Ordinance 018-1997Building Official ORDINANCE No.018 -1997 AN ORDINANCE WHICH AMENDS M.C.C. SECTION 6-31(a) & (b), IN ORDER TO ACHIEVE COMPATIBILITY WITH FLOOD PLAIN MANAGEMENT REQUIREMENTS (M.C.C. SEC- TION 9.5-125) IE: PERMITS ARE REQUIRED FOR ANY NEW WORK SUBJECT TO FLOOD PLAIN JURISDICTION; PROVIDING FOR SEVERABILITY; PROVIDING FOR RE- PEAL OF ALL ORDINANCES INCONSISTENT HEREWITH; PROVIDING FOR INCORPORATION INTO THE MONROE COUNTY CODE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS M.C.C. Section 6-31 exempts the requirement for permitting under certain circumstances; and WHEREAS M.C.C. Section 9.5-125 (flood plain management) mandates such permitting under the aforementioned circumstances; now, therefore BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF MONROE COUNTY, FLORIDA, that: Section 1. Section 6-31(a)(3) is hereby created to read as follows: " (3 ) Any work subject to f lood`7'pain Lmanagement requirements (M.C.C. 9.5-125)." w Section 2. Section 6-31 (b) (1) is hereby modifies to :'read w as follows: • • `= "(1) All new construction and remodeling work, except as set forth in subsection (a)(1) and (2) and (3), of the ---." Section 3. If any section, subsection, sentence, clause, or provision of this Ordinance is held invalid, the remainder of this Ordinance shall not be affected by such invalidity. Section 4. All ordinances or parts of ordinances in con- flict with this Ordinance are hereby repealed to the extent of said conflict. Section 5. The provisions of this Ordinance shall be included and incorporated in the Code of Ordinances of the County of Monroe, Florida, as an addition or amendment thereto, and shall be appropriately renumbered to conform to the uniform num- bering system of the Code. Section 6. This Ordinance shall take effect immediately upon receipt of official notice from the Office of the Secretary of State of the State of Florida that this Ordinance has been filed with said Office.
