 16 as identified in Book 397
Page 737 of the Official Records of Monroe County.
B. Restrictions on alcoholic beverages
1. No person may possess any container containing alcoholic beverages
at the parks listed above in this section.
2. The Board of County Commissioners may waive the prohibition of this
section upon a resolution of the Board. Any waiver must require the presence of
security guards in the number the board determines is necessary to preserve public
order, and must require liability insurance, in a policy by a firm authorized to do
business in the State of Florida, naming Monroe County as an additional named
insured in a forma an amount satisfactory to the County Administrator.

C. Posting signs of enhanced penalties under, § 893. 73f IJfd), Florida Statutes.
The Director of Facilities Maintenance shall place signs warning of enhanced
penalties under §893.13(1)(d), Fla. Stat. for persons selling, manufacturing, delivering,
or possessing with the intent to sell, manufacture, or deliver, a controlled substance
within 200 feet of the parks listed above. said signs shall be placed at each park
entrance and at other locations near the parks' boundaries as the Director of Facilities
Maintenance shall consider likely avenues of exit and entry.
D. Park hours.
The parks listed above are open to the public, Monday through Sunday, from
7:30 AM until 10:30 PM. All persons and their vehicles that enter the parks during the
open hours must leave the parks by 10:30 PM. Any vehicles in the parks between 10:30
PM and 7:30 AM the following morning will be towed away at the vehicle owner's
expense.
E. Special events and assemblies.
1. Any person or organization who holds or conducts at any of the parks
listed above, a public assembly that is subject to Ordinance No. 030-1996, must obtain
approval under the provision of that ordinance.
2. Any person or organization who holds or conducts any special events
or assembly not subject to Ordinance No. 030-1996 must obtain approval and
scheduling through the Public Works Parks and Recreation Coordinator (the
coordinator) subject to already scheduled activities. A complete application, and
proof of insurance (if required) must be submitted to the coordinator at least seven
days prior to the event or assembly.
3. Athletic activity organizers who wish to use the recreational playing
field on multiple occasions during a sports season must obtain approval from and
schedule their activities with, the coordinator before the beginning of the season.
4. Athletic activity organizers who wish to use the tennis courts for
tournaments, etc., must schedule their activities with the coordinator before the
beginning of any such event.
F. Tennis court lights.
Tennis court lights may be used Monday through Sunday from ten minutes
before sunset until 10:30 PM.
G. Fires in permitted areas only.
No person may cook or light or maintain any fire at any park except in the
permanent grill structures provided by the County.
H. Signs.
The Director of Facilities Maintenance must post each park entrance with a
sign briefly summarizing the park rules established by this ordinance.

I Penalties.
Violations of this section shall be prosecuted in the some manner as
misdemeanors are prosecuted. Such violations shall be prosecuted in the name of
the state in a court having jurisdiction of misdemeanors by the prosecuting attorney
thereof and upon conviction shall be punished by a fine not to exceed five hundred
dollars ($500.00) or by imprisonment in the County jail not to exceed sixty (60) days or
by both such fine and imprisonment.
Section 3. If any section, subsection, sentence, clause or provision of this ordinance is
held invalid, the remainder of this ordinance shall not be affected by such invalidity.
Section 4. All ordinances or parts of ordinances in conflict with this ordinance are hereby
repealed to the extent of said conflict.
Section 5. The provisions of this ordinance shall be included and incorporated in the
Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform numbering system of the Code.
Section 6. This ordinance shall take effect immediately upon receipt of official notice
from the Office of the Secretary of State of the State of Florida that this ordinance has been filed with
said Office.
PASSED AND ADOPTED by the Board of County Commissioners of Monroe County, Florida, at a
regular meeting of said Board held on the 16th day of January, 1997.
