ORDINANCE No. 02 -1991
AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS
OF MONROE COUNTY, FLORIDA, AMENDING SEC. 6-31(a) &
(b) AND 6-41(c) & (e) IN ORDER TO INCREASE THE
FAIR MARKET VALUE OF NEW WORK NOT NEEDING A PERMIT
TO LESS THAN $1,000; ELIMINATE THE NEED FOR RESI-
DENTIAL DEMOLITION PERMITS WHEN THE FAIR MARKET
VALUE OF THE STRUCTURE TO BE DEMOLISHED IS LESS
THAN $1,000. PROVIDING ADDITIONAL CLARIFICATION OF
THE TERM "FAIR MARKET VALUE". CREATE SECTION 6-46
ENTITLED "WORKING THROUGH A STOP WORK ORDER/RED
TAG" WITH A MINIMUM $500 FINE, AUTOMATIC REVOCA-
TION OF ALL DEVELOPMENT ORDERS RELATED TO THE WORK
BEING DONE AND A 6 MONTH AUTOMATIC SUSPENSION OF
THE APPLICABLE CONTRACTORS PERMIT PULLING PRIVILEG-
ES. PROVIDING FOR SEVERABILITY; PROVIDING FOR_,

WHEREAS THE BOARD OF COUNTY COMMISSIONERS has directed that

there should be an increase in the fair market value fd4 new work
(not requiring a permit) from less than five hundred dollars
($500) to less than one thousand dollars ($1000); and
WHEREAS there is a need for the elimination of residential,
demolition permits when the fair market value of the structure
to be demolished, is less than one thousand dollars ($1,000) and
WHEREAS clarification of the term "fair market value" should
reflect the fact that neither "volunteer labor" and/or "free
material" can apply to the definition of "fair market value" and
WHEREAS the act of working through a "Stop Work Order/Red
Tag" is a serious violation of Section 103.3 of the Standard
Building Code and should be enforced and punished accordingly.
NOW THEREFORE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE
COUNTY, FLORIDA, that:
Section 1. Sec. 6-31 (a)(1) shall be amended as follows:
Site preparation permits which involve
land clearing, the placement of fill,
commercial demolition, blasting, excava-
tion, or the storage of materials.
Provided that no site preparation per-
mit shall be issued except in conjunc-
tion with the establishment of a use or
structure allowed in the district where
the site is located except that a site
preparation permit may be issued to
clear invasive exotic vegetation with-
out the establishment of a use or struc-
ture.
Section 2. Sec. 6-31 (b)(1) shall be amended as follows:
All new construction and remodeling
work, except as set forth in subsection
(a)(1) and (2), if the fair market
value of the construction or work is
less than five hundred 4$599} one
thousand dollars ($1,000), and interior
remodeling if the fair market value is
less than one thousand dollars ($1,000)
and residential, demolition when the
fair market value of the structure to
dollars ($1,000). For the purposes of
this subsection and subsection (b)(2),
Fair market value shall mean:
(i) An invoice for materials which
reflects an arms -length transac-
tion or, if no invoice is avail-
able, the cost of materials calcu-
lated as if the materials were
purchased pursuant to an arms -
length transaction; plus
(ii) Labor costs calculated pursuant to
the most recent edition of Means
Construction Data.
Section 3. Sec. 6-31(b)(1)(iii) shall be created to read
as follows:
(iii) "Voluntary labor" and/or "gift material"
cannot be used to represent fair market value

Section 4. Sec. 6-41(c) shall be amended as follows:
In lieu of the above, the person, firm
or corporation may remove all unpermit-
ted work and return the site to its
original condition. A demolition permit
shall be required for all commercial
work (regardless of value) and for
residential work when the fair market
value of the unpermitted work is one
thousand dollars ($1,000) or more.
Section 5. Sec. 6-41(e) shall be amended as follows:
In the event the construction work is
unpermittable under the Monroe County
Code, the site shall be restored to its
original condition. If demolition is
required, a demolition permit shall be
obtained for all commercial work (rP-
unpermitted work is ($1 000) or more
If land clearing was involved, the site
shall be restored pursuant to section
9 . 5 -119 (a) (1) - (4) , Monroe County Code.
Section 6. Section 6-46, Monroe County Code shall be created
to read as follows:
Section 6-46. Working through a
Stop Work Order/Red Tag
Any person or entity continuing to
perform work subsequent to the issuance
of a Stop Work Order/Red Tag shall be
fined a minimum of $500 by the Code
Enforcement Department. In addition
there shall be automatic revocation of
tractor(s) performing such work
Section 7. If any section, subsection, sentence, clause,
or provision of this Ordinance is held invalid, the remainder of
this Ordinance shall not be affected by such invalidity.

Section 8. All ordinances or parts of ordinances in con-
flict with this Ordinance are hereby repealed to the extent of
said conflict.
Section 9. The provisions of this Ordinance shall be
included and incorporated in the Code of Ordinances of the County
of Monroe, Florida, as an addition or amendment thereto, and
shall be appropriately renumbered to conform to the uniform num-
bering system of the Code.
Section 10. This Ordinance shall take effect immediately
upon receipt of official notice from the Office of the Secretary
of State of the State of Florida that this Ordinance has been
filed with said Office.

Enclosed please find a certified copy of Monroe County Ordinance No. 02-1997
amending Sec. 6-31(a) & (b) and 6-41(c) & (e) in order to increase the Fair Market
Value of new work not needing a permit to less than $1,000; eliminate the need for
residential demolition permits when the Fair Market Value of the structure to be
demolished is less than $1,000. Providing additional clarification of the term "Fair
Market Value". Create Section 6-46 entitled "Workingthrough a Stop Work Order/Red
Tag" with a minimum $500 Fine, automatic revocation of all Development Orders
related to the work being done, and a six month automatic suspension of the applicable
contractors permit pulling privileges; providing for severability; providing for the repeal
of all ordinances inconsistent herewith; providing for incorporation into the Monroe
County Code of Ordinances; and providing an effective date.
This Ordinance was adapted by the Monroe County Board of County
Commissioners at a Regular Meeting, in formal session, on January 16, 1997.
